CHAPTER I GENERAL PROVISIONS

  • Article 1 (Purpose)

  • The purpose of this Ordinance is to prescribe matters necessary for the operation of municipal performance venues established to satisfy citizens’ diverse demand for culture and the arts and to contribute to the promotion of culture and the arts.

  • Article 2 (Names and locations)

  • The names and locations of the Busan Metropolitan City Municipal Performance Venues (hereinafter referred to as the “Performance Venues”) shall be as follows:

    • 1. Busan Opera House: Within the Marine Cultural District in the North Port Redevelopment District, Jung-gu, Busan Metropolitan City
    • 2. Busan Concert Hall: 250, Dongpyeong-ro (Yeonji-dong), Busanjin-gu, Busan Metropolitan City
  • Article 3 (Main projects)

  • The main projects of the Performance Venues shall be as follows:

    • 1. Planning and attracting performance and exhibition of excellent culture and arts works;
    • 2. Providing venues for performance and exhibition to promote culture and the arts;
    • 3. Operating culture and arts education programs;
    • 4. Advertising and leasing projects for the operation of the Performance Venues;
    • 5. Other projects the Mayor of Busan Metropolitan City (hereinafter referred to as the “Mayor”) deems necessary for the promotion of culture and the arts.

CHAPTER II OPERATION OF COMMITTEE

  • Article 4 (Operation Advisory Committee)

  • (1) To advise on the following matters concerning the operation of the Performance Venues, an Operation Advisory Committee for the Performance Venues (hereinafter referred to as the “Advisory Committee”) shall be established:

  • 1. Matters concerning directions for promoting main projects and development;

  • 2. Matters concerning annual performance planning and operation;

  • 3. Other matters requiring expert opinions concerning the operation of the Performance Venues.

  • (2) The Advisory Committee shall be composed of not more than 11 members, including 1 chairperson and 1 vice-chairperson; the chairperson shall be elected from among the members, and the vice-chairperson shall be designated by the chairperson from among the members.

  • (3) The ex officio member of the Advisory Committee shall be the Director of the Performance Venue, and the commissioned members shall be appointed by the Mayor, taking gender into consideration, from among persons with extensive knowledge and experience in fields related to culture and the arts and from among persons recommended by civil society organizations.

  • (4) The term of office of commissioned members shall be 2 years and may be renewed only once; provided, the term of office of a member commissioned to fill a vacancy shall be the remaining term of his or her predecessor.

  • (5) The chairperson shall convene meetings of the Advisory Committee. In such cases, a meeting shall open with the attendance of a majority of the incumbent members, and resolutions shall be adopted by a majority of the members present.

  • (6) Matters necessary for the operation of the Advisory Committee, other than those prescribed in this Ordinance, shall be determined by the chairperson following a resolution of the Advisory Committee.

  • Article 5 (Performance Venue Rental Deliberation Committee)

  • (1) To deliberate on matters concerning the granting of permission for rental, etc. of the Performance Venues, a Performance Venue Rental Deliberation Committee (hereinafter referred to as the “Deliberation Committee”) shall be established.

  • (2) The Deliberation Committee shall be composed of not more than 11 members, including 1 chairperson and 1 vice-chairperson; the Director of the Performance Venue shall serve as the chairperson, and the vice-chairperson shall be elected from among the members.

  • (3) The ex officio members of the Deliberation Committee shall be the team leaders in charge of the Performance Venue’s affairs, and the commissioned members shall be appointed by the Mayor, taking gender into consideration, from among persons with extensive knowledge and experience in fields related to culture and the arts; provided, a majority of the members shall be commissioned members.

  • (4) The term of office of commissioned members shall be 2 years and may be renewed only once; provided, the term of office of a member commissioned to fill a vacancy shall be the remaining term of his or her predecessor.

  • (5) The chairperson shall convene meetings of the Deliberation Committee. In such cases, a meeting shall open with the attendance of a majority of the incumbent members, and resolutions shall be adopted by a majority of the members present.

  • (6) Matters necessary for the operation of the Deliberation Committee, other than those prescribed in this Ordinance, shall be determined by the chairperson following a resolution of the Deliberation Committee.

