BUSAN METROPOLITAN CITY ORDINANCE ON SUPPORT FOR OPERATION OF PUBLIC LATE-NIGHT PHARMACIES

  • ●Article 1 (Purpose)

  • ●The purpose of this Ordinance is to prescribe matters necessary for the designation, operation, and support of public late-night pharmacies in order to alleviate the inconvenience of citizens in purchasing medicines during late-night hours and to prevent the misuse or abuse of medicines, in accordance with the Pharmaceutical Affairs Act.

  • ●Article 2 (Definitions)

  • ●The term “public late-night pharmacy” in this Ordinance means a pharmacy established and registered in Busan Metropolitan City under Article 20 of the Pharmaceutical Affairs Act (hereinafter referred to as the “Act”), and designated by the Mayor of Busan Metropolitan City (hereinafter referred to as the “Mayor”) for the sale of medicines or quasi-drugs during late-night hours and on public holidays.

  • ●Article 3 (Responsibilities of the Mayor)

  • ●(1) The Mayor shall endeavor to provide convenience in the purchase of medicines and quasi-drugs and to prevent the misuse or abuse of medicines through the designation of public late-night pharmacies.

  • ●(2) The Mayor shall endeavor to ensure that public late-night pharmacy is operated in a balanced manner across different regions.

  • ●(3) The Mayor shall endeavor to expand voluntary participation by pharmacy owners or pharmacy-related organizations and associations.

  • ●Article 4 (Designation and support of public late-night pharmacies)

  • ●(1) The Mayor may designate public late-night pharmacies upon application by pharmacy owners who wish to be so designated, and may support the designation and operation of public late-night pharmacies in Gu/Gun.

  • ●(2) The Mayor may provide all or part of financial support within the budget for the operation of public late-night pharmacies designated under paragraph (1).

  • ●(3) The criteria, methods, and procedures for the designation of public late-night pharmacies shall follow Articles 11-3 and 11-4 of the Enforcement Rule of the Pharmaceutical Affairs Act, and detailed matters shall be determined by the Mayor.

  • ●Article 5 (Operation of public late-night pharmacies)

  • ●The operating hours of public late-night pharmacies shall be from 8:00 p.m. to 1:00 a.m. of the following day, and the daily operating time shall be at least 3 hours.

  • ●Article 6 (Management of public late-night pharmacies)

  • ●(1) The Mayor may provide guidance and supervision regarding the operation of public late-night pharmacies.

  • ●(2) The Mayor may investigate the operational status of public late-night pharmacies on a quarterly basis.

  • ●(3) If, as a result of the investigation under paragraph (2), it is determined that the pharmacies have poor utilization or is inefficiently operated, the Mayor may revoke the designation of the public late-night pharmacies or suspend their operation.

  • ●Article 7 (Revocation of designation of public late-night pharmacies)

  • ●(1) The Mayor may revoke the designation of a public late-night pharmacy if it falls under any of the subparagraphs of Article 21-3 (5) of the Act: provided, the designation shall be revoked if it falls under subparagraph (1).

  • ●(2) A pharmacy whose designation as a public late-night pharmacy has been revoked under paragraph (1) shall not be re-designated as a public late-night pharmacy within 1 year from the date of revocation.

  • ●Article 8 (Recovery of subsidies)

  • ●Where the designation of a public late-night pharmacies have been revoked under Article 7 (1), the Mayor may recover all or part of the subsidies granted to the relevant public late-night pharmacies.

  • ●Article 9 (Public relations)

  • ●The Mayor may publicize the public late-night pharmacies program to pharmacies and citizens in Busan Metropolitan City to ensure the active operation of public late-night pharmacies.

ADDENDUM

Ordinance No. 7448, Dec. 11, 2024.

  • ●Article 1 (Enforcement date)

  • ●This Ordinance shall enter into force on the date of its promulgation.

  • ●Article 2 (Amendment to other ordinances)

  • ●The Busan Metropolitan City Ordinance on Public Health Care shall be partially amended as follows:
    Subparagraph (3) of Article 2 shall be deleted.In Article 3 (1), “Mayor” shall be amended to “Mayor of Busan Metropolitan City (hereinafter referred to as the ‘Mayor’).”Articles 11 and 12 shall be deleted.
