Busan Metropolitan City Ordinance on the Prevention of Illegal Filming in Public-Use Facilities

Busan Metropolitan City Ordinance No. 7067, 11. October, 2023., Enactment
- Article 1 (Purpose)
- The purpose of this ordinance is to regulate matters necessary for preventing illegal filming in public-use facilities, such as public toilets, and to promote safe facility use, thereby contributing to the convenience and welfare of citizens.
- Article 2 (Definitions)
- The terms used in this ordinance are defined as follows:
- 1. The term “Public-use facility” means facilities used by an unspecified number of people, including public toilets.
- 2. The term “Public toilets” means toilets as defined in each provision of Article 2 of the Public Toilets Act.
- 3. The term “Private restroom” means restrooms installed within private facilities, excluding those defined as public toilets in item 2.
- 4. The term “Illegal filming” means filming as defined in Article 14 (1) of the Act on Special Cases Concerning the Punishment of Sexual Crimes.
- 5. The term “Illegal filming device” means cameras or other devices with similar functions used for illegal filming.
- Article 3 (Responsibilities of the City)
- Busan Metropolitan City (hereinafter referred to as “City”) shall establish necessary policies to prevent illegal filming and ensure the safe use of public toilets and other public-use facilities to enhance citizens' convenience and safety.
- Article 4 (Establishment of a Prevention Plan)
- (1) The Mayor of Busan Metropolitan City (hereinafter referred to as “Mayor”) shall establish and implement a plan to prevent illegal filming in public-use facilities.
- (2) The prevention plan mentioned in paragraph (1) may include the following:
- 1. Matters related to the inspection of public-use facilities such as public toilets
- 2. Management plans for a continuous inspection cooperation system consisting of the police, public institutions, and civic organizations
- 3. Designation and inspection of special management zones (e.g., public toilets in densely populated areas where there is a high risk of illegal filming)
- 4. Operation of a citizen monitoring team to prevent illegal filming
- 5. Securing appropriate detection equipment and inspection plans
- 6. Other matters deemed necessary for the prevention of illegal filming
- Article 5 (Regular Inspection of Public Toilets)
- (1) The Mayor may establish a system for regular inspection to check for the installation of illegal filming devices in public toilets to ensure the safety of citizens.
- (2) In establishing such an inspection system, the Mayor may consult with district and county offices.
- Article 6 (Support for Private Toilets Inspections)
- (1) Upon request from the owner or manager of a private facility, the Mayor may conduct inspections for illegal filming devices in private toilets.
- (2) If the owner or manager of a private facility wishes to inspect private toilets independently, the Mayor may provide equipment, such as detectors for illegal filming devices.
- Article 7 (Citizen Observation Team for Illegal Filming)
- (1) The Mayor may operate a citizen monitoring team (hereinafter referred to as “Observation Team”) to inspect public-use facilities for illegal filming devices when necessary.
- (2) The necessary details regarding the operation of the Observation Team shall be separately determined by the Mayor.
- Article 8 (Investigation into Actual Conditions)
- (1) The Mayor may conduct investigations to gather data needed for the development of policies to prevent illegal filming in public-use facilities.
- (2) Investigations conducted under paragraph (1) may be linked to the investigation provided for in Article 5 of the Busan Metropolitan City Ordinance on the Prevention of Digital Sexual Crimes and Protection and Support for Victims.
- Article 9 (Establishment Cooperation System)
- The Mayor shall establish a cooperation system with district and county offices, the Busan Metropolitan Police, and related organizations to effectively prevent illegal filming and inspect illegal filming devices in public-use facilities.
- Article 10 (Education)
- (1) The Mayor may provide regular training on methods for detecting illegal filming devices and using inspection equipment for monitoring team members and facility managers.
- (2) The Mayor may prepare and distribute manuals on inspecting for illegal filming devices when necessary.
- Article 11 (publicity)
- The Mayor may engage in public awareness campaigns, such as producing and distributing promotional materials, to raise awareness of illegal filming in public-use facilities and to prevent harm caused by illegal filming.

- This ordinance shall enter into force on the date of its promulgation.
