Busan Metropolitan City Ordinance on the Promotion and Support of the Information Security Industry

Busan Metropolitan City Ordinance No. 7010, 16. August, 2023., Enacted

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to establish the necessary provisions for the promotion of the information security industry in Busan Metropolitan City, thereby laying the foundation for the industry, enhancing the quality of life for citizens, and contributing to the development of the local economy.
  • Article 2 (Definitions)
  • The terms used in this Ordinance shall have the meanings as defined in Article 2 of the Act on the Promotion of Information Security Industry.
  • Article 3 (Responsibilities)
  • (1) The Mayor of Busan Metropolitan City (hereinafter referred to as "Mayor") shall formulate and implement policies necessary for promoting the information security industry and secure the necessary financial resources.
  • (2) The Mayor shall ensure that the outcomes of the promotion and support of the information security industry lead to the enhancement of security capabilities in the local industrial sector.
  • Article 4 (Relationship with Other Ordinances)
  • Unless otherwise stipulated in other ordinances, matters related to the promotion and support of the information security industry shall be governed by the provisions of this Ordinance.
  • Article 5 (Formulation of Basic Plans, etc.)
  • (1) The Mayor shall formulate and implement a basic plan for the promotion and support of the information security industry (hereinafter referred to as "Basic Plan") every three years to ensure a systematic approach to industry promotion.
  • (2) The Basic Plan shall include the following matters:
    • 1. Basic policy direction for the promotion of the information security industry.
    • 2. Establishment of the foundation for nurturing information security professionals, developing technology, and expanding the use of information security services.
    • 3. Standardization and protection of intellectual property rights related to information security technologies.
    • 4. Promotion and support of information security companies.
    • 5. Support for joint research among industry, academia, and research institutions.
    • 6. International cooperation and support for overseas expansion of the information security industry.
    • 7. Securing and allocating financial resources for the promotion of the information security industry.
    • 8. Institutional improvements necessary for promoting the information security industry.
    • 9. Other matters deemed necessary for the promotion and support of the information security industry.
  • (3) The Mayor shall formulate and implement an annual action plan based on the Basic Plan.
  • (4) The Mayor may conduct a survey on the current status of the information security industry to effectively formulate and implement the Basic Plan.
  • (5) The Mayor may include the Basic Plan under Article 5 of the Busan Metropolitan City Ordinance on the Promotion and Facilitation of Information and Communication Industry.
  • Article 6 (Establishment of the Information Security Industry Promotion Committee)
  • (1) The Mayor may establish the Busan Metropolitan City Information Security Industry Promotion Committee (hereinafter referred to as “Committee”) to deliberate and advise on the following matters related to the promotion and support of the information security industry:
    • 1. Formulation and implementation of the Basic Plan and annual action plans.
    • 2. Institutional improvements for the promotion and support of the information security industry.
    • 3. Cooperation related to the promotion and support of the information security industry.
    • 4. Other matters deemed necessary by the Chairperson for the promotion and support of the information security industry.
  • (2) Deliberations and advice on matters under paragraph (1) shall be conducted by the Busan Metropolitan City Information and Communication Strategy Committee established under the Busan Metropolitan City Ordinance on the Promotion and Facilitation of Information and Communication Industry. In such cases, the Information and Communication Strategy Committee shall serve as the Information Security Industry Promotion Committee.
  • (3) The Mayor shall reflect the Support Plan in policies related to disability welfare, healthcare, and family support.
  • Article 7 (Support Projects)
  • The Mayor may implement the following projects to promote and support the information security industry:
    • 1. Research and development on the level of information security technologies.
    • 2. Designation of institutions for nurturing information security professionals and development/dissemination of educational programs.
    • 3. Commercialization and performance evaluation of information security technologies.
    • 4. Establishment of clusters related to the information security industry.
    • 5. Projects to promote the trading of information security technologies.
    • 6. Support projects for strengthening the security capabilities of local enterprises.
    • 7. Other projects deemed necessary by the Mayor for promoting and supporting the information security industry.
  • Article 8 (Financial Support)
  • (1) The Mayor may provide financial support within the budget to corporations or organizations implementing the projects specified in Article 7.
  • (2) The method and procedures for providing financial support shall be governed by the Busan Metropolitan City Ordinance on the Management of Local Subsidies.
  • Article 9 (Information Security Industry Support Center)
  • (1) The Mayor may establish and operate the Busan Metropolitan City Information Security Industry Support Center (hereinafter referred to as "Support Center") to systematically and efficiently implement the projects specified in Article 7.
  • (2) The Mayor may entrust the operation of the Support Center to organizations or corporations with expertise in the information security industry.
  • (3) The Mayor may provide financial support for the operation of the Support Center within the budget.
  • (4) Matters not specified in this Ordinance regarding the operation of the Support Center shall be governed by the Busan Metropolitan City Framework Ordinance on the Entrustment or the Busan Metropolitan City Ordinance on the Entrustment and Agency of Affairs to Public Institutions.

Addenda

Ordinance No. 7010, 16. August, 2023.

  • Article 1 (Enforcement Date)
  • This Ordinance shall enter into force on the date of its promulgation.
  • Article 2 (Amendment of Other Ordinances)
  • The Busan Metropolitan City Ordinance on the Promotion and Facilitation of Information and Communication Industry shall be partially amended as follows:
    • In Article 7, Subparagraph 7 shall be renumbered as Subparagraph 8, and a new Subparagraph 7 shall be added as follows:
      • 7. Matters related to Article 6 (1) of the Busan Metropolitan City Ordinance on the Promotion and Support of the Information Security Industry.
