BUSAN METROPOLITAN CITY ORDINANCE ON FOSTERING AND SUPPORTING HARBOR-RELATED INDUSTRIES

- Article 1 (Purpose)
- The purpose of this Ordinance is to prescribe matters necessary to foster and support harbor-related industries, thereby contributing to strengthening the competitiveness of Busan’s harbor and logistics industries and revitalizing the local economy.
- Article 2 (Definitions)
- The terms used in this Ordinance are defined as follows:
- 1. The term “harbor-related industries” means the following businesses:
- (a) business of providing goods or services to ships in the harbor, which includes harbor service business, ship stores supply business, bunker fuel supplying business, ship repairing business, and container repairing business under Article 2 (4) of the Harbor Transport Business Act (hereinafter referred to as the “Act”);
- (b) Inspection business, appraisal business, and weighing business under Article 3 (2) through (4) of the Act;
- (c) Tugboat business at trade harbors under Article 24 (1) of the Act on the Arrival and Departure of Ships;
- (d) Excursion ship business and ferry business under subparagraphs 1 and 2 of Article 2 of the Excursion Ship and Ferry Business Act.
- 2. The term “harbor-related business operator” means any of the following:
- (a) A person registered for a harbor transport business under Article 26-3 of the Act;
- (b) A person registered for an inspection, appraisal, or weighing business under Article 4 of the Act;
- (c) A person registered for a tugboat business under Article 24 (1) of the Act on the Arrival and Departure of Ships;
- (d) A person registered for an excursion ship or ferry business under Article 2 of the Excursion Ship and Ferry Business Act.
- 1. The term “harbor-related industries” means the following businesses:
- Article 3 (Responsibilities of the Mayor)
- The Mayor of Busan Metropolitan City (hereinafter referred to as the “Mayor”) shall formulate and implement necessary policies to foster harbor-related industries as high value-added industries so as to enhance the global competitiveness of Busan Harbor.
- Article 4 (Relationship with other ordinances)
- Except as otherwise provided in other ordinances, matters concerning the fostering and support of harbor-related industries shall be governed by this Ordinance.
- Article 5 (Basic Plan for the fostering of harbor-related industries)
- (1) To systematically foster and support harbor-related industries, the Mayor may formulate a basic plan of Busan Metropolitan City for the fostering of harbor-related industries (hereinafter referred to as the “Basic Plan”).
- (2) The Basic Plan under paragraph (1) shall include the following:
- 1. Current status and outlook of harbor-related industries;
- 2. Goals and directions for fostering harbor-related industries;
- 3. Promotion strategies and implementation plans by sector for harbor-related industries;
- 4. Measures to improve systems related to harbor-related industries and to strengthen support;
- 5. Measures to improve service quality and occupational safety in harbor-related industries;
- 6. Matters concerning the establishment of infrastructure and distribution systems for harbor-related industries;
- 7. Other matters the Mayor deems necessary to foster and support harbor-related industries.
- Article 6 (Fact-finding survey)
- To efficiently formulate and implement the Basic Plan and policies necessary to foster and support harbor-related industries, the Mayor may conduct fact-finding surveys on harbor-related industries.
- Article 7 (Project implementation)
- (1) To foster harbor-related industries, the Mayor may implement the following projects:
- 1. Statistical surveys related to harbor-related industries;
- 2. Improvement of distribution structures in harbor-related industries;
- 3. Establishment and improvement of digital platforms for harbor-related industries;
- 4. Support for entry into overseas markets by harbor-related industries;
- 5. Cultivation and supply of professional human resources for harbor-related industries;
- 6. Improvement of the business environment for harbor-related industries;
- 7. Other projects the Mayor deems necessary to foster harbor-related industries.
- (2) The Mayor may subsidize, within budgetary limits, all or part of the necessary expenses to institutions and organizations that implement the projects under paragraph (1).
- Article 8 (Establishment of the Council on the Fostering of Harbor-related Industries)
- (1) To foster and support harbor-related industries, the Mayor may establish the Busan Metropolitan City council on the Fostering of Harbor-related Industries (hereinafter referred to as the “Council”).
- (2) The Council shall deliberate on and resolve the following:
- 1. Matters concerning the formulation and amendment of the Basic Plan;
- 2. Matters concerning the implementation and support of projects related to harbor-related industries under Article 7;
- 3. Other matters the Mayor deems necessary to foster and support harbor-related industries.
- Article 9 (Composition of the Council)
- (1) The Council shall be composed of not more than 15 members, including 1 chairperson and 1 vice-chairperson. The chairperson shall be the head of the office and bureau in charge of harbor-related industry affairs, and the vice-chairperson shall be elected from among the commissioned members.
- (2) Council members shall be appointed or commissioned by the Mayor, taking gender into consideration, from among the following:
- 1. Members of the Busan Metropolitan Council;
- 2. Public officials affiliated with Busan Metropolitan City who are in charge of harbor-related industry affairs;
- 3. Persons with extensive expert knowledge and experience related to harbor-related industries;
- 4. Harbor-related business operators affiliated with organizations and associations related to harbor-related industries;
- 5. Persons with extensive expert knowledge and experience in corporate management consulting;
- 6. Experts in the field of harbor-related industries affiliated with public institutions and research institutes;
- 7. Other persons the Mayor deems necessary to foster and support harbor-related industries.
- (3) The term of office of commissioned members shall be 2 years and may be renewed only once.
- Article 10 (Operation of the Council)
- (1) The chairperson shall convene meetings of the Council and preside over them.
- (2) Meetings of the Council shall open with the attendance of a majority of the incumbent members, and resolutions shall be adopted by a majority of the members present.
- (3) One secretary may be appointed to handle the affairs of the Council, and the secretary shall be the head of the division in charge of harbor-related industry affairs.
- Article 11 (Establishment of a cooperation system)
- To systematically foster harbor-related industries, the Mayor shall establish a close cooperation system with central government ministries, related agencies, and organizations and associations of harbor-related industries.
