Busan Metropolitan City Ordinance on the Safety Management of Public-Use Businesses

Busan Metropolitan City Ordinance No. 7184, 3. January, 2024., Enacted

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to enhance the initial response capabilities of persons in charge by supporting fire drills and educational activities for public-use businesses where there is a high risk of significant loss of life and property in the event of fire or other disasters, thereby contributing to the protection of citizens' lives and property and promoting public safety.
  • Article 2 (Definitions)
  • The terms used in this Ordinance are defined as follows:
    • 1. The term "Public-Use Business" means businesses engaging in public-use as defined in Subparagraph 1 of Article 2 (1) of the Special Act on the Safety Control of Publicly Used Establishments (hereinafter referred to as "Act").
    • 2. The term "Person in Charge" means operators and employees of public-use businesses and individuals intending to operate such businesses.
  • Article 3 (Scope of Application)
  • This Ordinance applies solely to public-use businesses within the jurisdiction of Busan Metropolitan City.
  • Article 4 (Responsibilities of the Mayor)
  • The Mayor of Busan Metropolitan City (hereinafter referred to as "Mayor") shall endeavor to support fire drills and educational activities for public-use businesses to enhance public safety and protect citizens' lives and property.
  • Article 5 (Responsibilities of Persons in Charge)
  • (1) Persons in charge shall undergo fire safety education in accordance with Article 8 of the Act.
  • (2) Persons in charge shall strive to obtain relevant certifications in safety management, including fire safety and disaster management, as stipulated in Annex 2 of the Enforcement Rule of the National Technical Qualifications Act.
  • Article 6 (Formulation and Implementation of Fire Drill and Education Support Plan)
  • (1) The Mayor shall annually formulate and implement a Fire Drill and Education Support Plan (hereinafter referred to as the "Fire Drill Support Plan") for public-use businesses.
  • (2) The Fire Drill Support Plan shall include the following:
    • 1. Support for equipment necessary for fire drills.
    • 2. Evaluation and guidance of fire drills.
    • 3. Development and dissemination of standard manuals necessary for fire drills and education.
    • 4. Tailored fire drill education.
    • 5. Other matters deemed necessary by the Mayor.
  • Article 7 (Support)
  • (1) The Mayor may provide support for fire drills and education to public-use businesses.
  • (2) The Mayor may also provide safety management materials, such as those preventing accidents at emergency exits, to public-use businesses.
  • Article 8 (Marks of Exemplary Safety Control Establishments)
  • (1) The Mayor may affix a mark of recognition to businesses with outstanding safety management in accordance with Article 21 (1) of the Act, if a business demonstrates excellence in safety management or if the person in charge holds relevant certifications in fire safety, disaster management, or other safety fields under Article 5 (2).
  • (2) Matters concerning the marking of outstanding safety management businesses shall follow Article 21 (4) of the Act.
  • Article 9 (Awards)
  • The Mayor may award persons in charge or institutions that demonstrate exemplary fire safety management, conduct outstanding fire drills or education, or hold certifications related to facility safety management.

  • This ordinance shall enter into force on the date of its promulgation.
