BUSAN METROPOLITAN CITY ORDINANCE ON PROMOTION OF MICE INDUSTRY

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to increase the brand value of Busan Metropolitan City as a city of the MICE industry and to contribute to invigorating the regional economy by promoting the MICE industry.
  • Article 2 (Definitions)
  • The ordinance shall use the terms, which are defined as follows:
    • 1. “MICE industry (hereafter called “MICE Industry”) means a new industry, which blends corresponds with the following items:
      • a. Meeting
      • b. Incentive Travel
      • c. Convention
      • d. Exhibition
    • 2. “Public institution” means a public corporation or entity established by Busan Metropolitan City, pursuant to the Local Public Enterprise Act, and an institute invested or contributed pursuant to the Busan Metropolitan City Ordinance on the Operation of Invested and Contributed Institution Article 2.
  • Article 3 (Responsibilities)
  • The City shall establish the sustainable industrial foundation and eco system and plan for and advance the required policy to cultivate the MICE Industry and grow and develop to a central city of the MICE Industry.
  • Article 4 (Plan and Execution of Master Plan)
  • ① The mayor of Busan Metropolitan City (hereafter called “mayor”) shall plan for and execute the master plan for the cultivation of the MICE Industry (hereafter called “Master Plan”) to cultivate the MICE Industry in every five years.
  • ② The Master Plan shall incorporate the following subparagraphs:
    • 1. Development goal and direction for the MICE Industry
    • 2. Domestic and international conditions of the MICE industry, and prospects therefor
    • 3. Matters concerning policies to promote the MICE industry
    • 4. Establishment of the cooperation system pursuant to Article 19
    • 5. Policy and system improvement for the cultivation of the MICE Industry
    • 6. Management of safety, sanitation, and quarantine for infectious disease pertaining to the MICE Industry
    • 7. Other matters necessary for promoting the MICE industry
  • ③ The Mayor shall plan for and execute the implementation plan for the cultivation of the MICE Industry (hereafter called “Implementation Plan”), pursuant to the Master Plan.
  • Article 5 (Inspection of Status)
  • ① The Mayor may commission a special institution and conduct a survey or a policy research service for the MICE Industry if needed, to plan for and execute the Master Plan and the Implementation Plan in an efficient manner.
  • ② The Mayor may request relevant institutions and organizations to submit materials, if needed, to conduct a survey pursuant to Paragraph 1.
  • Article 6 (Projects to Promote MICE Industry)
  • ① The Mayor shall advance the following projects to promote the MICE industry and to strengthen its competitiveness:
    • 1. Research and study on the MICE Industry
    • 2. Expand and operate the facilities pertaining to the MICE Industry
    • 3. Support to attract, discover and, host the events pertaining to the MICE Industry
    • 4. Publicizing the MICE industry at home and abroad
    • 5. Projects of participation in overseas exhibitions
    • 6. Educating and training specialists in the MICE industry
    • 7. Supporting promising international conferences and exhibitions suitable for promoting strategic industries of the City
    • 8. Promoting and supporting local enterprises relating to the MICE industry
    • 9. Supporting participants in the events relating to the MICE industry
    • 10. Formation and operation of the Council to invigorate the MICE Industry
    • 11. Foundation establishment to carry out the electronic MICE event via information communication network, such as internet
    • 12. Activity to cultivate and promote the international conference multiplex zone designated pursuant to the Act on the International Conference Industry Promotion Act Article 15-2
    • 13. Other projects deemed by the Mayor necessary in promoting the MICE industry
  • ② The Mayor may support the required expense, in entirety or in part, within the budget for the institution, or organization, or organization, which advances the activity that any one of following subparagraphs in Paragraph 1 is applicable to.
  • Article 7 (Formation, Designation, and Support for Special Organization)
  • ① To efficiently advance duties relating to the MICE industry, the Mayor may establish or designate an organization exclusively(hereafter called “Special Organization) in charge of the MICE industry that performs the following duties; he/she may subsidize the expenses necessary for its operation within budgetary limits.
