BUSAN METROPOLITAN CITY ORDINANCE ON SUPPORTING TOILETS FOR PUBLIC USE

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to prescribe matters concerning supporting toilets for public use designated by the head of a Gu or Gun under Article 9 (2) of the Public Toilets, etc. Act, thereby to contribute to promoting hygienic convenience and welfare for the public.
  • Article 2 (Definitions)
  • The terms used in this Ordinance shall be defined as follows:
    • 1. The term "toilet for public use" means a toilet designated by the head of a Gu or Gun (hereinafter referred to as the "head of a Gu, etc.") pursuant to Article 9 (2) of the Public Toilets, etc. Act;
    • 2. The term "management and operation expenses" means expenses for convenient and hygienic items and electricity; expenses for water supply and drainage; cleaning fees for septic tanks; and other costs necessary for managing toilets for public use.
  • Article 3 (Responsibilities) (1) The Busan Metropolitan City Mayor (hereinafter referred to as the "Mayor") shall formulate measures necessary for encouraging and expanding the designation of toilets for public use in consultation with the head of Gu, etc. in order to enhance convenience and sanitation levels for the citizens.
  • (2) The Mayor shall take various measures to allow citizens to readily recognize toilets for public use in consultation with the head of Gu, etc.
  • Article 4 (Scope of Application)
  • Except as otherwise expressly provided for in statutes or other Ordinances, this Ordinance shall apply to supporting toilets for public use.
  • Article 5 (Subsidizing Management and Operation Expenses, Etc.) (1) The Mayor may partially subsidize management and operation expenses to the head of Gu, etc. within budgetary limits to support toilets for public use, and the criteria for subsidization shall be as attached Table.
  • (2) The Mayor may fully or partially subsidize the expenses for installing direction signs of toilets for public use.
  • (3) Person who may be entitled to subsidized management and operation expenses, etc. shall be an owner or manager of a building.
  • (4) The users' assessment and satisfaction level of toilets for public use may be reflected in calculating subsidies for management and operation expenses in paragraph (1). <Newly Inserted by Ordinance No. 5457, Nov. 2, 2016>
  • (5) The Mayor may promote the following projects to enhance the sanitation of and citizens' convenience with toilets for public use: <Newly Inserted by Ordinance No. 5457, Nov. 2, 2016>
    • 1. Education and campaigns to improve the level of citizens' awareness;
    • 2. Surveys and monitoring related to toilets;
    • 3. Matters necessary for enhancing the sanitation level of and convenience with toilets.
  • (6) The Mayor may provide administrative and financial support on institutions and organizations which promote projects prescribed in the subparagraphs of paragraph (5). <Amended by Ordinance No. 5457, Nov. 2, 2016>
  • Article 6 (Supervision, Etc.)
  • The Mayor may supervise and survey support to toilets for public use in consultation with the head of Gu, etc.
  • Article 7 (Obligations)
  • Any person subsidized with management and operation expenses shall conscientiously do the following:
    • 1. As a good manager, he/she shall keep the relevant toilets clean and comfortable;
    • 2. Prepare and provide convenient and hygienic articles;
    • 3. Not use such subsidies other than for management and operation expenses.
  • Article 8 (Sanctions)
  • Where a person subsidized with management and operation expenses falls under any of the following, the Mayor may order him/her to return all or part of the subsidies for management and operation expenses already subsidized:
    • 1. Where he/she has been subsidized for expenses for management and operation by fraud or other illegal means;
    • 2. Where he/she fails to open the relevant toilet buildings without any justification;
    • 3. Where he/she violates any of the obligations in the subparagraphs of Article 7.

ADDENDUM <Ordinance No. 5457, Nov. 2, 2016>

  • This Ordinance shall enter into force one month after the date of its promulgation.