  • Article 5-2 (Subcommittee)

  • (1) Notwithstanding Article 5, a Subcommittee may be established to deliberate on the following matters:

  • 1. Use of the lobby, outdoor performance venues, exhibition rooms, etc.;

  • 2. Rentals arising from cancellation of rentals.

  • (2) The Director of the Performance Venue shall serve as the chairperson of the Subcommittee, and the Subcommittee shall be composed of not more than 5 members designated by the chairperson from among the members of the Deliberation Committee.

  • (3) Deliberation and resolutions of the Subcommittee shall be deemed deliberation and resolutions of the Deliberation Committee. [This Article Added on Jul. 3, 2024]

  • Article 6 (Dismissal of members)

  • The Mayor may dismiss a member where the member falls under any of the following:

  • 1. Where the member expresses an intention that it is difficult to perform his or her duties;

  • 2. Where there is a corrupt act related to duties;

  • 3. Where the member fails to recuse himself or herself notwithstanding falling under paragraph (1) of Article 7;

  • 4. Where the member is deemed unfit due to negligence of duties, damage to dignity, or other reasons.

  • Article 7 (Disqualification and recusal of members)

  • (1) A member shall be disqualified from deliberation where the member has a direct interest in the relevant agenda item or where there exist other significant reasons to prevent fairness.

  • (2) A member who falls under paragraph (1) shall voluntarily recuse himself or herself from deliberation on the relevant agenda item.

CHAPTER III USE OF FACILITY

  • Article 8 (Opening and closing)

  • The Performance Venues shall be open year-round except on the following closed days; provided, the Mayor may designate or adjust closed days where necessary for operation of the Performance Venues:

  • 1. January 1;

  • 2. Every Monday (limited to the basic facilities under Article 10).

  • Article 9 (Hours of use)

  • (1) Hours of use of the Performance Venue facility shall be as follows:

  • 1. Morning: 09:00 to 12:00

  • 2. Afternoon: 13:00 to 17:00

  • 3. Evening: 18:00 to 22:00

  • (2) Where a person intends to use the Performance Venues during the morning or afternoon, instruments and performance equipment shall be removed within the hours of use.

  • (3) Notwithstanding paragraph (1), where deemed necessary, the Mayor may allow use during late-night hours (22:00–09:00).

  • Article 10 (Classification of facilities)

  • Facilities of the Performance Venues shall be classified as follows.

    • 1. Basic facilities: Grand Performance Hall; Small Performance Hall
    • 2. Ancillary facilities: Lobby, practice rooms, lecture rooms, conference rooms, outdoor performance venues, exhibition rooms, etc.
    • 3. Stage facilities: Stage equipment, sound equipment, lighting equipment, heating and cooling equipment, and all other auxiliary equipment necessary for performances and events
  • Article 11 (Permission for use and cancellation)

  • (1) A person who intends to use the Performance Venues shall obtain permission from the Mayor. The same shall apply where a person who has obtained permission for use (hereinafter referred to as the “User”) intends to change the particulars of such permission.

  • (2) A person who intends to obtain permission under paragraph (1) shall submit to the Mayor an application for permission to use stating the performance plan, etc.

  • (3) When deciding whether to grant permission for use, the Mayor may adjust the period of use or attach necessary conditions for the proper maintenance and management of the facilities.

  • (4) Article 25 of the Public Property and Commodity Management Act shall apply mutatis mutandis to the cancellation of permission for use.

  • Article 12 (Restrictions on permission for use)

  • The Mayor may refuse to grant permission for use where any of the following applies:

  • 1. Where there is a concern that public order or good morals may be undermined;

  • 2. Where the applicant has failed to fulfill the obligations of a User;

  • 3. Missionary or proselytizing acts of religion;

  • 4. Performances for political purposes;

  • 5. Other cases where the Deliberation Committee deems it necessary to restrict permission for use.

  • Article 13 (Use contract and fees for use)


  • (1) A person who has obtained permission for use shall conclude a use contract by the deadline determined by the Mayor.

  • (2) Fees for use of Performance Venue facilities shall be imposed as prescribed in Appendix 1.

