Chapter 1 General Provisions
- Article 1 (Purpose)
- The ordinance aims at stipulating the requirements for the libraries in Busan Metropolitan City and the promotion of book reading culture, pursuant to the Library Act and the Reading Culture Promotion Act, to contribute to developing the culture and enhaning the quality of community life in Busan Metropolitan City. <Revision February 17, 2016>
- Article 2 (Definition)
- “Cyber library” in the ordinance means the library, which engages in the joint use of library material, the promotion of digitization, and the vitalization of book reading culture within the jurisdiction of Busan Metropolitan City by use of the information and communications network (referring to the information and communications network under the Act on the Promotion of Information and Communications Network Use and Information Protection Article 2 Paragraphs 1 Subparagraph 1, and applied henceforth).
- Article 3 (Duties)
- Busan Metropolitan City (hereafter called “City”) shall strive, and prepare for the required policy, to expand the library service and promote the book reading cullture, which shall allow the free, equal access to, and the use of, the knowledge information for the community memers.
Chapter 2 Cultivation and Support for Library
- Article 4 (Planning for Comprehensive Library Development Plan and Implementation Plan)
- ① The mayor of Busan Metropolitan City (hereafter called “Mayor”) shall plan for the comprehensive library development plan, in every 5 years,
which includes the matters of the following subparagraphs, based on the comprehensive library development plan in the Library Act (hereafter called “Act”) Article 14.
- 1. Goal of library policy
- 2. Direction and implementation of library development
- 3. Any other requirement for the implementation of library policy
- ② The Mayor shall plan and execute the annual implementation plan under the City’s comprehensive library development plan in Paragraph 1.
- Artile 5 (Cultivation and Support for Public Library)
- ① The Mayor shall strive to establish and cultivate public libraries by living zone to allow easy access to the residents, pursuant to Article 27 of the act and the Library Acr Enfocement Decree Article 17,
- ② The Mayor may support, in part within the budget, for the expense for facility improvement and establishment of public library, the material purchase cost, and the operation cost.
- ③ The Mayor may evaluate on the operation of the public libraties for the development and efficient operation of the public libraries.
- Article 6 (Activity for Library Coopration)
- The Mayor may support, in part within the budget, for the conduction of library cooperation activities, including an integrated use of libraries within the jurisdiction, a cooperative acquisition (referring to the joint collection of library material), and a cooperative repository, and the required expense for the libraries that engage in such activities.
- Article 7 (Support for Relief of Knowledge and Information Disparity)
- The Mayor may support the public libraries, in part within the budget, for the expense required to engage in the activites for the disadvantaged community in knowledge and information, produce and purchase library materials, and improve facilities, which shall improve the access to, and the use environment of, the disadvantaged community in knowledge and information, pursuant to Article 44 of the act.
Chapter 3 Busan Metropolitan City Representaitive Library
- Article 8 (Establishment and Operation)
- The Mayor shall plan for and implement the library policies, pursuant to Article 22 of the act and Article 15 Paragraph 1 of the enforcement decree,
and establish and operate the Busan Metropolitan Library, as a Busan Metropolitan City representative library, to provide the systematic supports for the relevant services.

- Article 9 (Library Member)
- ① A person, who intends to use the material and facility of the Busan Metropolitan Library, may enroll as a library member.
- ② The Mayor may have the Busan Metropolitan Library engage in the integrated management for the members registered in the public librarties located in the City.
- ③ The Mayor shall determine the requirement for the registration and integrated management of the members pursuant to Paragraphs 1 and 2.

- Article 9-2 (Limitation of Use)
- ① A user of the Busan Metropolitan Library shall not engage in the acts of the following subparagraphs:
- 1. Infringement of the rights under the Copyrights Law during, while using the material in the Busan Metropolitan Library
- 2. Loss, destroying, or damage of the material, supplies and facility in the Busan Metropolitan Library
- 3. Search or viewing of the harmful information, including obscene material, with the information devices in the Busan Metropolitan Library
- 4. Encumbrance to the library users by smoking and drinking
- 5. Any restriction deemed otherwise neccesary by the Mayor for safety and order maintenance
- ② The Mayor may suspend the use of, or restrict the entry to, the Busan Metropolitan Library, when the user engages in the act of any one of the following subparagraphs of Paragraph 1:

