Busan Metropolitan City Ordinance for the Penetration Facilitation and Use Invigoration of Electric Vehicle

  • Article 1 (Purpose)
  • The ordinance aims at stipulating the requirements for the delegation, pursuant to the Act on the Faciliation of Development and Penetration of Environment-friendly Vehicle Enforcement Decree, and the penetration facilitation and use invigoration of electric vehicle, cultivating the imprvement in the community living environment, and contributing to the invigoration of the local economy.
  • Article 2 (Definition)
  • The ordinance shall use the terms, which are defined as follows:
    • 1. “Electric vehicle” means the vehicle pursuant to the Act on the Faciliation of Development and Penetration of Environment-friendly Vehicle ARticle 2 Paragraph 2.
    • 2. “Charging facility” means the facility, which is set up to charge electricity to the battery of an electric vehicle, pursuant to the Act on the Faciliation of Development and Penetration of Environment-friendly Vehicle Enforcement Decree (hc_ “Decree”) Article 18-5 Paragraph 1.
    • 3. “Public building” means the facility, pursuant to the Decree Article 18-4 Paragraph 1, which is owned or managed by central administrative agencies, municipalities, and institutions of the following items
      • a. Office of Education pursuant to the Act on Local Education Autonomy
      • b. Public institution pursuant to the Act on Public Institution Operation
      • c. Local public corporation, pursuant to the Local Public Enterprises Act, and local industrial complext pursuant to the Act Article 76
      • d. Hospital pursuant to the Act on the Establishment of National University-Affiliated Hospitals and the Act on the Establishment of National University-Affiliated Dental Hospitals
      • e. National and public school pursuant to the Elementary and Secondary Education Act Article 3 and the Higher Education Act Article 3
    • 4. “Parking unit stall” means the parking unit stall pursuant to the Parking Lot Act Article 2 Paragraph 7.
  • Article 3 (Duties)
  • ① Busan Metropolitan City (hc_ “City”) shall plan for and execute the measures to facilitate the penetration of, and invigorate the use of, electric vehicle.
  • ② The community members shall be fully cooperative of the policies to invigorate the use of electric vehicle.
  • Article 4 (Relation with Other Ordinance)
  • The penetration facilitation and use invigoration of electric vehicle shall follow the stipulations in the ordinance, unless otherwise stipulated in different ordinances.
  • Article 5 (Invigoration Plan)
  • ① The mayor of Busan Metropolitan City (hc_ “Mayor”) shall plan and execute the plan for the penetration facilitation and use invigoration of electric vehicle (hc_ “Invigoration Plan”).
  • ② the Invigoration Plan pursuant to Paragraph 1 shall include the matters of the following subparagraphs.
    • 1. Basic direction and goal of the Invigoration Plan
    • 2. Penetration plan and track records for electric vehicle
    • 3. Measures to build up, manage, and operate the charging infrastructures for electric vehicle
    • 4. Measures to finance and provide financial supports for the penetration of electric vehicle and the buildup of charging infrastructures
    • 5. Any matter donb the Mayor to faciliate the penetration, and invigorate the use, of electric vehicle
  • ③ The Mayor shall strive to collect the opinions from relevant experts and the community members, while planning and executing the Invigoration Plan.
  • Article 6 (Eligibility for Charging Facility)
  • ① The facility, which falls under any one of the following subparagraphs pursuant to the Decree Article 18-4 and with the parking lot unit stalls of 100 or more, shall install the charging facility for electric vehicle.
    • 1. Public building and public use faility, which are the structures by use, pursuant to the Building Act, and fall under the following items:
      • a. Class 1 Neighbourhood Facility
      • b. Class 2 Neighbourhood Facility
      • c. Cultural and Assembly Facility
      • d. Sales facility
      • e. Transportation facility
      • f. Health care facility
      • g. Education research facility
      • h. Sports facility
      • I. Work facility
      • j. Lodging facility
      • k. Recreational facility
      • l. Vehicle facility
      • m. Broadcasting communication facility
      • n. Power generation facility
      • o. Tourism rest facility
    • 2. Apartment housing, pursuant to the Building Act Enforcement Decree Article 3-5 and the Attached Table 1 No. 2, which falls under the following items:
      • a. Apartment with 500 households or more
      • b. Dormitory
    • 3. Parking lot, pursuant to the Parking Lot Act Article 2 Paragraph 1, which is installed by the Mayor, district mayors, or gun mayors
  • ② The owner, administrator, and building owner (meaning the building owner pursuant to the Building Act Article 2 Paragraph 1 Subparagragh 12, and hereinafter the same) of the facilities of the subparagraphs of Paragraph 1 shall be cooperative for the City’s policy to install the electric vehicle charging facility,
  • ③ The owner, administrator, and building owner of the facility, which is to install an electric vehicle charging facility pursuant to Paragraph 1, shall include the details about the following subparagraphs in the building plan or the management plan:
    • 1. Type and quanity of required charging facility
    • 2. Installation of parking stalls exclusive to electric vehicle pursuant to the Parkig Lot Act Article 6 or the Regulation for the Housing Construction Criteria Article 27
    • 3. Any matter donb the Mayor to install charging facilities
  • Article 7 (Type of Charging Facility)
  • ① The type of charging facility shall include the fast charging facility and slow charging facility, pursuant to the Decree Article 18-5 Paragraph 1.
  • ② The installation of the facility with access to portable charger shall be deemed the installation of a slow charging facility, contingent upon the installation of the exclusive parking stalls for electric vehicle pursuant to the Parking Lot Act Article 6 or the Regulation on Housing Construction Criteria Article 27.
  • Article 8 (Installation Ration fo Charging Facility)
  • ① The number of charging facilities to be installed in the facility under the Article Paragraph 1 Subparagraphs 1 and 2, pursuant to the Decree Article 18-5 Paragraph 2, shall be the total number of parking unit stalls divided by 200, or more.
  • ② The facility with the parking lot unit stalls of 100 or more shall install more than one fast charging facility unit. In such a case, the parking lot pursuant to Article 6 Paragraph 1 Subparagraph 3 shall install fast charging facilities in 50 hundredths of total charging facilities or more. <Revision January 10, 2018>
  • ③ The number of charging facility to install, pursuant to Paragraphs 1 and 2, shall be calculated by rounding off to a whole point.
  • Article 9 (Support for the Operation of Electric Vehicle)
  • ① The Mayor may provide the supports of the following subparagraphs with the electric vehicle with a City-issued electric vehicle mark (hc_ “Mark”) attached:
    • 1. Reduction of toll for the City-run toll road
    • 2. Installation of exclusive parking stalls for electric vehicle
    • 3. Any support donb the Mayor
  • ② The Mayor shall determine the standard and attachment method of the mark issued by the City pursuant to Paragraph 1.
  • Article 10 (Cultivation of Electric Vehicle Industry)
  • ① The Mayor may implement the activities of the following subparagraphs to understand the electric vehicle and cultivate the electric vehicle industry:
    • 1. Research and delectric vehicleelopment to invigorate the electric vehicle and related industry
    • 2. Host, hold, and observe the expo and exhibition, domestic and overseas, for electric vehicle
    • 3. Hosting a seminar and forum to cultivate the electric vehicle industry
    • 4. Manpower cultivation for electric vehicle industry
    • 5. Expansion of electric vehicle penetration
    • 6. Establishment of the electric vehicle charging infrastructures and the information management computer network
    • 7. Any activity otherwise required to cultivate the electric vehicle industry
  • ② The Mayor may support an electric vehicle corporation or organization for the expense, in entirety or in part, within the budget to implement the activities pursuant to Paragraph 1 efficiently.
  • ③ The method and procedure to support the expense pursuant to Paragraph 1 shall follow the Busan Metropolitan City Local Subsidy Management Ordinance.
  • Article 11 (Consignment)
  • ① The Mayor may consign a part of the works for the penetration facilitation and use invigoration of electric vehicle to an electric vehicle institution or organization.
  • ② Consigning works, pursuant to Paragraph 1, shall follow the Busan Metropolitan City Framework Ordinance for Private Consignment for the matter not stipulated in the ordinance.
  • Article 12 (Reward)
  • The Mayor may reaward a person, institution, or corporation that contritutes greatly to the penetration facilitation and use invigoration of electric vehicle.
  • Article 13 (Prioritized Purchase of Electric Vehicle)
  • ① The Mayor shall strive to purchase or lease the 40 hundredths or more of the cars, which are managed and operated by the City, with electric vehicle.
  • ② The Mayor may recommend the City-invested institutions to follow the purchase ratio of Paragraph 1 for purchasing or leasing the office cars.