  • (3) Upon concluding a use contract, the User shall pay a deposit equivalent to 30 percent of the basic facilities’ fees for use, and the remaining fees for use shall be paid by the earlier of 30 days before the commencement date of use and the date on which ticket sales commence; provided, where the period from the date of permission for use to the commencement date of use is within 30 days, the total fees for use shall be paid within 5 days after the conclusion of the contract.

  • Article 14 (Reduction and exemption of fees for use)

  • (1) The Mayor may exempt fees for use only for performances or events directly hosted and organized by the State or Busan Metropolitan City (hereinafter referred to as the “City”).

  • (2) The Mayor may reduce the basic fees for use by up to 30 percent in any of the following cases:

    • 1. Pure art performances sponsored by the State or the City;
    • 2. Performances directly hosted and organized by an arts corporation or arts organization designated by the City.
  • Article 15 (Refund of fees for use)

  • In any of the following cases, the Mayor shall refund all or part of the fees for use to the User:

  • 1. Where permission for use is cancelled due to force majeure or due to the Mayor’s need for the public interest:

  • (a) Where cancelled by the day before the commencement date of use: Full refund.

  • (b) Where cancelled after the commencement date of use: Refund of the remaining fees for use after prorating for the days used.

  • 2. Where permission for use is cancelled at the User’s request:

  • (a) Where cancelled by the 30 days before the commencement date of use: Refund of the amount after deducting 30 percent of the total fees for use.

  • (b) Where cancelled by the day before the commencement date of use: Refund of the amount after deducting 50 percent of the total fees for use.

  • (c) Where cancelled after the commencement date of use: Refund of the amount after deducting 50 percent of the total fees for use and, from the remaining amount, deducting the prorated amount corresponding to the days used.

  • Article 16 (User’s equipment)

  • (1) Where a User intends to install special equipment during the period of use, the User may install such equipment at his or her own expense upon prior approval by the Mayor.

  • (2) A User who has installed equipment under paragraph (1) shall remove such equipment and restore the original state within the period of use.

  • (3) Where the User fails to fulfill the obligation under paragraph (2), the Mayor may restore the original state and collect the costs from the User.

  • Article 17 (User’s liability for compensation)

  • (1) The User shall use the Performance Venues with the duty of care of a good manager.

  • (2) Where the User neglects the duty under paragraph (1) and damages the equipment of the Performance Venues or loses or damages auxiliary equipment, the User shall restore the original state or compensate for the damage with an equivalent amount.

CHAPTER IV OPERATION OF PERFORMANCE PERSONNEL

  • Article 18 (Commissioning of Artistic Director)

  • (1) To implement high-quality performance projects, the Mayor may appoint an Artistic Director.

  • (2) The Artistic Director shall be commissioned by the Mayor from among persons recognized domestically or internationally for outstanding competence in the performing arts, upon the recommendation of at least 5 persons with extensive knowledge and experience in the performing arts.

  • Article 19 (Duties of the Artistic Director)

  • The Artistic Director shall perform the following:

  • 1. Overall management of performance planning and attraction;

  • 2. Matters concerning support for nurturing performance personnel;

  • 3. Other matters requested by the Mayor to invigorate the operation of the Performance Venues.

  • Article 20 (Support for the Artistic Director’s duties)

  • (1) The Mayor may appoint experts to support the performance of the Artistic Director’s duties.

  • (2) The Mayor may commission experts upon the recommendation of the Artistic Director, from among persons who have worked in relevant arts fields or who possess the qualities necessary for performance planning and attraction.

  • Article 21 (Term of commission)

  • (1) The terms of commission of the Artistic Director and experts shall be within 3 years.

  • (2) Upon expiration of the term of commission, the Mayor may, after consultation with the Advisory Committee, recommission the Artistic Director and experts for a term not exceeding 2 years.

  • Article 22 (Payment of expenses)

  • The Mayor may pay, within budgetary limits, expenses necessary for the Artistic Director and experts to perform their duties.

  • Article 23 (Nurturing of performance personnel)

  • (1) The Mayor may promote projects for nurturing performance personnel to provide opportunities for artists to participate in performances.

  • (2) Participants in projects for nurturing performance personnel may be paid allowances, etc., within budgetary limits.

