BUSAN METROPOLITAN CITY ORDINANCE ON THE ESTABLISHMENT AND OPERATION OF BUSAN TRAFFIC CULTURE INSTITUTE

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to prescribe the matters necessary to establish and operate the Busan Metropolitan City Traffic Culture Institute pursuant to Article 25 (3) of the Passenger Transport Service Act and Article 59 (2) of the Trucking Transport Business Act.
  • Article 2 (Location)
  • The Busan Metropolitan City Traffic Culture Institute (hereinafter referred to as "the Institute") shall be located at 256 Hyoyeol-ro Buk-gu Busan Metropolitan City (Geumgok-dong).
  • Article 3 (Programs)
  • The Institute shall provide the following programs:
    • 1. Matters concerning education for transport employees under Article 3-2 (2) 6 of the Passenger Transport Service Act and subparagraph 8 of Article 2 of the Trucking Transport Business Act (hereinafter referred to as "transport employees");
    • 2. Matters concerning education for drivers of a special means of transportation and a low-floor bus under the Busan Metropolitan City Ordinance on the Promotion of Transportation Convenience of Mobility Disadvantaged Persons;
    • 3. Matters concerning the support of transport employee's leisure activity;
    • 4. Matters concerning education to improve services for passengers and cargo transportation;
    • 5. Other matters concerning traffic order and safety education for citizens.
  • Article 4 (Education Fees)
  • (1) When the Mayor of Busan Metropolitan City (hereinafter referred to as the "Mayor") provides education under Article 25 (1) of the Passenger Transport Service Act and Article 59 (1) of the Trucking Transport Business Act, he or she may receive education fees from transport employees who are newly employed for passenger transport and those who drive trucks whose principal place of use is not Busan Metropolitan City.
  • (2) The Mayor shall determine education fees referred to in paragraph (1) and education schedules for transport employees considering the content, hours, etc. of educational courses, and shall post such fees and schedules on the website of Busan Metropolitan City. The same shall also apply when the fees and schedules are changed.
  • Article 5 (Entrustment of Management and Operation)
  • (1) For the efficient management of the Institute and expertise in teaching, the Mayor may entrust the management and operation of the Institute to a nonprofit corporation established for the purpose of educating transport employees.
  • (2) If the Mayor intends to entrust the management and operation of the Institute, he or she shall conclude an entrustment contract with an entrusted person (hereinafter referred to as "entrusted person"), and a contract period shall be up to five years.
  • (3) An entrusted person shall prepare regulations regarding the management and operation of the Institute and obtain approval thereof from the Mayor. The same shall also apply when such regulations are amended.
  • (4) The Mayor may assist an entrusted person with expenses for the management and operation of the Institute within the budget.
  • Article 7 (Guidance and Supervision)
  • (1) Where the Mayor entrusts the management and operation of the Institute under Article 5, he or she may require a report to be made on entrusted affairs or have relevant public officials investigate or inspect the status of facility management and the provision of education, documents, etc.
  • (2) If any matter is found to be corrected after a report is made or an investigation or inspection is conducted under paragraph (1), the Mayor shall order an entrusted person to correct such matter or shall take other necessary measures.
  • Article 8 (Termination of Entrustment Contract)
  • The Mayor may terminate an entrustment contract under any of the following conditions:
    • 1. Where an entrusted person violates relevant statutes, regulations or this Ordinance;
    • 2. Where an entrusted person violates an entrustment contract;
    • 3. Where the normal management and operation of the Institute is impracticable due to any other reason attributable to an entrusted person.
  • Article 9 (Hearing)
  • The Mayor shall hold a hearing if he or she intends to terminate an entrustment contract pursuant to Article 8.
  • ADDENDUM <Ordinance No. 5423, Sep. 21, 2016>
  • This Ordinance shall enter into force one month after the date of its promulgation: Provided, That the amended provisions of subparagraph 1 of Article 3 shall enter into force on January 20, 2017.
