Busan Metropolitan City Ordinance on the Promotion and Support of the Quantum Industry

Busan Metropolitan City Ordinance No. 7009, 16. August, 2023., Enactment
- Article 1 (Purpose)
- The purpose of this ordinance is to regulate matters related to the systematic promotion and support of the quantum industry in Busan Metropolitan City, thereby contributing to regional economic development and improving the quality of life for its citizens.
- Article 2 (Definitions)
- The terms used in this ordinance are defined as follows:
- 1. The term “Quantum information and communication technology” means the technology defined in item (e), Subparagraph (1), Paragraph (1) of Article 2 of the Special Act on Promotion of Information and Communication Technology and Vitalization of Convergence Thereof.
- 2. The term “Quantum industry” means industries that develop, manufacture, and produce products using quantum information and communication technology or provide services based on this technology.
- Article 3 (Responsibilities of the Mayor)
- The Mayor of Busan Metropolitan City (hereinafter referred to as “Mayor") shall establish and implement comprehensive policies for the promotion and support of the quantum industry and strive to secure the necessary financial resources for their execution.
- Article 4 (Formulation of Basic Plans)
- (1) The Mayor shall formulate and implement a Basic Plan for the Promotion and Support of the Quantum Industry (hereinafter referred to as “Basic Plan”) every three years to foster the quantum industry.
- (2) The Basic Plan shall include the following:
- 1. Goals and basic directions for promoting the quantum industry
- 2. Promotion of research and development in the quantum industry and dissemination of outcomes
- 3. Development of specialized human resources for the quantum industry
- 4. Fostering and attracting quantum-related enterprises
- 5. Facilitation of joint research and establishment of research facilities for cooperation between industry, academia, and research institutions
- 6. Expansion of public awareness and understanding of the quantum industry
- 7. Other necessary matters for the promotion of the quantum industry
- (3) The Mayor shall annually formulate and implement an action plan based on the Basic Plan.
- (4) The Mayor may conduct surveys to collect basic data and assess regional conditions when formulating the Basic Plan.
- (5) The Mayor shall consult extensively with industry, academia, and research institutions when formulating or amending the Basic Plan.
- Article 5 (Establishment and Composition of the Quantum Industry Promotion Committee)
- (1) The Mayor shall establish the Busan Metropolitan City Quantum Industry Promotion Committee (hereinafter referred to as “Committee”) to deliberate and provide advice on the following matters related to the promotion and support of the quantum industry:
- 1. Finalization of the Basic Plan under Article 4
- 2. Evaluation of the implementation of the action plan
- 3. Policy issues and coordination of tasks related to the promotion of the quantum industry
- 4. Other matters related to the promotion and support of the quantum industry referred to the Committee by the Chairperson
- (2) The Committee shall consist of no more than 20 members, including one Chairperson and one Vice-Chairperson.
- (3) The Chairperson shall be the head of the relevant department, and the Vice-Chairperson shall be elected from among the members. The members shall be appointed or commissioned by the Mayor, considering gender balance, from the following individuals:
- 1. Public officials of Grade 4 or higher in Busan Metropolitan City
- 2. Professors at the associate level or higher or individuals with over 10 years of experience in quantum information and communication technology research
- 3. Other experts recognized by the Mayor for their expertise in the quantum industry
- (4) The term of appointed members shall be two years, and the term of substitute members shall be the remaining term of their predecessor.
- Article 6 (Meetings)
- (1) The Chairperson shall convene and preside over the Committee meetings.
- (2) Meetings of the Committee shall be held when deemed necessary by the Chairperson or upon the request of at least one-third of the members.
- (3) A quorum for a meeting shall be a majority of the members, and decisions shall be made by a majority of those present.
- (4) A secretary shall be appointed to handle the administrative affairs of the Committee, and the secretary shall be the head of the relevant department.
- (5) Appointed members and experts attending the meetings may be compensated for their attendance and travel expenses within the budget.
- (6) Matters not specified in this ordinance related to the operation of the Committee shall be determined by the Chairperson through a resolution of the Committee.
- Article 7 (Training of Experts)
- (1) The Mayor may support the following projects to train specialized personnel (hereinafter referred to as "quantum personnel") necessary for the activation of the quantum industry:
- 1. Research on the supply and demand of quantum personnel
- 2. Education and training for the development and transition of quantum personnel
- 3. Exchange and recruitment of quantum personnel
- 4. Other necessary matters for the development of quantum personnel
- (2) The Mayor may provide administrative and financial support to universities and graduate schools focusing on quantum information and communication technology if necessary for training quantum personnel.
- Article 8 (Establishment and Utilization of Research Facilities)
- (1) The Mayor may establish and operate research equipment and facilities to promote the quantum industry.
- (2) When establishing research facilities under paragraph (1), the Mayor shall prepare plans to secure specialized personnel, improve utilization rates, maintain and enhance the facilities, support the supply of necessary materials and components for research, and ensure the practical use of research outcomes.
- Article 9 (Support for Enterprises)
- The Mayor may support the following projects to foster quantum-related enterprises:
- 1. Provision of funds, personnel, and market development support for startups
- 2. Provision of startup spaces and utilization of research facilities
- 3. Legal, management, tax, and patent consulting services
- 4. Other necessary projects to promote startups and facilitate overseas market entry
- Article 10 (Quantum Industry Support Center)
- The Mayor may designate the Busan Metropolitan City Quantum Industry Support Center for a specific period to serve as a hub for securing quantum information and communication technology and linking it with the regional industry through close cooperation between industry, academia, and research institutions.
- Article 11 (Financial Support)
- (1) The Mayor may provide full or partial financial support within the budget to the following institutions or organizations for the projects specified in Articles 7 to 10:
- 1. National and public research institutions
- 2. Research institutions funded or invested in by the government or local governments
- 3. Universities established under the Higher Education Act
- (2) The methods and procedures for providing financial support under paragraph (1) shall be governed by the Busan Metropolitan City Ordinance on the Management of Subsidies.
- Article 12 (Entrustment of Projects)
- (1) The Mayor may entrust all or part of the tasks related to the promotion and support of the quantum industry to relevant institutions, corporations, or organizations for efficient execution.
- (2) Matters not specified in this ordinance related to the entrustment of responsibilities shall be governed by the Busan Metropolitan City Framework Ordinance on the Entrustment or the Busan Metropolitan City Ordinance on the Entrustment and Agency of Affairs to Public Institutions.

- This ordinance shall enter into force on the date of its promulgation.
