BUSAN METROPOLITAN CITY ORDINANCE ON THE PROMOTION OF THE ARTIFICIAL INTELLIGENCE INDUSTRY AND THE FACILITATION OF THE INTRODUCTION AND UTILIZATION OF ARTIFICIAL INTELLIGENCE

- Article 1 (Purpose)
- The purpose of this Ordinance is to prescribe matters necessary for promoting the artificial intelligence (AI) industry and facilitating the Introduction and utilization of AI across society, thereby contributing to the growth of local industries and the improvement of citizens’ quality of life.
- Article 2 (Definitions)
- The terms used in this Ordinance shall be as defined in Article 2 of the Framework Act on the Development of Artificial Intelligence and the Establishment of Trust.
- Article 3 (Basic principles and responsibilities of the Mayor)
- (1) AI technologies and the AI industry shall develop in a direction that enhances safety and reliability and improves citizens’ quality of life.
- (2) The Mayor of Busan Metropolitan City (hereinafter referred to as the “Mayor”) shall endeavor to minimize regulation by respecting the creativity of AI business operators, and shall establish policies to foster related industries and to raise productivity and value through convergence with other industries and services.
- (3) In response to changes brought by AI in all areas—such as society, the economy, culture, and citizens’ daily lives—the Mayor shall devise policies to enable all citizens to use AI technologies and services in a stable and accessible manner.
- Article 4 (Relationship with other ordinances)
- (1) Except as otherwise provided by other ordinances with special provisions concerning artificial intelligence, AI technologies, the AI industry, and an AI society (hereinafter referred to as “AI, etc.”), matters shall be governed by this Ordinance.
- (2) Where other ordinances are enacted or amended concerning AI, etc., they shall conform to the purpose of this Ordinance.
- Article 5 (Formulation and implementation of an Implementation Plan)
- (1) Each year, to promote AI technologies and the AI industry and to facilitate the Introduction and utilization, the Mayor shall formulate and implement an implementation plan for the promotion of the AI Industry and the facilitation of the introduction and utilization of AI (hereinafter referred to as the “Implementation Plan”).
- (2) In formulating the Implementation Plan, the Mayor shall reflect the basic plan for the promotion of the information and communications industry and the vitalization of convergence under Article 7 of the Busan Metropolitan City Ordinance on the Promotion of the Information and Communications Industry and the Vitalization of Convergence, and shall submit the Implementation Plan along with the performance report of the previous year’s Implementation Plan to the Busan Metropolitan City Artificial Intelligence Committee under Article 6.
- (3) The Implementation Plan shall include the following:
- 1. Basic directions and strategies of policies concerning AI, etc.;
- 2. Matters concerning the cultivation of professional human resources for systematically fostering the AI industry and the establishment of a foundation to promote AI development and utilization;
- 3. Matters concerning systems and culture for realizing a sound AI society, including the dissemination of AI ethics;
- 4. Matters concerning the securing of resources and directions of investment for AI technology development and the promotion of the AI industry;
- 5. Matters concerning the creation of a trust-based foundation, including securing fairness, transparency, accountability, and safety of AI;
- 6. Matters concerning the directions of development of AI technologies and the resulting changes and responses in various social sectors, including education, labor, the economy, and culture;
- 7. Other matters the Mayor deems necessary to promote the AI industry and to facilitate the Introduction and utilization of AI.
- Article 6 (Artificial Intelligence Committee)
- (1) The Busan Metropolitan City Artificial Intelligence Committee (hereinafter referred to as the “Committee”) may be established to deliberate and resolve on matters concerning the promotion of the AI industry and the facilitation of the Introduction and utilization of AI.
- (2) The Committee shall be composed of not more than 25 members, including 1 chairperson and 1 vice-chairperson.
- (3) The Mayor shall serve as the chairperson of the Committee; the vice-chairperson shall be elected from among the members; and, where necessary, one of the commissioned members may be designated as a co-chairperson.
- (4) Members shall be appointed or commissioned by the Mayor, taking gender into consideration, from among the following:
- 1. Public officials of Grade 4 or higher affiliated with Busan Metropolitan City;
- 2. Persons recommended by the Busan Metropolitan Council;
- 3. Persons with extensive knowledge and experience related to AI;
- 4. Other persons recognized by the Mayor as having AI-related expertise.
- (5) The term of office of commissioned members shall be 2 years and may be renewed only once.
- (6) 1 secretary shall be appointed to handle the affairs of the Committee, and the secretary shall be the head of the division in charge of AI policy affairs.
- (7) Where necessary for performing work by specialty and discussing specific pending issues, subcommittees, special committees, or advisory groups may be established as determined by the Mayor.
- (8) Members of the Committee shall not divulge secrets learned in the course of their duties to others or use them for purposes other than official duties; provided, this shall not apply where otherwise specially provided by other Acts or ordinances.
- (9) The chairperson shall convene meetings of the Committee and preside over them.
- (10) Meetings of the Committee shall open with the attendance of a majority of the members and resolutions shall be adopted by a majority of the members present.