  • Article 14 (Publicity)
  • The Mayor may use various media and publicize to invigorate the penetration and use of electric vehicle. [New addition of the article January 10, 2018]
  • Article 15 (Exclusive Parking Stall for Electric Vehicle)
  • The Mayor may recommend to assign a certain ratio for the exlcusive parking stall for electric vehicle to the exlcusive parking stall for light car and environment-friendly car installed pursuant to the Parking Lot Act Enforcement Decree Article 14.
  • Supplementary Provision

  • Article 1 (Effective Date)
  • The ordinance shall be in effect 3 months after proclamation.
  • Article 2 (Application for Eligible Installation for Charging Facility)
  • Article 6 shall apply to the facility which applies for a construction permit pursuant to the Building Act Article 11, the facility which files for a construction reporting pursuant to the Act Article 14, the facility which discusses with an permit authority in jurisdiction of a structure pursuant to the Act Article 29, the faility which applies for a business plan authorization pursuant to the Housing Act Article 15 Paragraph 1 or Paragraph 3, and the facility which applies for the authorization of an implementation plan pursuant to the National Land Planning and Utilization Act Article 88.
  • Article 3 (Relectric vehicleision of Other Ordinance)
  • the Busan Metropolitan City Ordinance on the Toll Collection for Toll Road shall be revised partially as follows: The Attachment Table 2 shall add the No. 18 column as follows:
  • Supplementary Provision <January 10, 2018>

  • The ordinance shall be in effect upon proclamation.
