BUSAN METROPOLITAN CITY ORDINANCE ON THE ESTABLISHMENT AND OPERATION OF THE BUSAN INNOVATION CITY COMPLEX INNOVATION CENTER

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to prescribe matters necessary for the establishment and operation of the Busan Innovation City Complex Innovation Center, thereby fostering Busan Innovation City as a regional growth hub, improving residential conditions, and contributing to regional development.
  • Article 2 (Location and facilities)
  • (1) The Busan Innovation City Complex Innovation Center (hereinafter referred to as the “Center”) shall be located at 14, Haeyang-ro 301beon-gil (Dongsam-dong), Yeongdo-gu, Busan Metropolitan City.
  • (2) The facilities of the Center are as follows:
    • 1. Basic facilities: cultural lecture rooms, small library, integrated children’s cultural space, childcare space, stepped plaza, etc.
    • 2. Rental facilities: exhibition and performance hall, small meeting room, large conference room, activity room
    • 3. Lease facilities: book cafe, convenience store, enterprise attraction space, etc.
  • Article 3 (Functions)
  • The functions of the Center are as follows:
    • 1. Formulating and implementing plans for efficient management and operation of the Center;
    • 2. Managing and operating facilities to improve residential conditions in the innovation city;
    • 3. Operating programs to promote citizens’ education, leisure, culture, and welfare;
    • 4. Supporting cooperation among enterprises housed in the Center and relocated public institutions & related institutions;
    • 5. Other matters the Mayor of Busan Metropolitan City (hereinafter referred to as the “Mayor”) deems necessary for the development of the innovation city and revitalization of the Center.
  • Article 4 (Permission to use and usage fees)
  • (1) A person who intends to use the facilities referred to in subparagraph 3 of Article 2 (2) shall obtain prior permission from the Mayor. The same shall apply where he or she intends to change any matters for which permission has been granted.
  • (2) To foster the innovation city as a regional growth hub under the Special Act on the Construction and Development of Innovation Cities, where an enterprise in an industry related to relocated public institutions (such as the maritime or financial sector) or a research institute, corporation, or organization intends to use the enterprise attraction space, the Mayor may, after separate screening, permit use by the method of private contract.
  • (3) A person permitted under paragraphs (1) and (2) shall pay usage fees under the Busan Metropolitan City Ordinance on Public Property Commodity Management.
  • Article 5 (Rental of facilities and rental fees)
  • (1) Any person who intends to rent the facilities referred to in subparagraph 2 of Article 2 (2) shall obtain prior approval from the Mayor. The same shall apply where he or she intends to change any approved matters.
  • (2) A person who intends to rent facilities shall pay the rental fees set forth in Appendix 1.
  • Article 6 (Reduction or exemption of rental fees)
  • (1) The Mayor may reduce or exempt rental fees in any of the following cases:
    • 1. Events hosted or organized by the State or a local government: full exemption of rental fees.
    • 2. Events hosted or organized by relocated public institutions of Busan Innovation City: 80 percent reduction of rental fees.
    • 3. Where the Mayor deems it necessary, such as for revitalization of the Center: 50 percent reduction of rental fees.
  • (2) A person who intends to receive all or part of the reduction or exemption of rental fees under paragraph (1) shall apply therefor in advance.
  • Article 7 (Cultural courses and tuition)
  • (1) To cultivate citizens’ refinement and promote leisure, the Mayor may operate courses in culture, sports, etc.
  • (2) A person who intends to take a course shall pay the tuition set forth in Appendix 1.
  • (3) The subjects and scope of tuition reductions under paragraph (2) shall be as set forth in Appendix 2.
  • Article 8 (Restriction on use of facilities)
  • The Mayor may restrict rental and use of facilities in any of the following cases:
    • 1. Where there is a concern that public order or good morals may be harmed;
    • 2. Where facilities or equipment may be damaged or where management may be impeded;
    • 3. Where a person carries articles that may harm others or interfere with use;
    • 4. Where a religious or political event and performance, etc. is to be held;
    • 5. Other cases the Mayor deems necessary.
  • Article 9 (Refund of rental fees)
  • The Mayor shall refund all or part of rental fees and tuition already received in any of the following cases:
    • 1. Where cancellation is made due to natural disasters or for reasons of public interest:
      • (a) If canceled by the day before the rental (course) date: full refund.
      • (b) If canceled on or after the rental (course) date: refund of the remaining amount after calculating, on a per diem basis, the portion for the days already rented (attended).
    • 2. Where cancellation is made at the request of the renter (participant):
      • (a) If canceled by the day before the rental (course) date: refund of the amount remaining after deducting 10 percent of the total rental (tuition) fee.
      • (b) If canceled on or after the rental (course) date: refund of the amount remaining after deducting 10 percent of the total rental (tuition) fee and then deducting, on a per diem basis, the portion corresponding to the days already rented (attended).
  • Article 10 (Restoration to original state)
  • (1) Where a person permitted to use the facilities under Article 2 (2) (hereinafter referred to as the “User”) intends to install special equipment, the User shall report such intention to the Mayor in advance; and upon completion or suspension of use, the User shall immediately remove the equipment and restore the site to its original state.
  • (2) Where the User fails to perform the obligation under paragraph (1), the Mayor may restore the site to its original state and collect the costs from the User.
  • (3) Where the User intentionally or negligently damages or loses facilities, such as equipment or devices in the Center, the User shall compensate for the damage or restore them to their original state.
  • Article 11 (Entrustment of the operation of the Center)
  • (1) For professional and efficient management and operation of the Center, the Mayor may entrust all or part of the affairs concerning its management and operation to any of the following:
    • 1. Corporations, public corporations, or institutions established by, or invested in or contributed to by, Busan Metropolitan City;
    • 2. Corporations or organizations recognized as having the capacity to perform affairs for the management and operation of the Center.
  • (2) Where the management and operation of the Center are entrusted under paragraph (1), the Mayor may, within budgetary limits, subsidize all or part of the expenses to the trustee.
