Busan Metropolitan City Ordinance on the Operation of the Food Promotion Fund
- Article 1 (Purpose)
- The purpose of this Ordinance is to prescribe necessary matters for the efficient management and operation of the Busan Metropolitan City Food Promotion Fund, under Article 43，paragraph 7 of the Enforcement Decree of the Food Sanitation Act (hereinafter referred to as the "Enforcement Decree’。
- Article 2 (Operation of Fund)
- The Busan Metropolitan City Food Promotion Fund (hereinafter referred to as the "Fund") shall open a fund account in the Busan Metropolitan City Safe and conduct separate operations for the revenue account and the expenditure account.
- Article 3 (Fund Deliberative Committee)(1) The Busan Metropolitan City Food Promotion Fund Deliberative Committee (hereinafter referred to as the "Committee") shall be established for the deliberation of the following subparagraphs on the management and operation of the Fund.

- 1. Matters on the establishment and amendment of the Fund operation plan
- 2. Matters on the settlement of the Fund
- 3. Other matters that the Mayor of Busan Metropolitan City (hereinafter referred to as the "Mayor") deems necessary
- (2) The committee shall consist of no more than 13 members including a chairperson and a vice chairperson.
- (3) The chairperson shall be Director General of Welfare and Health Bureau, and the vice chairperson shall be elected among the members.
- (4) The members shall be commissioned or appointed by the Mayor among those who fall under the following subparagraphs:
- 1. Experts with knowledge in food sanitation
- 2. Craft union representatives related to the food sanitation business
- 3. Officials related to food sanitation
- (5) The term of the appointed members shall be 2 years and may be reappointed. However, the term of members who filled the vacancy shall be the remainder of the predecessor.
- (6) The Committee shall have an executive secretary to handle the Committee affairs，and the executive secretary shall be the deputy director in charge of food sanitation affairs.
- (7) Allowance and traveling expenses may be provided to appointed members within the scope of the budget.
- Article 4 (Report on Fund Operation Plan and Settlement)(1) The Mayor shall establish a fund operation plan every fiscal year, and shall prepare a settlement report.
- (2) The Mayor shall submit the fund operation plan and the fund settlement report every fiscal year pursuant to Paragraph 1 to Busan Metropolitan Council.
- Article 5 (Financing Project)(1) Pursuant to Article 71，Paragraph 3, Subparagraph 1 of the Food Sanitation Act, the Mayor may loan the Sanitation Management Facilities Improvement Fund (hereinafter referred to as the "Improvement Fund") to those who conduct business of Article 7 of the Enforcement Decree.
- (2) In case the Mayor loans the Improvement Fund under Paragraph 1，the detailed plan including the total volume of loan shall be established and enforced every year.
- (3) Persons who would like to receive the Improvement Fund loan shall apply to the Mayor.
- (4) The details on the target, procedure, and qualifications shall be prescribed in Municipal Rules.
- Article 6 (Entrustment and Management of Fund)(1) The Mayor may entrust the asset needed for the loan to a financial institution and have them deal with credit affairs.
- (2) In case the loan is entrusted to a financial institution pursuant to Paragraph 1， the Mayor shall conclude a contract on the entrustment management of the financing affairs.
- Article 7 (Accounting Related Official)(1) The Mayor shall appoint the following accounting related officials for the efficient operation of the fund.

- 1. Fund Accounting Commander: Director General of Welfare and Health Bureau.
- 2. Deputy Fund Accoutring Commander: Director in Charge of Food Sanitation Related Issues
- 3. Fund Accounting Public Official : Deputy Director in charge of Food Sanitation
- Article 8 (Delegation)
- The Mayor may partially delegate his/her right on the financing business to the head of Borough(Gu) and County(Gun).
- Article 9 (Appication mutatis mutandis of Related Provisions)
- Matters on the operation of this Fund that are not prescribed by this Ordinance shall be in accordance with the example of general accoutring custom.
