Busan Metropolitan City Ordinance on the Establishment and Operation of the Busan Children Traffic Safety Education Center

- Article 1 (Purpose)
- The purpose of this Ordinance is to establish the Busan Metropolitan City Children Traffic Safety Education Center for preventing children traffic accidents and for developing traffic safety spirits, and to prescribe the matters necessary to mange and operate the Busan Metropolitan City Children Traffic Education Center.
- Article 2 (Place of Location)

The Busan Metropolitan City Child Traffic Safety Education Center 9hereafter called “Education Center”) shall be as located as follows:
- 1. 29-48, 33 beon-gil , Seongjigok-ro, Busanjin-gu, Busan Metropolitan City
- 2. 687, Nakdongbuk-ro, Buk-gu, Busan Metropolitan City (Gupo-dong)
- Article 3 (Facility)

The Center shall equip the following facilities for traffic safe education which is systematic and realistic to children:
- 1. Indoor education facilities: traffic structures including bus, plasma display panel, screen exhibitions, simulators, etc
- 2. Outdoor education facilities: model pedestrian overpasses, model alleys, otor cars, traffic signals, traffic signs and
- 3. Others: a management office, a warehouse, etc.
- Article 4 (Business)

The Center shall conduct the following businesses:
- 1. Traffic safety education for children
- 2. Building a database related to traffic safety for children
- 3. Publication and promotion of newsletters related to traffic safety and
- 4. Any other activity for child to raise awareness for the traffic safety and experience the traffic safety
- Article 5 (Business Hours, etc.) (1) The business hours of the Center shall be as follows:

- 1. Weekdays: 09:00 - 18:00 and
- 2. Saturday: 09:00 - 13:00.
- (2) The Center shall be closed on Sundays and holidays.
- (3) It the mayor of Busan Metropolitan City (hereafter called “Mayor”) adjusts the operation hours and closed days due to the reason of facility maintenance and/or repair, notwithstanding Paragraphs 1 and 2, the Mayor shall post the adjustments in the Busan Metropolitan City website.
- Article 6 (Education Fees, etc.)
- The fees for using the Center and traffic safety education for children shall be free of charge.
- Article 7 (Entrustment of Managent and Operation)
- (1) The Mayor may consign the management and operation of the education center located as in Article 2 Paragraph 1, if deemed necessary to manage and operate the education located as in Article 2 Paragraph 1 in an efficient manner, to a Busan Metropolitan City public corporation or entity or a non-profit corporation or organization pertaining to traffic (hereafter called “Assignee”).
- (2) The consignment of the education center operation and management, pursuant to Paragraph 1, shall require to conclude a consignment contract with the Assignee for the consignment period of up to five years.
- (3) The entrusted person shall establish the management regulations necessary for such management and operation, which shall be subject to the approval of the Mayor , and the same shall apply to amendments to those management regulations.
- (4) (3) shall include all the matters necessary for the management and operation of the Center, such as the organization and the prescribed number of personnel for the performance of entrusted affairs, and the entrusted person shall manage and operate the Centerin accordance with the said management regulations.
- (5) The Mayor shall subsidize expenses necessary for such management and operation of the Center within the limits of budget when he/she entrusts the management and operation of the Center pursuant th th paragraph (1)
- Article 8 (Obligations of Entrusted Person)
- (1) The entrusted person shall neither use the Center for any purpose other than those of its establishment nor make any alteration to its facilities without the approval of the Mayor.
- (2) The entrusted person shall, bona fide, manage all the facilities at the Center.
- (3) The entrusted person shall take appropriate measure including having insurance for children safety accident and facility management.
- (4) The entrusted person shall not do purchase, sale, concession, exchange, and establishment of any right with th third party. The entrusted person shall neither transfer nor sublease any right related to or arising from the management and operation of the Center to other persons without the approval of the Mayor.
- Article 9 (Guidance and Supervision)
- (1) The Mayor may guide and supervise the entrusted person in the management and operation of the Center, have the entrusted person make a necessary report on entrusted affairs or order him/her to take other necessary measures, and have a relevant public official investigate or inspect the status of such management and operation and the books, etc. regularly or frequently.
- (2) If the Mayor deems that there are matters which shall be corrected, after receipt of a report or the results of investigation or inspection under the paragraph ① he/she shall order the entrusted person to take measures necessary for such correction.
- Article 10(Termination of Agreement on Entrustment)
- (1) in any case falling under any of the following subparagraphs, the Mayor may terminate an entrustment contract:
- 1. In a case where the entrusted person commits a breach of the said agreement on entrustment;
- 2. In a case where the entrusted person violates Article 8;

- 4. If the Assignee is unable to operate the education center normally due to the reason of own responsibility
- (2) The Mayor intends to terminate the consignment contract pursuant to Paragraph 1, the Mayor shall notify the Assignee of the reason and the termination date no later than sixty days prior to the scheduled termination date.
- Article 11 (Hearing)
- The Mayor shall conduct a hearing to terminate the consignment contract, pursuant to Article 10 Paragraph (1)
- Article 12 (Delegation of Authority)
- (1) The Mayor shall delegate the management and operation of the education centers located as in Article 2 Paragraph 2 to the district mayors in jurisdiction of the places of location.
- (2) The Mayor may support the expense, within the budget, required for the delegated mayors pursuant to Paragraph 1 to carry out the consigned works.
- (3) The Mayor may have the delegated district mayors, pursuant to Paragraph 1, report the management and operation of the education center, if necessary, or have relevant officials inspect and examine, regularly and occasionally, the management and operation and the ledgers.
- Article 13 (Volunteer Workers)
- The Mayor may assign volunteer workers to the Center for the smooth operation, user’s convenience, and the maintenance of order.
- Article 14 (Provisions Applicable Mutatis Mutandis)
- The relevant provisions of the Busan Metropolitan City Local Subsidy Management Ordinance and the Busan Metropolitan City Ordinance on the Public Property and Goods Management shall apply mutatis mutandis to those matters concerning management operation, etc. of the Center which are not provided for by this Ordinance.
- Supplementary Provision
- Article 1 (Effective Date)
- The ordinance shall be in effect one month after proclamation.
- Article 2 (Interim Measure on Consigned Operation)
- The education center under consigned operation pursuant to the previous regulation at the time of enforcing the ordinance shall be deemed consigned for operation pursuant to the ordinance.

- Article 1 (Effective Date)
- The ordinance shall be in effect one month after proclamation.
