CHAPTER I GENERAL PROVISIONS

• ●Article 1 (Purpose)

• ●The purpose of this Ordinance is to prescribe matters necessary for the management and operation of culture and arts centers established to promote culture and the arts and to expand opportunities for citizens to enjoy culture and artistic activities.

• ●Article 2 (Names and locations)

• ●The names and locations of the culture and arts centers subject to this Ordinance (hereinafter referred to as “Culture and Arts Centers”) shall be as follows:

• ○1. Geumjeong Culture Center: 7, Cheyukgongwon-ro, Geumjeong-gu, Busan Metropolitan City (Guseo-dong)

• ○2. Nakdong Art Center: 630-2, Myeongji-dong, Gangseo-gu, Busan Metropolitan City

• ●Article 3 (Main projects)

• ●The main projects of the Culture and Arts Centers shall be as follows:

• ○1. Planning and hosting of performances and exhibitions of outstanding culture and artistic works;

• ○2. Providing venues for performances and exhibitions to promote culture and the arts;

• ○3. Operating of culture and arts education programs;

• ○4. Promoting domestic and international exchange projects in the field of culture and the arts;

• ○5. Other projects deemed necessary by the Mayor of Busan Metropolitan City (hereinafter referred to as the “Mayor”) to promote culture and the arts.

CHAPTER II USE OF FACILITIES

• ●Article 4 (Opening and closing days)

• ●(1) The Culture and Arts Centers shall be open throughout the year except on the following closing days; provided, if necessary for operational reasons, the Mayor may designate or adjust closing days.

• ○1. January 1st;

• ○2. Lunar New Year’s Day and Chuseok (including holidays);

• ○3. Every Monday.

• ●(2) When determining closing days under the proviso of paragraph (1), the closing dates and reasons for closure shall be announced in advance through notice boards or the official website of the Culture and Arts Centers.

• ●Article 5 (Operating hours)

• ●(1) The operating hours of the Culture and Arts Centers shall be as follows; provided, exhibition halls shall be open from 09:00 to 19:00.

• ○1. Morning: 09:00 – 12:00

• ○2. Afternoon: 13:00 – 17:00

• ○3. Evening: 18:00 – 22:00

• ●(2) Notwithstanding paragraph (1), the Mayor may allow the use of facilities during late-night hours (22:00 – 02:00) if deemed necessary.

• ●Article 6 (Classification of facilities)

• ●Facilities of the Culture and Arts Centers shall be classified as prescribed separately.

  Nakdong Art Center	Basic Facilities	Concert Hall, Multipurpose Theater, Concert Hall Lobby, Rehearsal Room, Exhibition Space, Academy Room, etc.
  	Ancillary Facilities	Musical instruments, stage facilities, lighting facilities, sound facilities, air-conditioning and heating systems, and other related facilities and equipment.

• ●Article 7 (Permission and revocation of use)

• ●(1) Any person who intends to use the facilities of the Culture and Arts Centers shall obtain permission from the Mayor. The same shall apply when a person who has received permission (hereinafter referred to as the “User”) intends to change the permitted details.

• ●(2) The Mayor may revoke permission for use or take other necessary measures in any of the following cases:

• ○1. Where use becomes impossible due to natural disasters or another force majeure;

• ○2. Where the facilities are used for purposes other than those permitted, or the usage fee is not paid by the designated date;

• ○3. Where permission was obtained through false or fraudulent means;

• ○4. Where the User transfers the right of use to another person without the Mayor’s approval;

• ○5. Where there is a significant safety risk to the facilities;

• ○6. Where the Mayor deems it particularly necessary for the public interest.

• ●Article 8 (Restrictions on permission for use)

• ●The Mayor may refuse permission for use in any of the following cases:

• ○1. Where there is concern that public order or good morals may be undermined;

• ○2. Where the management of facilities is likely to be impeded;

• ○3. Where the applicant has failed to fulfill previous obligations as a User;

• ○4. Where the performance, exhibition, or event (hereinafter referred to as “Performance, etc.”) is for a specific religious or political purpose;

• ○5. Where use has been canceled without just cause 2 or more times in a year;

• ○6. Where the Mayor deems it necessary to restrict use for other reasons.

• ●Article 9 (Usage fees)

• ●(1) The Mayor shall collect usage fees from Users within the range prescribed in Appendix 1.

• ●(2) The User shall enter into a use agreement and pay 30 percent of the basic facility usage fee as a deposit by the date designated by the Mayor, and the remaining balance shall be paid no later than 30 days prior to the date of use or the date of ticket sales, whichever comes earlier. However, if the period between the date of permission and the date of use is within 30 days, the entire usage fee shall be paid within 5 days after concluding the agreement.