- Article 9-3 (Usage Fee)
- ① The Mayor may allow the use of some part of the Busan Metropolitan Library facilities for the efficient operation of the facilities, and the usage fees for the facilities shall be as in the Attached Table 1.
- ② The refund criteria for the usage fee pursuant to Subparagraph 1 shall be as in the Attached Table 2.
- ③ The Mayor may exempt the usage fee for the Busan Metropolitan Library facilities, if any one of the following subparagraphs is true:
- 1. Event hosted or supervised by the state or local municipalities: exemption
- 2. Event sponsored by the City: reduction of 50 hundredths of facility usage fee
- 3. Event deemed necessary by the Mayor for the vitalization of the Busan Metropolitan Library and the development of local book reading culture:

- Article 9-4 (Compensation and Indemnification)
- ① When a user of the Busan Metropolitan Library engaged in the act of losing, destorying, or damaging the library material, the user shall compensate with an identidical material and, if the idential material is impracticable to compensate, a present converted currency value.
- ② When a user of the Busan Metropolitan Library engaged in the act of destroying or damaging the Busan Metropolitan Library facility deliberately or negligently,
while in use, the use shall restore, or compensate for, the facility.

- Article 9-5 (Cooperative Repository Library)
- ① The Mayor may operate a cooperative repository library to preserve and share the material transferred from other institutions.
- ② The Mayor shall determine separately the requirements to operate the cooperative repository library.

Chapter 5 Cyber Library
- Article 12 (Establishment and Operation)
- The Mayor may establish and operate the cyber library within the public libraries for the efficient work execution of the cyber library.
- Article 13 (Work)
- The cyber library shall conduct the works of the following subparagraphs.
- 1. Management and operation of the cyber library
- 2. Service for the joint use of the library material by using information communication networks
- 3. Any other works required for functioning as the cyber library
Chapter 6 Library Information Service Committee
- Article 14 (Term of Member)
- A member of the Busan Metropolitan City Library Information Service Committee (hereafter called “Committee”), installed pursuant to Article 24 Paragraph of the act, shall serve the term of 2 years with one consecutive term allowed, except that a supplementary member shall serve for the remaining term of a predecessor.
- Article 15 (Meeting)
- The meetings of the Committee shall convene with the attendance of a majority of the registered members, and decide by the consent of a majority of the attending members.
- Article 15-2 (Hearing of Opinion)
- The chairperson may have a relevant public official or a relevant expert attend the meeting to hear his/her opinion,
or request a relevant instituion or organization to submit material or opinion, if deemed necessary for deliberation.

- Article 16 (Administrative Secretary)
- The Committee may have 1 administrative secreraty in place to process the works of the Committee, and the position of the administrative secretary shall be undertaken by a director in charge of library.
- Article 17 (Allowance)
- The enstrusted member may be provided the payment for allowance and travel expense within the budget.
- Article 18 (Operation Regulation)
- The chairperson shall determine the requirements, other than the stipulations in the ordinance, to operate the Committee with voting by the Committee.
Chapter 6-2 Library Operation Committee <New Insertion February 5, 2020>
- Article 18-2 (Setup of Library Operation Committee)
- ① Each library shall have the library operation committee (hereafter called “Operation Committee”) in place respectively, pursuant to Article Paragraphs 2 and 3 of the act, to operate the library efficiently.
- ② The Operation Committee shall deliberate on the matters of the following subparagraphs:
- 1. Operation, improvement and development of the library
- 2. Selection of the library material
- 3. Any other requirement to operate the library

- Article 18-3 (Composition of Operation Committee)
- ① The Operation Committee shall consist of up to 15 members, including 1 chairperson and 1 vice chairperson respecively.
- ② The chairperson and the vice chairperson shall be elected out of the members.
- ③ The Operation Committee shall have the ex-officio members of the head of a department in charge of library and the library director with other members appointed by the Mayor, in consideration of gender, out of the persons of the following subparagraphs:
- 1. Person recommended by the Busan Metropolitan City Council
- 2. Public official in the Busan Metropolitan City Office of Education, whose responsilibity is related to the library
- 3. Worker fromo public library, university library, school library, and special library
- 4. Person highly knowledgable of library with an abundance of experiences
- ④ The chairperson shall represent, and oversee the works of, the Operation Committee.
- ⑤ The vice chairperson shall act on behalf of the chairperson in the event that the chairperson is unable to fulfill his/her duties.