    • 1. Support to attract and host a MICE event
    • 2. Domestically and internationally publicizing the MICE industry
    • 3. Collecting and distributing information relating to the MICE industry
    • 4. Educating specialists relating to the MICE industry, and demand therefor and supply thereof
    • 5. Cooperating with an organization in exclusive charge of international conferences designated by the Minister of Culture, Sports and Tourism pursuant to Article 5 of the International Conference Industry Promotion Act
    • 6. Other duties relating to promoting the MICE industry.
  • ② Where necessary to efficiently operate an organization exclusively in charge of the MICE industry, the Mayor may have affiliated public officials dispatched to such organization to serve therein pursuant to the Local Public Officials Act.
  • Article 8 (Entrustment of Duties)
  • ① The Mayor may consign the activities pursuant to the ordinance, in entirety or in part, to the Special Organization, or a public institution, or a non-profit corporation or organization, pertaining to the MICE Industry, to execute the activities pursuant to the ordinance in a professional and efficient manner.
  • ② Where the Mayor entrusts duties pursuant to paragraph (1), he/she may subsidize necessary expenses, within budgetary limits.
  • Article 9 (Formation of Busan Metropolitan City MICE Industry Cultivation Council)
  • The Mayor shall have the Busan Metropolitan City MICE Industry Cultivation Council (hereafter called “Council”) in place for consulting on the following subparagraphs on the cultivation of the MICE Industry.
    • 1. Planning for the Master Plan and the Implementation Plan
    • 2. Activities to cultivate the MICE Industry pursuant to Article 6
    • 3. Formation, designation, and support for the Special Organization pursuant to Article 7
    • 4. Work consignment pursuant to Article 8
    • 5. Establishment of the cooperation system pursuant to Article 19
    • 6. Any agenda introduced by the Mayor on the cultivation of the MICE Industry
  • Article 10 (Formation of Council)
  • ① The Council shall consist of up to fifteen members, including one chairperson and one vice chairperson.
  • ② A Economy Deputy Mayor shall act as the chairperson of the Council (hereafter called “Chairperson”) with the vice chairperson elected from the members.
  • ③ A Tourism MIVE Industry Director General shall as an ex-officio member, and the Mayor shall appoint the entrusted members, in consideration of gender, from the persons of the following subparagraphs:
    • 1. Person recommended by the Busan Metropolitan City Council
    • 2. Person recommended by institutions and organizations pertaining to the MICE Industry
    • 3. Specialist from the MICE Industry and other industries related to the MICE
    • $. Other person highly knowledgeable of the MICE Industry with an abundance of experiences
  • ④ The entrusted members shall serve the term of two years, except that a supplementary member shall serve the remaining term of a predecessor member.
  • Article 11 (Dismissal of Council Member)
  • The Mayor may dismiss a member of the Council if any one of the following subparagraphs is applicable to the member:
    • 1. Unable to carry out duties due to a health reason
    • 2. Involved in the breach of confidence or misdeeds pertaining to duties
    • 3. Deemed inappropriate to serve as a member due to negligence, demeaning, and any other reason
    • 4. Revealing by a member of the incapability of fulfilling the duties
  • Article 12 (Exclusion, Recusal, and Evasion of Council Member)
  • ① A member of the Council shall not participate in the deliberation on an agenda, in which the member has direct interests.
  • ② A concerned party of the agenda may file for a recusal with the Council in the event that he/she has a circumstance that makes the fair deliberation by the member unlikely to expect, and the Council shall determine the recusal of the member. In such case, the member in the recusal filing shall not participate in the decision.
  • ③ A member of the Council shall recuse himself/herself from the deliberation of the agenda in the event that the reason for exclusion in Paragraph 1 is applicable to the member.
  • Article 13 (Duties of Chairperson)
  • ① The chairperson shall represent the Council and oversee the works of the Council.
