Busan Metropolitan City Ordinance on Support for Pregnancy, Childbirth, and Childcare for Families with Disabilities

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to stipulate the necessary provisions for the comprehensive services and support related to pregnancy, childbirth, and childcare for families with disabilities, thereby contributing to the stable family life of such families.
  • Article 2 (Definitions)
  • The term "family with disabilities" means households in which either the father or mother is a registered person with disabilities as defined in Article 32 of the Act on Welfare of Persons with Disabilities and who are either preparing for pregnancy or childbirth, or have minor children.
  • Article 3 (Responsibilities of the Mayor)
  • (1) The Mayor of Busan Metropolitan City (hereinafter referred to as "Mayor") shall create an environment conducive to pregnancy, childbirth, and childcare for families with disabilities and shall formulate the necessary policies for this purpose.
  • (2) The Mayor shall strive to prevent discrimination against families with disabilities in matters related to pregnancy, childbirth, and childcare due to their disabilities.
  • Article 4 (Relationship with Other Ordinances)
  • Unless otherwise specified in other ordinances, matters concerning pregnancy, childbirth, and childcare for families with disabilities shall be governed by the provisions of this Ordinance.
  • Article 5 (Investigation into Actual Conditions)
  • (1) The Mayor may conduct surveys to establish policies related to pregnancy, childbirth, and childcare for families with disabilities.
  • (2) Such surveys may be outsourced to relevant corporations or specialized institutions.
  • Article 6 (Establishment and Implementation of Support Plans)
  • (1) The Mayor shall establish and implement an annual support plan (hereinafter referred to as “Support Plan”) for pregnancy, childbirth, and childcare for families with disabilities.
  • (2) The Support Plan shall include the following:
    • 1. Goals and direction for the implementation of the Support Plan.
    • 2. Policies for the development of support measures for pregnancy, childbirth, and childcare for families with disabilities.
    • 3. Support projects as specified in Articles 7 and 8.
    • 4. Matters related to surveys and financial resource allocation.
    • 5. Other matters deemed necessary by the Mayor.
  • (3) The Mayor shall reflect the Support Plan in policies related to disability welfare, healthcare, and family support.
  • Article 7 (Support Projects for Pregnancy, Childbirth, and Childcare)
  • (1) The Mayor may carry out the following projects to support pregnancy, childbirth, and childcare for families with disabilities:
    • 1. Projects supporting childbirth and medical care for families with disabilities.
    • 2. Projects for the health management of mothers and infants in families with disabilities.
    • 3. Projects supporting household activities and childcare for families with disabilities.
    • 4. Projects providing information on pregnancy, childbirth, and childcare for families with disabilities.
    • 5. Other projects deemed necessary by the Mayor for improving the welfare of families with disabilities and creating a stable environment for pregnancy, childbirth, and childcare.
  • (2) The Mayor may provide financial support within the budget to institutions, corporations, or organizations that implement the support projects specified in paragraph (1).
  • Article 8 (Designation of Disability-Friendly Obstetric Hospitals)
  • (1) The Mayor may designate obstetric hospitals as disability-friendly medical institutions, in accordance with Article 18-3 of the Act on Guarantee of Rights to Health and Medical Access for Persons with Disabilities, to ensure that women with disabilities can receive medical services related to pregnancy and childbirth without physical or psychological discomfort.
  • (2) The Mayor may support the following projects for disability-friendly obstetric hospitals to provide medical services to women with disabilities, within the limits of the budget:
    • 1. Projects for the installation of facilities accommodating persons with disabilities.
    • 2. Projects for the purchase of medical equipment for providing medical services to persons with disabilities.
    • 3. Projects for educating medical staff on disability awareness and the characteristics of disabilities.
    • 4. Other projects deemed necessary by the Mayor.
  • Article 9 (Establishment of Cooperation Systems)
  • The Mayor may establish cooperative systems with medical institutions and other relevant agencies, corporations, or organizations to effectively implement the projects supporting pregnancy, childbirth, and childcare for families with disabilities.

  • This ordinance shall enter into force on the date of its promulgation.
