Busan Metropolitan City Designated Driving Day System Support Ordinance

[Effective August 14, 2016] [Busan Metropolitan City Ordinance No. 5377, Partially revised July 13, 2016]

The ordinance aims at stipulating the basic requirements for the Busan Metropolitan City’s traffic demand control policy of the Designated Driving Day System, pursuant to Article 33 Paragraph 3, and laying grounds for advancing the Designated Driving Day System in a systematic and continuous manner by engaging the community members in autonomous participation.

  • Article 2 (Deleted)

  • Article 4 (Basic Responsibility)
  • ① The mayor of Busan Metropolitan City (hereafter called “Mayor”) shall advance the Designated Driving Day System (referring to the Designated Driving Day System pursuant to the Urban Traffic Improvement Promotion Act Article 34-2 and henceforth applied likewise), and shall develop and implement, actively, the matters and various traffic demand control methods to facilitate the more frequent use of the public transit.
  • ② District mayors and gun mayors shall be fully cooperative of implementing the Designated Driving Day System in an efficient manner.
  • ③ The representatives of the public institution and organization and companies shall recommend the staffs to participate in the Designated Driving Day System, and take requisite actions.
  • Article 5 (Citizen’s Rights and Duties)
  • ① All the citizens shall have the right to live in pleasant traffic environment.
  • ② All the citizen must actively participate and cooperat in the No-Drive Days operation for improving traffic environment conditions.
  • Article 6 (Participation and Method of Designated Driving Day System)
  • ① A participating vehicle of the Designated Driving Day System shall be limited to a non-commercial passenger car with a seating capacity of 10 passengers or less, which shall not be available for driving on a certain day during the weekdays of Monday through Friday.
  • ② The participating vehicle in the Designated Driving Day System shall file for registration with Busan Metropolitan City, and operate with the Mayor-issued electronic certification sticker attached to a set location.
  • ③ The Mayor may deregister a vehicle from the Designated Driving Day System if any one of the following subparagraphs is applicable, and in such case, the deregistered vehicle shall not be eligible for registration in the given year:
    • 1. A passenger car participating in the Designated Driving Day System violates the Designated Driving Day System in the given year five times or more
    • 2. A passenger car participating in the Designated Driving Day System fails to attach, or damages, the electronic certification sticker
    • 3. A passenger car participating in the Designated Driving Day System has no records of operation for 90 days, and fails to complete an inspection of the electronic certification sticker within 30 days after the inspection is demanded
  • ④ The benefits pursuant to Article 9 shall be suspended for the deregistered vehicle pursuant to Paragraph 3.
  • Article 6-2 (Operation Hours)
  • ① The operation hours for the Designated Driving Day System shall be Monday through Friday, 7:00am to 8:00 pm.
  • ② The Designated Driving Day System shall not be applied to the day of the following subparagraphs:
    • 1. Holiday pursuant to the Regulation on Holiday for Public Office
    • 2. Labor Day pursuant to the Act on Labor Day Enactment
    • 3. College scholastic ability test day pursuant to the Higher Education Act Enforcement Decree
    • 4. Any day deemed otherwise necessary by the Mayor
  • Article 7 (Execution by Agent for Designated Driving Day System)
  • The Mayor may hire an civil organization to act as an agent for publicity, guidance, and other requirements to implement the Designated Driving Day System in an efficient manner.
  • Article 8 (Financial Support)
  • ① The Mayor may support the expense spending pursuant to the Designated Driving Day System, in part, for the agent organization pursuant to Article 7.
  • ② The Mayor may support supplies and publicity materials for the events pertaining to the Designated Driving Day System, such as campaigning for the enlarged participation in the Designated Driving Day System.
  • ③ The Mayor may provide prizes, via drawing, for the participants of the Designated Driving Day System.
  • Article 9 (Benefits for Participating Vehicle in Designated Driving Day System)
  • The Mayor may grant the benefits of the following subparagraphs to encourage the participation in the Designated Driving Day System.
    • 1. Reduced parking rate at public parking lots pursuant to the Busan Metropolitan City Parking Lot Installation and Management
    • 2. Deleted
    • 3. Deleted
    • 4. Discounted entrance fee of public facilities(park, gym facility and etc.)
    • 5. Prioritized support for a part of the expense required to resolve the resident suggestion, within the budget, for an apartment housing with excellent results of participation in the Designated Driving Day System
    • 6. Additional points given to the evaluation item in the allocation criteria for resident-reserved parking lot
    • 7. Exemption of charges for causing the traffic congestion provided for the business traffic demand management system
    • 8. Reduced automobile tax pursuant to the Busan Metropolitan City Tax Reduction Ordinance
  • Article 10 (Restriction Against Non-Participating Vehicle)
  • Any car, which does not participate in, or fails to satisfy the requirements for, the Designated Driving Day System may be placed under the necessary measures, such as the restricted parking in public office buildings or public parking lots, except for the non-participating cars of the Designated Driving Day System, as determined by the Mayor.
  • Article 10 (Reward)
  • THE Mayor may reward the community member, organization and public official, who make contributions to the vitalization of the Designated Driving Day System, pursuant to the Busan Metropolitan City Reward Ordinance.
  • Supplementary Provision <July 7, 2010>

  • Article 1 (Effective Date)
  • The ordinance shall be in effect on and after October 1, 2010.
  • Article 2 (Revision of Other Ordinance)
  • The Busan Metropolitan City Parking Lot Installation and Management Ordinance shall be revised in part as follows:
    • Paragraph 8 shall be newly incorporated into Article 3-2 as follows: 8. A driver of the participating car in the Designated Day Driving System pursuant to the Busan Metropolitan City Designated Day Driving System Support Ordinance Article 6: Reduction by fifty hundredths, except that no reduction shall be available for the monthly parking.
  • Supplementary Provision <July 13, 2016>

  • The ordinance shall be in effect one month after.