  • ② The vice chairperson shall act on behalf of the chairperson in the event that the chairperson is unable to carry out his/her duties due to an unavoidable reason. The Mayor shall designate a member, who shall act on behalf of the chairperson in the event that both the chairperson and vice chairperson are unable to carry out their duties due to unavoidable reasons.
  • Article 14 (Meeting of Council)
  • ① The chairperson shall convene and chair the meetings of the Council.
  • ② The Council shall have in place the meetings, which are divided into a regular meeting held once a year and a special meeting held when deemed necessary by the chairperson or if one third of the registered members demand.
  • ③ The meeting of the Council shall convene with the attendance of a majority of the registered members and reach a decision with the consent of a majority of the attending members.
  • ④ Notwithstanding Paragraph 3, the chairperson may specify a reason and deliberate in writing, if any one of the following subparagraphs is applicable, and in such case, a decision shall be reached with the submission of a deliberation opinion in writing by a majority of the registered members and the consent of a majority of the submitting members:
    • 1. Minor matters in nature
    • 2. Too urgent to convene the meeting due to a pressing reason
    • 3. Unable to attend the meeting due to a reason, such as infectious disease
  • Article 15 (Administrative Secretary)
  • The Council shall have one administrative secretary in place to process the works of the Council, and a director in charge of the works pertaining to the MICE Industry shall act as the administrative secretary.
  • Article 16 (Hearing of Opinion)
  • The Council may have a relevant official or specialist attend the meeting, if necessary, pertaining to deliberating on a meeting agenda, or request for the submission of to materials needed.
  • Article 17 (Allowance)
  • The Council may pay allowance and travel expense, within the budget, to the entrusted members and a relevant specialist for attending the meeting.
  • Article 18 (Operation Rule)
  • The chairperson shall determine, with the decision by the Council, the requirements to operate the Committee, other than the stipulation in the ordinance.
  • Article 19 (Construction of Cooperative System)
  • ① The Mayor may engage in advancing, or collaborating for, the activities jointly with other local municipalities and relevant institutions, organizations, or universities to promote the MICE Industry in an efficient manner.
  • ② The Mayor may push the international exchange activities, such as information exchange with overseas cities and international organizations, for the enhanced global status of the City and the policy development for the MICE Industry.
  • Article 20 (Prizes)
  • The Mayor may confer prizes on excellent enterprises or enterprise operators relating to the MICE industry who have made significant contribution to promoting the MICE industry, as prescribed by the Busan Metropolitan City Ordinance on Prizes.
  • ADDENDA
  • Article 1 (Enforcement Date)
  • This Ordinance shall enter into force one month after the date of its promulgation.
  • Article 2 (Repeal of other Ordinances)
  • The Busan Metropolitan City Ordinance on the Promotion of International Convention Industry is hereby repealed.
  • Supplementary Provision
  • Supplementary Provision (Busan Metropolitan City Administrative Institution Formation Ordinance) <July 10, 2019>
  • The ordinance shall be in effect upon proclamation.
  • ㉕; The Busan Metropolitan City Ordinance on the MICE Cultivation shall be revised in part as follows:
    “Administration Deputy Mayor” in the provisions of Article 7Paragraph 3, other than the subparagraphs, shall be substituted with “Economy Deputy Mayor.”

  • Supplementary Provision <August 11, 2021>
  • Article 1 (Effective Date)
  • The ordinance shall be in effect upon proclamation.
  • Article 2 (Interim Measure for Work Consignment)
  • The work under consignment at the time of enforcing the ordinance shall be deemed consigned pursuant to the ordinance, notwithstanding Article 8, until the consignment contract for the work expires.
  • Article 3 (Interim Measure on Term of Busan Metropolitan City MICE Industry Cultivation Council Members)
  • The work under consignment at the time of enforcing the ordinance shall be deemed consigned pursuant to the ordinance, notwithstanding Article 8, until the consignment contract for the work expires.