- (11) Commissioned members and relevant experts who attend meetings of the Committee may be paid allowances and travel expenses within budgetary limits.
- (12) Matters necessary for the Committee other than those prescribed in this Ordinance shall be determined by the chairperson following a resolution of the Committee.
- Article 7 (Functions of the Committee)
- (1) The Committee shall deliberate on and resolve the following:
- 1. Matters concerning the formulation and implementation monitoring and analysis of the Implementation Plan;
- 2. Matters concerning the identification and improvement of regulations that impede the development and competitiveness of the AI industry;
- 3. Matters concerning plans to expand infrastructure related to AI and AI technology development;
- 4. Matters concerning the promotion of AI utilization in industrial sectors such as manufacturing and services, and in the public sector;
- 5. Matters concerning recommendations or expression of opinions under paragraph (2);
- 6. Matters prescribed by this Ordinance or other ordinances as matters for deliberation by the Committee;
- 7. Other matters the chairperson of the Committee deems necessary to refer to a meeting of the Committee.
- (2) The Committee may make recommendations or express opinions to the heads of agencies directly under the Mayor and business offices under the Busan Metropolitan City Ordinance on the Establishment of Administrative Organizations, as well as to institutions invested in or contributed to by the City established by the Mayor under Article 4 of the Act on the Operation of Local Government-Invested or – Funded Institutions, and to AI business operators (hereinafter collectively referred to as “Affiliated Institutions, etc.”), regarding the proper use of AI, the practice of AI ethics, and the safety and reliability of AI technologies.
- (3) Where the Committee makes recommendations or expresses opinions under paragraph (2) to the head of an affiliated institution, etc. regarding the improvement of systems or the formulation of Implementation Plan, the head of the relevant affiliated institution, etc. shall endeavor to actively reflect such recommendations or opinions.
- Article 8 (Support for AI technology development, introduction and utilization)
- The Mayor may support the following projects to promote the development of AI technologies by enterprises and Affiliated Institutions, etc., and to facilitate their Introduction and utilization:
- 1. Surveys on domestic and overseas AI technology trends and levels and related systems;
- 2. Research and development, testing and evaluation of AI technologies, or the utilization of developed technologies;
- 3. Support for the diffusion of AI technologies, cooperation and transfer of AI technologies, and the commercialization and practical use of technologies;
- 4. Opening of facilities, machinery, and equipment, etc., for support under subparagraphs 2 and 3;
- 5. Support for expansion and joint use, etc., of AI technology development facilities and equipment;
- 6. Smooth distribution of information necessary to implement AI technologies and industry-academia cooperation;
- 7. Support for international exchanges related to the AI industry and for entry into overseas markets;
- 8. Consulting support for enterprises and Affiliated Institutions, etc. that intend to adopt and utilize AI technologies;
- 9. Support for funds used for the Introduction and utilization of AI technologies by enterprises;
- 10. Other matters the Mayor deems necessary to promote the Introduction and utilization of AI technologies by enterprises and Affiliated Institutions, etc.
- Article 9 (Facilitation of start-ups)
- To facilitate start-ups in the AI industry sector, the Mayor may implement the following projects:
- 1. Projects for discovering, fostering, and supporting founders in the AI industry sector;
- 2. Projects for education and training to facilitate start-ups in the AI industry sector;
- 3. Support for the commercialization of excellent AI technologies of professional human resources under Article 10;
- 4. Provision of outcomes of AI-related research and technology development;
- 5. Other projects the Mayor deems necessary to facilitate start-ups in the AI industry sector.
- Article 10 (Cultivation of professional human resources)
- (1) To develop AI technologies and advance the AI industry, the Mayor may cultivate and support professional human resources related to AI and AI technologies.
- (2) To cultivate professional human resources related to AI and AI technologies, the Mayor may implement the following policies:
- 1. Support for the establishment of facilities and equipment and for education and training to cultivate professional human resources in AI and AI technologies;
- 2. Establishment of an Industry-Academia-Research cooperation system for the cultivation of professional human resources;
- 3. Surveys and analyses of domestic and overseas demand for professional AI human resources, and support for their domestic and overseas employment;
- 4. Support for the overseas expansion of AI research institutes and universities, and for attracting overseas AI research institutes;
- 5. Support for attracting international events related to AI and AI technologies;
- 6. Other matters the Mayor deems necessary to cultivate professional human resources.
- Article 11 (Entrustment of affairs)
- (1) To efficiently perform affairs related to promoting the AI industry and the facilitating the introduction and utilization of AI, the Mayor may entrust all or part of the affairs to relevant corporations or organizations.
- (2) Where affairs are entrusted under paragraph (1), matters not prescribed in this Ordinance shall be governed by the Busan Metropolitan City Framework Ordinance on the Entrustment and the Busan Metropolitan City Ordinance on Entrustment and Agency of Affairs to Public Institutions.
ADDENDUM
Ordinance No. 7646, Jul. 9, 2025
- Article 1 (Enforcement date) This Ordinance shall enter into force on the date of its promulgation.
- Article 2 (Period of existence of the Committee) The Committee under Article 6 shall exist until Jun. 30, 2030.
