Busan Metropolitan City Ordinance on the Establishment of a Smart Safety Management System for Construction Works

Busan Metropolitan City Ordinance No. 7172, 3. January, 2024., Enactment
- Article 1 (Purpose)
- The purpose of this ordinance is to stipulate the necessary provisions for establishing a smart safety management system for construction works through the introduction of smart safety management equipment in Busan Metropolitan City, thereby contributing to the prevention of construction accidents and the enhancement of safety management at construction sites.
- Article 2 (Definitions)
- The terms used in this ordinance are defined as follows:
- 1. The term “Construction works” means the works defined in Article 2 (4) of the Framework Act on the Construction Industry.
- 2. The term “Constructor” means a construction business operator as defined in Article 2 (7) of the Framework Act on the Construction Industry and a housing construction business operator registered under Article 4 of the Housing Act.
- 3. The term “Wireless safety equipment” means the equipment defined in Article 2 (12) of the Construction Technology Promotion Act.
- 4. The term “Converged construction technology” means the technology that utilizes the Internet of Things (IoT), big data, artificial intelligence (AI), and real-time monitoring to automate traditional construction technology.
- 5. The term “Smart safety management equipment” means equipment that enhances safety management at construction sites by utilizing wireless safety equipment and converged construction technology.
- 6. The term “Smart safety management system” means a system that can detect and predict accident risks at construction sites using smart safety management equipment, thereby preventing construction accidents.
- Article 3 (Responsibilities of the Mayor)
- The Mayor of Busan Metropolitan City (hereinafter referred to as “Mayor") shall establish and promote smart safety management policies to ensure systematic safety management at construction sites and shall strive to provide the necessary administrative and financial support.
- Article 4 (Establishment of a Smart Safety Management System)
- The Mayor may establish a smart safety management system for construction works in Busan Metropolitan City, which shall include the following:
- 1. Development of a safety management platform utilizing the Internet of Things (IoT), artificial intelligence (AI), and big data
- 2. Plans for building smart safety management infrastructure for construction works
- 3. Inspection and verification of the status of construction works and safety management practices
- 4. Accident risk prediction and management through the analysis of accident occurrence data at construction sites
- 5. Other matters deemed necessary by the Mayor for the safety of construction works
- Article 5 (Safety Management Inspections)
- (1) The Mayor may conduct inspections of safety management practices at construction sites.
- (2) The specific details related to the safety management inspections under paragraph (1) shall be determined separately by the Mayor.
- Article 6 (Meetings)
- When the Mayor conducts an inspection under Article 5, the results shall be communicated to the relevant construction project operator, and the construction project operator shall take the following actions:
- 1. Immediate evaluation and emergency measures for any identified defects
- 2. Conduct a detailed safety inspection if necessary
- 3. Other actions deemed necessary by the Mayor for ensuring the safety of construction sites
- Article 7 (Formation of the Construction Smart Safety Management Advisory Group)
- (1) The Mayor may form and operate a Construction Smart Safety Management Advisory Group to enhance capabilities related to the formulation of plans and safety inspections for the establishment of the safety management system under Article 4.
- (2) The details regarding the formation and operation of the advisory group under paragraph (1) shall be determined separately by the Mayor.
- Article 8 (Education and Publicity)
- The Mayor may conduct education and publicity activities for construction project operators and other related parties to promote the activation of the smart safety management system at construction sites.

- This ordinance shall enter into force on the date of its promulgation.
