BUSAN METROPOLITAN CITY ORDINANCE ON THE PREVENTION OF AND SUPPORT FOR ELECTRICAL DISASTERS FOR FARMERS AND FISHERS

  • Article 1 (Purpose)

  • The purpose of this Ordinance is to prescribe matters necessary to prevent electrical disasters occurring in the course of production activities of farmers and fishers and to provide support to those affected by such electrical disasters, thereby protecting their lives and property and promoting management stability.

  • Article 2 (Definitions)

  • The terms used in this Ordinance are defined as follows:

  • 1. The term “farmer and fisher” means farmer defined in subparagraph 2 of Article 3 of the Framework Act on Agriculture, Rural Community and Food Industry, and fisher defined in subparagraph 3 of Article 3 of the Framework Act on Fisheries and Fishing Villages Development.

  • 2. The term “electrical disaster” means damage to life or property caused by electricity, such as electric shocks, electrical fires, or other accidents due to electricity.

  • 3. The term “agricultural and fisheries facilities” means the facilities defined in subparagraph 10 of Article 2 of the Act on the Prevention of and Countermeasures against Agricultural and Fishery Disasters, the facilities defined in paragraph (7) of Article 2 of the Enforcement Decree of the same Act, and the facilities defined in subparagraph 10 of Article 2 of the Aquaculture Industry Development Act.

  • Article 3 (Formulation and implementation of Prevention and Support Plan)

  • (1) The Mayor of Busan Metropolitan City (hereinafter referred to as the “Mayor”) shall formulate and implement a plan for the prevention of electrical disasters for farmers and fishers and support for those affected (hereinafter referred to as the “Prevention and Support Plan”).

  • (2) The Prevention and Support Plan under paragraph (1) shall include the following:

  • 1. Basic directions and goals for prevention of and support against electrical disasters;


  • 2. Types and current status of electrical disasters;

  • 3. Manuals for response to electrical disasters;

  • 4. Projects for prevention of and support against electrical disasters;

  • 5. Matters concerning education and publicity for the prevention of electrical disasters;

  • 6. Other matters deemed necessary by the Mayor for the prevention of electrical disasters and support for victims thereof.

  • Article 4 (Prevention projects)

  • The Mayor may promote the following projects to prevent electrical disasters:

  • 1. Electrical safety inspection and management of agricultural and fisheries facilities;

  • 2. Repair and replacement of aged electrical systems in agricultural and fisheries facilities;

  • 3. Publicity for the prevention of electrical disasters;

  • 4. Preparation of response manuals through investigation and analysis of electrical disaster cases;

  • 5. Establishment and operation of an electrical disaster prevention and safety management system;

  • 6. Safety education for the prevention of electrical disasters, including proper use of agricultural and fisheries facilities;

  • 7. Other projects deemed necessary by the Mayor to prevent electrical disasters.

  • Article 5 (Support projects)

  • The Mayor may promote the following projects to respond to electrical disasters affecting farmers and fishers and to provide recovery and support:

  • 1. Support for equipment, materials, manpower, or expenses for response to electrical disasters;

  • 2. Support for temporary electrical facilities and equipment necessary for recovery from electrical disasters;

  • 3. Other projects deemed necessary by the Mayor to respond to electrical disasters.

  • Article 6 (Entrustment of affairs)

  • (1) The Mayor may entrust all or part of the projects under Articles 4 and 5 to institutions, corporations, or organizations with expertise, in order to efficiently promote such projects.

  • (2) Where projects are entrusted under paragraph (1), the Mayor may support necessary expenses within budgetary limits.

  • (3) Matters not prescribed in this Ordinance regarding the entrustment of projects under paragraph (1) shall be governed by the Busan Metropolitan City Framework Ordinance on the Entrustment and Agency of Affairs to Public Institutions and the Busan Metropolitan City Framework Ordinance on the Entrustment.

  • Article 7 (Establishment of cooperation system)

  • The Mayor shall endeavor to establish a cooperation system with relevant agencies and organizations to prevent electrical disasters and provide support for affected farmers and fishers.
