BUSAN METROPOLITAN CITY ORDINANCE ON THE FOSTERING OF THE USED BATTERY INDUSTRY FOR ELECTRIC VEHICLES

- Article 1 (Purpose)
- The purpose of this Ordinance is to prescribe matters necessary to foster the used batteries industry for electric vehicles, thereby contributing to the realization of a carbon neutral society and the revitalization of the local economy.
- Article 2 (Definitions)
- The terms used in this Ordinance are defined as follows:
- 1. The term “electric vehicle” means an electric vehicle under Article 2 (3) of the Act on the Promotion of Development and Distribution of Environment-Friendly Motor Vehicles;
- 2. The term “battery” means a cell that stores electrical energy supplied from an external source as chemical energy and then reconverts it to electrical energy to provide power when needed;
- 3. The term “reuse” means enabling a used battery from an electric vehicle to be used again in production activities as is, after performance evaluation and inspection;
- 4. The term “remanufacturing” means restoring a used battery from an electric vehicle to its original performance or higher through processes such as disassembly, cleaning, inspection, repair, adjustment, and reassembly;
- 5. The term “recycling” means recovering and re-resourcing materials or raw materials by dismantling, disassembling, shredding, etc. a used battery from an electric vehicle from which energy has been removed.
- Article 3 (Responsibilities of the Mayor)
- The Mayor of Busan Metropolitan City (hereinafter referred to as the “Mayor”) shall establish and implement necessary policies to foster the used batteries industry for electric vehicles.
- Article 4 (Formulation and implementation of a Basic Plan)
- (1) To foster the used batteries industry for electric vehicles, the Mayor may, every 5 years, formulate and implement a basic plan of Busan Metropolitan City for the promotion of the used batteries industry for electric vehicles (hereinafter referred to as the “Basic Plan”) including the following matters:
- 1. Basic directions and goals;
- 2. Sector-specific promotion strategies and tasks;
- 3. Industrial trends and outlook;
- 4. Policies for fostering and supporting the industry;
- 5. Cultivation of professional human resources;
- 6. Establishment of an industry–academia–research cooperation system;
- 7. Other matters the Mayor deems necessary.
- (2) The Mayor may formulate and implement an implementation plan in accordance with the Basic Plan.
- (3) The Mayor may include the Basic Plan and the implementation plan in the Basic Plan and implementation plan under Article 5 of the Busan Metropolitan City Ordinance on the Promotion and Support of the Secondary Battery Industry.
- Article 5 (Fact-finding survey)
- (1) To efficiently formulate and promote the Basic Plan and implementation plan under Article 4, the Mayor may conduct fact-finding surveys on domestic and overseas trends, technologies, and the status of the used batteries industry for electric vehicles.
- (2) The Mayor may entrust the fact-finding surveys under paragraph (1) to specialized institutions or organizations and, in such cases, may subsidize the necessary expenses within budgetary limits.
- Article 6 (Promotion projects)
- (1) To foster the used batteries industry for electric vehicles, the Mayor may implement the following projects:
- 1. Research and development related to reuse, remanufacturing, and recycling;
- 2. Education and training for cultivating professional human resources;
- 3. Attraction of enterprises and research institutions, etc.;
- 4. Holding, attracting, and participating in events such as seminars and exhibitions;
- 5. Installation and expansion of facilities related to used batteries;
- 6. Other matters the Mayor deems necessary.
- Article 7 (Financial support)
- (1) The Mayor may subsidize all or part of the expenses, within budgetary limits, to institutions, corporations, or organizations that implement the projects under Article 6.
- (2) Methods and procedures for subsidizing expenses under paragraph (1) shall be governed by the Busan Metropolitan City Ordinance on the Management of Subsidies.
- Article 8 (Entrustment of affairs)
- (1) For efficient implementation of the projects under Article 6, the Mayor may entrust all or part of affairs to related institutions, corporations, or organizations.
- (2) Where affairs are entrusted under paragraph (1), the Mayor may subsidize all or part of the expenses within budgetary limits.
- (3) Where affairs are entrusted under paragraph (1), matters not prescribed in this Ordinance shall be governed by the Busan Metropolitan City Framework Ordinance on Entrustment and the Busan Metropolitan City Ordinance on Entrustment and Agency of Affairs to Public Institutions.
- Article 9 (Research and development)
- (1) To foster the used batteries industry for electric vehicles, prevent safety accidents, and enhance technological capability, industry–academia–research and the public and private sectors may jointly promote research and development.
- Article 10 (Establishment of a cooperation system)
- To foster the used batteries industry for electric vehicles, the Mayor may establish a cooperation system with relevant public and private sectors.

- This Ordinance shall enter into force on the date of its promulgation.
