Busan Metropolitan City Ordinance on Revitalization of Support for Culture and Arts : City Government

Busan Metropolitan City Ordinance No. 7059, 11. October, 2023., Enactment

Article 1 (Purpose)
The purpose of this ordinance is to prescribe matters necessary to revitalize support for culture and arts in Busan Metropolitan City.

Article 2 (Definitions)
The terms used in this ordinance are defined as follows:
- 1. The term “Culture and Arts” means Article 2 (1) of the Act on Revitalization of Support for Culture and Arts (hereinafter referred to as “Act”).
- 2. The term "support for culture and arts" means Article 2 (2) of the Act.
- 3. The term “Sponsors of culture and arts” means Article 2 (3) of the Act.
- 4. The term “Intermediary group supporting culture and arts” means Article 2 (4) of the Act.

Article 3 (Responsibilities of the Mayor)
The Mayor of Busan Metropolitan City (hereinafter referred to as “Mayor") shall devise and implement policies necessary to revitalize the culture of cultural and artistic sponsorship for the development of culture and arts in Busan. The Mayor shall also actively encourage citizens to participate in cultural and artistic sponsorship.

Article 4 (Establishment of Basic Plans)
(1) The Mayor shall formulate and implement a basic plan (hereinafter referred to as “Basic Plan”) to support the revitalization of cultural and artistic sponsorship.
(2) The Basic Plan under paragraph (1) shall include the following:
- 1. Development of programs to establish a culture of cultural and artistic sponsorship
- 2. Education and promotion to encourage cultural and artistic sponsorship
- 3. Establishment of networks with cultural and artistic organizations, social organizations, professional arts corporations, and businesses
- 4. Other matters deemed necessary by the Mayor to revitalize cultural and artistic sponsorship
(3) The Mayor may include the Basic Plan in the implementation plan established under Article 5 of the Busan Metropolitan City Ordinance on Regional Cultural Promotion.

Article 5 (Support Projects)
(1) The Mayor may pursue or support the following projects to revitalize cultural and artistic sponsorship:
- 1. Development and research of programs to promote cultural and artistic sponsorship
- 2. Establishment of cooperative systems to revitalize cultural and artistic sponsorship
- 3. Promotion of the culture of cultural and artistic sponsorship
- 4. Securing cultural facilities and spaces necessary for the revitalization of cultural and artistic sponsorship
- 5. Other projects deemed necessary by the Mayor to revitalize and expand the culture of cultural and artistic sponsorship
(2) The Mayor may provide full or partial financial support, within budget limits, to institutions, corporations, or organizations that pursue the projects under paragraph (1).
(3) The methods and procedures for providing financial support under paragraph (2) shall be governed by the Busan Metropolitan City Ordinance on Management of Subsidies.

Article 6 (Fostering and Supporting Sponsorship Intermediary Organizations)
(1) The Mayor may foster and support intermediary organizations for cultural and artistic sponsorship to revitalize the field.
(2) The Mayor may provide full or partial financial support for the operation of cultural and artistic sponsorship intermediary organizations within budget limits.
(3) The methods and procedures for providing financial support under paragraph (2) shall be governed by the Busan Metropolitan City Ordinance on the Management of Subsidies.

Article 7 (Establishment of the Cultural and Artistic Sponsorship Committee)
(1) The Mayor may establish the Busan Metropolitan City Cultural and Artistic Sponsorship Committee to deliberate and advise on the following matters related to the revitalization of cultural and artistic sponsorship:
- 1. Formulation of the Basic Plan under Article 4
- 2. Financial support for the support projects under Article 5
- 3. Formulation and evaluation of project plans for the support projects
- 4. Other matters deemed necessary to revitalize cultural and artistic sponsorship
(2) The Busan Metropolitan City Culture Cooperation Committee established under the Busan Metropolitan City Ordinance on Regional Cultural Promotion shall deliberate and advise on the matters under paragraph (1). In this case, the Culture Cooperation Committee shall serve as the Cultural and Artistic Sponsorship Committee.

Article 8 (Establishment of Cooperation Systems)
The Mayor shall make efforts to expand exchanges and establish cooperation systems with cultural and artistic organizations, social organizations, corporations, and other legal entities to revitalize cultural and artistic sponsorship and foster cultural development.

Article 9 (Awards)
The Mayor may award institutions, organizations, or individuals who have made significant contributions to the revitalization of cultural and artistic sponsorship, in accordance with the Busan Metropolitan City Ordinance on Awards.

Article 2 (Amendment of Other Ordinances)
The Busan Metropolitan City Ordinance on Regional Cultural Promotion shall be partially amended as follows:
- Subparagraph 12 of Article 14 (2) shall be renumbered as subparagraph 13, and a new subparagraph 12 shall be added as follows:
  - “12. Matters related to each subparagraph of Article 7 (1) of the Busan Metropolitan City Ordinance on the Revitalization of Support for Culture and Arts.”