• ●Article 10 (Reduction and exemption of usage fees)

• ●(1) The Mayor may exempt usage fees for Performances, etc. directly hosted or organized by the State or the Busan Metropolitan City (hereinafter referred to as the "City").

• ●(2) The Mayor may reduce up to 30 percent of the basic facility usage fee for pure art Performances, etc. sponsored by the State or the City; provided, if the City merely allows the use of its name without financial support, such reduction shall not apply.

• ●(3) The Head of a Gu delegated under Article 19 may separately determine matters concerning the reduction of usage fees for performances or events hosted, organized, or sponsored within his or her jurisdiction.

• ●Article 11 (Refund of usage fees)

• ●The Mayor shall refund all or part of the usage fees in any of the following cases:

• ○1. Where the permission for use is revoked due to natural disasters or public necessity:

• ■(a) If canceled before the date of use: full refund;

• ■(b) If canceled after the date of use: refund the unused portion calculated on a pro rata basis.

• ○2. Where the User requests cancellation:

• ■(a) If canceled at least 30 days before the date of use: refund the amount after deducting 30 percent of the total usage fee;

• ■(b) If canceled by the day before the date of use: refund the amount after deducting 50 percent of the total usage fee;

• ■(c) If canceled after the date of use: refund the remaining amount after deducting 50 percent of the total usage fee and the portion corresponding to the days already used.

• ●Article 12 (User’s equipment)

• ●(1) Where a User intends to install special equipment during the period of use, the User shall obtain prior approval from the Mayor and install such equipment at his or her own expense.

• ●(2) The User shall remove and restore the installed equipment to its original state within the period of use.

• ●(3) Where the User fails to fulfill the obligation under paragraph (2), the Mayor may restore the facilities to their original condition and collect the costs from the User.

• ●Article 13 (User’s liability for compensation)

• ●(1) The User shall use the facilities with the duty of care of a good manager.

• ●(2) Where a User neglects such duty and causes loss or damage to the facilities, the User shall restore them to their original state or compensate for the equivalent amount.

CHAPTER III VIEWING AND OPERATION OF CULTURE AND ARTS PROGRAMS

• ●Article 14 (Admission fees)

• ●(1) Users may collect admission fees from persons who wish to attend Performances, etc.

• ●(2) The Mayor may issue admission tickets and collect admission fees for Performances, etc. planned by the Culture and Arts Centers if deemed necessary.

• ●(3) The targets and scope of admission fee reductions under paragraph (2) shall be as prescribed in Appendix 2.

• ●Article 15 (Restriction of admission)

• ●The Mayor may restrict the entry or attendance of any person who falls under any of the following:

• ○1. Persons who are intoxicated, disorderly, or infected with communicable diseases;

• ○2. Persons carrying items that may harm others or disturb Performances, etc.;

• ○3. Persons without valid admission tickets;

• ○4. Other persons deemed necessary by the Mayor to restrict for facility safety or maintenance of order.

• ●Article 16 (Culture and arts education programs)

• ●(1) The Mayor may operate culture and arts education programs as necessary to broaden the base of culture and the arts.

• ●(2) Persons wishing to enroll in such programs shall pay tuition fees within the range prescribed in Appendix 3.

• ●Article 17 (Reduction of tuition fees)

• ●The Mayor may reduce or exempt all or part of tuition fees for the following persons:

• ○1. Recipients under the National Basic Living Security Act or Housing Benefit Act;

• ○2. Persons with certificates under the Single-Parent Family Support Act;

• ○3. Holders of family-love cards under the Busan Metropolitan City Ordinance on Preferential Treatment and Support for Multi-Child Families;

• ○4. Holders of disability registration cards under the Act on Welfare of Persons with Disabilities (including one guardian for persons with severe disabilities);

• ○5. Holders of certificates under the Act on the Honorable Treatment of and Support for Persons of Distinguished Service to the State, the Act on the Honorable Treatment of Persons of Distinguished Service to Independence, or the Act on the Honorable Treatment of Persons of Distinguished Service to the May 18 Democratization Movement and Establishment of Related Organization;

• ○6. Other persons deemed by the Mayor to require fee reduction.

• ●Article 18 (Refund of tuition fees)

• ●The Mayor shall refund all or part of tuition fees in any of the following cases:

• ○1. Where a class is canceled due to the circumstances of the Culture and Arts Center or natural disasters: full refund;

• ○2. Where cancellation is made by the day before the start of the class: full refund;

• ○3. Where cancellation is made after the start of the class: refund for the remaining period excluding the number of classes attended.

• ●Article 19 (Delegation of authority)

• ●The Mayor may delegate the authority to manage and operate the Culture and Arts Centers to the competent head of a Gu for their efficient management and operation.