- Article 18-4 (Term of Member)
- ① The appointed member shall serve the term of 2 years with one consecutive term allowed, except that a supplementary member shall serve for the remaing term of a predecessor.
- ② The Mayor may dismiss a member if any one of the following subparagraphs is true:
- 1. Unable to carry out the duties due to a reason of health
- 2. Desirous of dismissal by the member himself/herself
- 3. Deemed inappropriate for a member due to a negligence of duty, a disgraced integrity, or any other reason

- Article 18-5 (Meeting of Operation Committee)
- ① The chairperson shall convene and chair a meeting of the Operation Committee.
- ② The meeting of the Operation Committee shall convene with the attendance of a majority of the registered members, and decide with the consent by a majority of the attending members.

- Article 18-6 (Opinion Hearing)
- The chairperson may have a relevant public official or a relevant specialist attend a meeting to hear his/her opinion,
or request a relevant instituion or organization submit material or opinion, if deemed necessary for deliberation.

- The chairperson may have one administrative secretary in place to process the committee works, and a person in charge of library shall undertake the position of the administrative secretary.

Chapter 7 Promotion of Book Reading Culture
- Article 19 (Planning of Implementation Plan for Book Reading Culture Promotion)
- The Mayor shall plan and execute the annual implementation plan, pursuant to the Book Reading Culture Promotion Act, to promote the book reading culture,
including the activities of the following subparagraphs:
- 1. Basic direction and goal of the policiy to promote the book reading culture
- 2. Measures to expand and improve the facilities, including library, to promote the book reading culture, and secure book reading materials
- 3. Improvement of book reading culture for the marginalized community, such as people with reading disability and multi-cultural families
- 4. Any activity required to promote the book reading culture
- Article 20 (Advancement of Book Reading Promotion Policy)
- ① The Mayor shall strive to create and improve the book reading environment for the locals, working workplaces, and marginalize communities.
- ② The Mayor may advance any activites to promote the book reading culture or support an institution or organization, related to book reading, to advance the activities.

- Article 22 (Invigoration of Local Printing Support)
- ① The Mayor shall strive for the invigoration of local publishing, and may implement the policy to support a local publisher (referring to the human and/or physical facility, located in the City and conducting the publishing business, of which the reference shall be applied henceforth in the ordinance).
- ② The Mayor shall strive to furnish the libraries, established and operated by the City, with publications published by the local publisher, and may recommend the libraries, established and operated by districts and/or guns and the Busan Metropolitan City Office of Education, with the publications published by the local publisher.
- ③ The Mayor may support for the required expense, if the libraries, established and operated by districts and/or guns and the Busan Metropolitan City Office of Education, are furnished with the publications published by the local publisher, pursuant to Paragraph 2.
- ④ The Mayor may select and support a good book, or books, from the books published by the local publisher.

Chapter 8 Supplementary Rules
- Article 23 (Reward)
- The Mayor may reward a person, who has made marked contributions to the library and the book reading culture promotion, pursuant to the Busan Metropolitan City Reward Ordiance.
- Article 24 (Application of Other Ordinance)
- The Busan Metropolitan City Local Subsidy Management Ordinance shall apply to any subsidies, not stipulated in the ordinance. <Revision January 1, 2015>
- Article 25 (Delegation of Authority)
- The Mayor shall delegate the authority for the works of opearting the Busan Metropolitan Library, pursuant to Article 9-2 through Article 9-5, to a Director of the Busan Metropolitan Library.

Supplementary Provision
- Article 1 (Effective Date)
- The ordinance shall be in effect one month after proclamation, except that the stipulation on the Small Library Promotion Act in Article 1 and the stipulations in Articles 10 and 11 shall be in effect on and after August 18, 2012.
- Article 2 (Repeal of Other Ordinance)
- The ordinance on the Busan Metropolitan City Library Information Service Committee shall be repelaed.

- The ordinance shall be in effect upon proclamation.
