Busan Metropolitan City Ordinance on the Registration and Support of the Busan Town Bus Transport Business

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to stipulate the matters mandated in Article 17 ②, Article 23 ② and Article 44 ⑥ of the Enforcement Regulations of the Passenger Motor Transport Business Act. <Amended on Feb. 16, 2005; Jul. 9, 2014; Jul. 11, 2018>
  • Article 1-2 (Definitions)
  • The meanings of the terms used in this Ordinance shall be as follows: <Amended on May 26, 2021>
  • 1. "Village bus" means a bus registered by the Busan Metropolitan Mayor (hereinafter referred to as the "Mayor") to operate a business that operates between the railway station (including the urban railway station) or the route bus stop closest to these villages, starting or ending at the starting point or ending point of any one of Article 3 ① of the Enforcement Decree of the Passenger Motor Transport Business Act (hereinafter referred to as the "Enforcement Decree") and the village falling under any one of Article 8 ④ of the Enforcement Regulations of the Passenger Motor Transport Business Act (hereinafter referred to as the "Enforcement Regulations");
  • 2. "Limited License" means a license obtained pursuant to Article 4 ③ of the Passenger Motor Transport Business Act (hereinafter referred to as the "Act") and Article 17 of the Implementing Regulations for a limited scope or period of work related to passengers, etc. to be transported from the market;
  • 3. "Village bus transport operator" means a transport operator that transports passengers by registering a passenger motor transport business in accordance with Article 3 ① of the Enforcement Decree;
  • 4. "Village bus transportation worker" means a person who is qualified to engage in driving work in accordance with Article 24 of the Act and is engaged in the driving work of a village bus transportation business;
  • 5. "Pressure-resistant container" means a container (including a container valve and a container safety device) manufactured for the purpose of mounting or mounting on an automobile for the purpose of using high-pressure gas as fuel as a container pursuant to Article 3 ② of the High-Pressure Gas Safety Control Act.

  • Article 2 (Registration Conditions)
  • Registration condition of the town bus transport business shall be as follows: <Amended on Jul. 9, 2014, Jan. 1, 2016>
    • 1. Securing the number of registration standards and the area of the garage owned in accordance with attached Table 3 of the Enforcement Rules; <Amended on Jul. 9, 2014; Jan. 1, 2016>
    • 2. Reporting the fare within the limit of the criteria and the rate as determined by the Mayor. <Amended on Jul. 9, 2014; Jan. 1, 2016>
  • Article 3 (Criteria for the operation system of the village bus transportation business)
  • ① The operating system of the village bus transportation project shall be designated to serve as an auxiliary function of the route bus that is responsible for the trunk line function and as a means of linked transportation.
  • ② The Mayor shall survey the traffic needs on a regular basis or frequently and determine the operating routes and operating systems for the areas where it is deemed necessary to operate the village bus.
  • ③ The Mayor shall ,unless there is a special reason, require village buses to operate between the nearest railway station or route bus stops with villages, etc. referred to in each subparagraph of Article 8 ④ of the Enforcement Rule as the starting or ending point.

  • Article 3-2 (Adjustment of Operation System)
  • When the Mayor deems it necessary to adjust the operating system of the registered village bus transportation business, he/she may adjust the operating system by referring to the opinions of the passengers, village representatives, and the relevant village bus transportation operator. <This Article Newly Inserted on Jan. 11, 2016>
  • Article 4 (Public Announcement of Bus Route, etc. <Amended on Jul. 9, 2014>)
  • The Mayor shall publicly announce the bus route and the operation system one month in advance when he/she deemed it necessary to operate the town bus. <Amended on Jul. 9, 2014>
  • Article 5 (Selection of Transport Business)
  • The Mayor shall select the operator considering bus depot, capital, experience in transport business, and service plan when there are more than 2 applicants who meet the registration criteria after publicly announcing the bus route, etc. pursuant to Article 4. <Amended on Jul. 9, 2014>
  • Article 6 (Relaxed Criteria of Registration)
  • The Mayor shall publicly announce the minimum number of buses for registration differently which is at least three as determined by the Mayor in islands, backwoods, and other special areas pursuant to the attached table 3 ① of the Rule. <Amended on Jul. 9, 2014>
  • Article 7 (Method of Public Announcement)
  • Public announcement pursuant to Article 4 and 6 shall be made by Busan city official gazette, and Webpage which is run by Metropolitan City. <Amended on Jun. 8, 2011; Jul. 9, 2014>
  • Article 8 (Qualified License)
  • Article 4 and 5 shall apply mutatis mutandis to the matters necessary for qualified license pursuant to the provision of Article 17 of the Rule. <Amended on Jul. 9, 2014>
  • Article 9 (Special Provisions on Guarantee of Rest Time for Village Bus Transport Workers)
  • Pursuant to Article 44-6 ② of the Enforcement Rule, the village bus transport operator shall guarantee a rest period of not less than 10 minutes after the end of the operation exceeding one hour, regardless of the number of trips, if the duration of the single operation is less than one hour.   • Article 10 (Safe Operation and Management)
  • ① A village bus transportation worker shall endeavor not to violate laws and regulations directly related to the safety of citizens, such as drunk driving, reckless driving, and violation of traffic laws.
  • ② A village bus transportation business operator shall maintain a clean state inside and outside the village bus.
  • ③ A village bus transportation business operator shall provide regular training for village bus transportation workers to be proficient in operating various devices related to the operation of village buses, and shall ensure that various devices operate normally.
  • ④ The village bus transportation business operator shall continuously manage the safety of the pressure-resistant container.

  • Article 11 (financial support)
  • ① The Mayor may partially subsidize necessary funds if deemed necessary for financial support in any of the following cases:
    • 1. In case a village bus transportation business operator carries out a business falling under any subparagraph of Article 50 ② of the Act;
    • 2. In the case of a transportation loss due to the implementation of the transfer discount system between public transportation means to a village bus transportation business operator;
    • 3. In case a village bus transportation business operator carries out other projects for the sound development of village buses and limited license transportation projects and the promotion of transportation convenience.
  • ② A village bus transport operator must obtain the approval of the mayor when it wishes to make changes to its business plan related to financial support.
  • ③ In case the Mayor decides to provide subsidies pursuant to paragraph ①, he/she may attach conditions necessary for achieving the purpose.
  • ④ Matters necessary for the application and procedures for financial support for village buses shall be governed by Articles 3 and 4 of the Busan Metropolitan Government Ordinance on Financial Support for Passenger Vehicle Transportation Business.
