Busan Metropolitan City Ordinance on the Safety Management of Road Tunnels

- Article 1 (Purpose)
- The purpose of this ordinance is to establish provisions for the installation of safety facilities, the implementation of safety inspections, and the proper maintenance of road tunnels in Busan Metropolitan City, thereby creating a safe environment within road tunnels and establishing an effective response system for fires, accidents, and other disasters.
- Article 2 (Definitions)
- The terms used in this ordinance are defined as follows:
- 1. The term “Road tunnel” means Type 1 and Type 2 structures as defined in item 2(a) of Table 1 of the Special Act on the Safety Control and Maintenance of Establishments.
- 2. The term “Managing entity” means the manager or owner of a road tunnel as defined under the Road Act. In this case, any party assuming responsibility for the management of facilities pursuant to a management contract with the owner of the road tunnel shall be regarded as the managing entity. The managing entity means Busan Metropolitan City or a local public enterprise under the Local Public Enterprises Act.
- 3. The term “Safety inspection” means the act of inspecting and identifying potential risks inherent in facilities through visual inspection or the use of inspection equipment by a qualified individual with experience and technical expertise.
- 4. The term “Detailed safety diagnosis” means the process of detecting physical or functional defects in a facility and proposing methods of repair or reinforcement by investigating, measuring, and evaluating the structural safety and causes of defects.
- 5. The term “Maintenance” means the activities required to preserve the function of completed facilities, including regular inspections and repairs, restoring damaged parts to their original condition, and improving, repairing, or reinforcing facilities over time to enhance user convenience and safety.
- Article 3 (Installation of Ventilation, Lighting, and Firefighting Facilities)
- (1) The managing entity shall install ventilation and lighting facilities in accordance with Article 42 of the Regulations on Road Structure and Facility Standards (hereinafter referred to as “Regulations”), taking into consideration the design speed, traffic conditions, environmental factors, tunnel specifications, and energy efficiency of the road.
- (2) The managing entity shall install fire suppression systems, alarm systems, evacuation and rescue facilities, firefighting equipment, and emergency power facilities in road tunnels where there is a risk of dangerous traffic situations arising from fires or other accidents. These facilities shall be installed, maintained, and managed in accordance with the technical standards outlined in the Guidelines for the Installation and Management of Road Tunnel Disaster Prevention and Ventilation Facilities.
- (3) The managing entity shall ensure that the concentration of carbon monoxide and nitrogen oxides inside the road tunnel does not exceed the limits specified in Article 42 (3) of the Regulations and shall install ventilation systems to prevent wind speeds from exceeding 10 meters per second during ventilation.
- Article 4 (Implementation of Safety Inspections)
- (1) The managing entity shall conduct safety inspections as prescribed in Article 11 of the Special Act on the Safety Control and Maintenance of Establishments, taking into account the specific characteristics of each road tunnel. However, if the condition and age of the road tunnel warrant it, the Mayor of Busan Metropolitan City (hereinafter referred to as “Mayor”) may require more frequent inspections as deemed necessary.
- (2) The managing entity shall take immediate measures, such as conducting detailed safety diagnoses, repairs, and maintenance, or imposing usage restrictions on road tunnels where safety inspection results reveal abnormalities.
- (3) The managing entity shall submit the results of safety inspections and the measures taken in accordance with paragraph (2) to the Mayor within 30 days of the occurrence of such results.
- Article 5 (Securing Personnel and Equipment)
- The managing entity shall endeavor to secure sufficient personnel and equipment, including portable equipment, access equipment, and non-destructive testing equipment, as appropriate to the specific characteristics of road tunnels to ensure the smooth execution of safety inspections.
- Article 6 (Accident Management System)
- (1) The managing entity shall establish an accident management system that includes recovery procedures, response methods, and a management framework for various accidents arising from defects in the road tunnel or other external factors.
- (2) The Mayor shall periodically inspect and supervise the adequacy of the accident management system established by the managing entity for each road tunnel in accordance with paragraph (1).
- (3) If the Mayor determines, based on the inspection results in paragraph (2), that the accident management system is inadequate, the Mayor shall take appropriate action to ensure its proper implementation.
- Article 7 (Budget Appropriation)
- The Mayor may prioritize budget allocations for the safety management of road tunnels if deemed necessary.

- This ordinance shall enter into force on the date of its promulgation.