  • Article 24 (Ushers)

  • (1) To ensure efficient operation of the Performance Venues, the Mayor may select and operate ushers.

  • (2) Ushers may be paid actual expenses, etc., within budgetary limits.

CHAPTER V AUDIENCE AND OPERATION OF CURTURE AND ARTS PROGRAMS

  • Article 25 (Tickets)

  • (1) Where a User intends to issue admission tickets or passes (hereinafter referred to as “Tickets, etc.”), the User shall consult with the Mayor.

  • (2) Tickets, etc. shall be sold under the responsibility of the User; however, the issuance and sale of Tickets, etc. may be entrusted to the Mayor.

  • (3) Commissions for the issuance and sale under paragraph (2) shall be prescribed by Rule.

  • Article 26 (Admission fees for planned performances)

  • (1) Where planned performances, etc. (including joint hosting or organizing; hereinafter the same) are held, the Mayor may collect admission fees.

  • (2) Admission fees shall be determined by the Mayor; provided, with respect to planned performances jointly hosted or organized, the admission fees shall be determined under the agreement.

  • (3) The beneficiaries and scope of reduction of admission fees for planned performances, etc. shall be as prescribed in Appendix 2.

  • Article 27 (Promotional materials)

  • (1) In relation to planned performances, etc., the Mayor may produce and sell promotional materials.

  • (2) Sales prices of promotional materials shall be determined by the Mayor.

  • Article 28 (Restriction on admission)

  • The Mayor may restrict the admission or viewing of any person falling under any of the following:

  • 1. Patients with infectious diseases;

  • 2. Persons carrying articles that may harm others or interfere with performances;

  • 3. Persons who do not possess a valid ticket;

  • 4. Other persons whom the Mayor deems necessary to restrict for safety and order at the Performance Venues. [Moved from Article 27; previous Article 28 moved to Article 29

  • Article 29 (Culture and arts education programs)

  • (1) Where necessary to expand the base of culture and the arts, the Mayor may operate culture and arts education programs.

  • (2) Persons who wish to take culture and arts education programs shall pay tuition fees as prescribed in Appendix 3.

  • (3) The Mayor shall refund all or part of paid tuition fees in any of the following cases:

  • 1. Where a class is cancelled due to circumstances of the Performance Venues or due to force majeure: Full refund.

  • 2. Where cancelled by the day before the commencement date: Full refund.

  • 3. Where cancelled after the commencement date: Refund of tuition fees for the remaining days, excluding the days attended.

  • Article 30 (Operation of membership program)

  • To expand the base of culture and the arts, the Mayor may operate paid or free membership programs for planned performances, etc., and specific matters shall be determined separately by the Mayor. [Moved from Article 29; previous Article 30 moved to Article 32

  • Article 31 (Courtesy to donors)

  • The Mayor may grant the following courtesies to corporations, organizations, institutions, individuals, etc. that voluntarily donate money or goods to the Performance Venues:

  • 1. Operating separate programs such as planned performances for donors;

  • 2. Providing convenience in the use of spaces at the Performance Venues;

  • 3. Other matters the Mayor deems necessary for courtesy to donors.

  • Article 32 (Entrusted operation)

  • (1) Where necessary for efficient operation of the Performance Venues, the Mayor may entrust part of affairs or facility management to corporations, organizations, institutions, individuals, etc.

  • (2) Where entrusting under paragraph (1), the Mayor may subsidize all or part of the necessary expenses within budgetary limits.

  • Article 33 (Delegation of authority)

  • The Mayor shall delegate to the Director of the Performance Venue the authority over affairs concerning management and operation of the Performance Venues under Articles 3 through 5, Article 5-2, Articles 6, 8, 9, 11 through 16, and Articles 23 through 32. [This Article Added on Jul. 3, 2024]

ADDENDUM

  • This Ordinance shall enter into force 1 month after the date of its promulgation.

  • Article 1 (Enforcement date) This Ordinance shall enter into force on the date of its promulgation.

  • Article 2 (Applicability concerning criteria for reduction of admission fees) The amended provisions of Appendix 2 shall apply beginning with cases where planned performances, etc. are viewed on or after Jun. 21, 2025..
