BUSAN METROPOLITAN CITY ORDINANCE ON THE WATER-RELATED LEISURE ACTIVITIES SAFETY MANAGEMENT

  • Article 1 (Purpose)

  • The purpose of this Ordinance is to prescribe matters necessary for the safety management of water-related leisure activities, thereby ensuring the safety and order of water-related leisure activities and contributing to improving citizens’ quality of life.

  • Article 2 (Definitions)

  • The terms used in this Ordinance are as defined in Article 2 of the Water-Related Leisure Activities Safety Act (hereinafter referred to as the “Act”).

  • Article 3 (Responsibilities of the Mayor)

  • The Mayor of Busan Metropolitan City (hereinafter referred to as the “Mayor”) shall establish and implement policies necessary to ensure the safety and order of water-related leisure activities.

  • Article 4 (Formulation and implementation of Implementation Plan for water-related leisure safety management)

  • (1) The Mayor shall each year formulate and implement an Implementation plan for water-related leisure safety management (hereinafter referred to as "Implementation Plan") in accordance with the master plan for water-related leisure safety management under Article 4 of the Act.

  • (2) The Implementation Plan under paragraph (1) shall include the following matters:

  • 1. Outcomes of the previous year’s Implementation Plan;

  • 2. Policy directions and detailed plans for water-related leisure safety management for the relevant year;

  • 3. Other matters the Mayor deems necessary for water-related leisure safety management.

  • Article 5 (Establishment of the Water-related Leisure Activities Safety Council)

  • (1) Under Article 35 of the Act, the Mayor may establish and operate a Water-related Leisure Activities Safety Council (hereinafter referred to as the “Safety Council”), composed of representatives of relevant administrative agencies and organizations, to create a cooperative framework for efficient safety management of water-related leisure activities.

  • (2) The Safety Council shall deliberate on the following:

  • 1. Improvement and supplementation of the safety-management system for water-related leisure activities;

  • 2. Cooperation on major policies and affairs related to the safety of water-related leisure activities;

  • 3. Prevention of and response to safety accidents related to water-related leisure activities;

  • 4. Other matters that the Mayor deems require consultation in relation to the safety of water-related leisure activities.

  • Article 6 (Composition of the Safety Council)

  • (1) The Safety Council shall be composed of not more than 10 members, including 1 chairperson and 1 vice-chairperson; the Vice Mayor for Administrative Affairs shall serve as the chairperson, and the vice-chairperson shall be elected from among the commissioned members.

  • (2) Members shall be appointed or commissioned by the Mayor, taking gender into consideration, from among the following persons:

  • 1. Public officials of Grade 3 or higher affiliated with Busan Metropolitan City (hereinafter referred to as the “City”);

  • 2. Among public officials in charge of water-related leisure affairs in Gu/Gun designated by the Mayor, persons recommended by the head of the Gu/Gun;

  • 3. Among police officials in charge of water-related leisure affairs at the Namhae Regional Headquarters of the Korea Coast Guard, persons recommended by the head of the said Headquarters;

  • 4. Representatives of organizations related to water leisure;

  • 5. Persons with extensive knowledge and experience in the field of water-related leisure safety.

  • (3) The term of office of commissioned members shall be 2 years and may be renewed only once; provided, the term of office of a member commissioned to fill a vacancy shall be the remainder of the predecessor’s term.

  • Article 7 (Operation)

  • (1) The chairperson shall convene meetings of the Safety Council and preside over them.

  • (2) Meetings of the Safety Council shall be held when the chairperson deems it necessary or upon the request of at least 1/3 of the incumbent members.

  • (3) Meetings of the Safety Council shall open with the attendance of a majority of the incumbent members and resolutions shall be adopted by a majority of the members present.

  • (4) 1 secretary shall be appointed to handle the affairs of the Safety Council, and the secretary shall be the head of the division in charge of water-related leisure safety management.

  • (5) Commissioned members and relevant experts who attend meetings of the Safety Council may be paid allowances and travel expenses within budgetary limits.

  • (6) Matters necessary for the operation of the Safety Council, other than those prescribed in this Ordinance, shall be determined by the chairperson following a resolution of the Safety Council.

  • Article 8 (Hearing of opinions)

  • For the performance of its duties, the Safety Council may invite relevant experts to attend meetings to hear their opinions, or may request necessary cooperation, such as the submission of materials and the provision of opinions, from relevant agencies or organizations.

  • Article 9 (Awards)

  • The Mayor may grant commendations to institutions, organizations, or individuals with outstanding merit in water-related leisure safety management in accordance with the Busan Metropolitan City Ordinance on Awards.

  • This Ordinance shall enter into force on the date of its promulgation.
