BUSAN METROPOLITAN CITY ORDINANCE ON THE PROMOTION OF NIGHT TOURISM : City Government

●Article 1 (Purpose)
●The purpose of this Ordinance is to prescribe matters necessary to promote night tourism in Busan Metropolitan City, thereby contributing to the sustainable development of the local tourism industry and the revitalization of the local economy.

●Article 2 (Definitions)
●The terms used in this Ordinance are defined as follows:
○1. The term “night tourism” means acts or phenomena of tourism that take place during night-time hours, before sunrise and after sunset, targeting various tourism contents such as tourist attractions, festivals, and tourism convenience facilities, etc.;
○2. The term “night tourism business” means any and all businesses that provide transportation, accommodation, food, entertainment, recreation, or services for night tourists, or that equip facilities for night-tourism activities for use by tourists.

●Article 3 (Responsibilities of the Mayor)
●The Mayor of Busan Metropolitan City (hereinafter referred to as the “Mayor”) shall endeavor to formulate and implement policies necessary to promote night tourism.

●Article 4 (Formulation of a night tourism Promotion Plan)
●(1) To promote night tourism, the Mayor shall formulate and implement, every 5 years, a night tourism promotion plan of Busan Metropolitan City (hereinafter referred to as the “Promotion Plan”) that includes the following matters:
○1. Matters concerning the establishment of a foundation for and the promotion of night tourism;
○2. Matters concerning the development of night tourism programs and contents;
○3. Matters concerning public-private cooperation systems related to night tourism businesses;
○4. Matters concerning publicity for night tourism;
○5. Matters concerning the nurturing and securing of professional human resources for night tourism;
○6. Matters concerning financing plans for the promotion of night tourism;
○7. Other matters the Mayor deems necessary to promote night tourism.
●(2) The Mayor may include the Promotion Plan under paragraph (1) in the Busan Metropolitan City Tourism Promotion Plan under Article 4 of the Busan Metropolitan City Ordinance on the Promotion of Tourism.

●Article 5 (Fact-finding survey)
●Where necessary to efficiently formulate and implement the Promotion Plan under Article 4, the Mayor may conduct fact-finding surveys on the status of night tourism and on project targets, etc.

●Article 6 (Night tourism promotion projects)
●(1) To promote night tourism, the Mayor may implement the following projects:
○1. Projects for discovering and developing night tourism products, programs, and contents;
○2. Foundation-building projects such as the installation of facilities to promote night tourism;
○3. Projects to establish a publicity system for night tourism;
○4. Research and surveys for the promotion of night tourism;
○5. Projects for training professional human resources related to night tourism and for capacity-building education;
○6. Operation of night tourism festivals and events;
○7. Other projects the Mayor deems necessary to promote night tourism.
●(2) The Mayor may subsidize all or part of the expenses, within budgetary limits, to institutions, corporations, or organizations that implement the projects under paragraph (1).
●(3) Methods and procedures for subsidizing expenses under paragraph (2) shall be governed by the Busan Metropolitan City Ordinance on the Management of Subsidies.

●Article 7 (Establishment of the Night Tourism Promotion Committee)
●(1) The Mayor may establish the Busan Metropolitan City Night Tourism Promotion Committee to deliberate and advise on the following matters related to the promotion of night tourism:
○1. Matters concerning the formulation and amendment of the Promotion Plan under Article 4;
○2. Matters concerning the night tourism promotion projects under Article 6;
○3. Matters concerning performance evaluation of night tourism promotion projects;
○4. Other matters the Mayor deems necessary to promote night tourism.
●(2) Matters subject to deliberation and advice under paragraph (1) shall be deliberated on and advised by the Busan Metropolitan City Tourism Promotion Committee under the Busan Metropolitan City Ordinance on the Promotion of Tourism. In such cases, the Busan Metropolitan City Tourism Promotion Committee shall be deemed the Busan Metropolitan City Night Tourism Promotion Committee under paragraph (1).

●Article 8 (Entrustment of affairs)
●(1) For efficient implementation of the projects under Article 6, the Mayor may entrust all or part of affairs to related institutions, corporations, or organizations.
●(2) Where affairs are entrusted under paragraph (1), the Mayor may subsidize all or part of the expenses within budgetary limits.
●(3) Where affairs are entrusted under paragraph (1), matters not prescribed in this Ordinance shall be governed by the Busan Metropolitan City Framework Ordinance on Entrustment and the Busan Metropolitan City Ordinance on Entrustment and Agency of Affairs to Public Institutions.

●Article 9 (Establishment of a cooperation system)
●The Mayor may establish a cooperation system with relevant institutions or corporations/organizations to promote night tourism.

●Article 1 (Enforcement date) This Ordinance shall enter into force on the date of its promulgation.
●Article 2 (Amendment of other Ordinances) Part of the Busan Metropolitan City Ordinance on the Promotion of Tourism shall be amended as follows: Subparagraph 10 of Article 7 moved to subparagraph 11, and subparagraph 10 Added as follows: 10. Matters concerning each subparagraph of Article 7 (1) of the Busan Metropolitan City Ordinance on the Promotion of Night Tourism.
