BUSAN METROPOLITAN CITY ORDINANCE ON THE MANAGEMENT AND OPERATION OF SPORTS FACILITIES

CHAPTER I GENERAL PROVISIONS

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to prescribe the matters necessary to manage and operate sports facilities established by Busan Metropolitan City under the Installation and Utilization of Sports Facilities Act.
  • Article 2 (Definitions)
  • The definitions of the terms used in this Ordinance shall be as follows: (Amended by Ordinance No. 4777, Jul. 11, 2012)
    • 1. The term "sports facilities" means the facilities defined in Article 2 (1) of the Installation and Utilization of Sports Facilities Act (hereinafter referred to as the "Act");
    • 2. The term "specialized sports facilities" means the facilities specified in attached Table 1 as sports facilities under Article 5 of the Act;
    • 3. The term "life sports facilities" means the facilities specified in attached Table 2 as sports facilities under Article 6 (1) of the Act;
    • 4. The term "sports facilities for persons with disabilities" means the facilities specified in attached Table 3 as sports facilities under Article 6 (2) of the Act;
    • 5. The term "user" means a person falling under any of the following who pays use fees for any of the sports facilities for a fixed time or period or who is allowed to use such facility by the facility operator:
      • (a) Infants: persons falling under subparagraph 1 of Article 2 of the Early Childhood Education Act;
      • (b) Children: persons aged under 13 except infants or elementary schoolchildren;
      • (c) Youths: persons aged over 13 and under 19 or middle and high school students;
      • (d) Adults: persons aged over 19 and under 65;
      • (e) Senior citizens: persons aged over 65.
  • Article 3 (Opening of and Access to Sports Facilities) (1) Where the Mayor of Busan Metropolitan City (hereinafter referred to as the "Mayor") intends to open the sports facilities to local residents in accordance with Article 8 of the Act, he or she shall formulate and implement a plan for regional residents' use thereof yearly or half-yearly and quarterly. In such cases, he or she shall consider the schedules of various games, sports events, or other events; plans for repairing sports facilities; holidays; etc.
  • (2) The Mayor shall arrange basic sports equipment in the sports facilities and shall post the following matters on the places readily visible to residents:
    • 1. Fees, opening hours, and methods of use in each sports facility;
    • 2. The scope of sports facilities for free use and matters concerning their use;
    • 3. The kinds of permanent sports schools and matters concerning their use.
  • (3) If the Mayor intents to restrict the opening of the sports facilities under paragraph (1) due to unavoidable reasons such as the schedules of various games, sports events, or other events; or the repair of sports facilities, he or she shall post the reasons, restriction period, etc. on the places readily visible to residents in advance.
  • Article 4 (Restriction on Use of Sports Facilities)(1) The Mayor may restrict the use of the sports facilities in any of the following cases: (Amended by Ordinance No. 2749, Dec. 29, 2010)

    • 2. In case of violating the purposes of the sports facilities;
    • 3. In case of obstructing the management of the sports facilities;
    • 4. In other cases it is difficult for other persons to use the sports facilities.
  • Article 5 (Assignment of Sports-for-All Instructors)
  • The Mayor may assign sports-for-all instructors under Article 10 of the Enforcement Decree of the National Sports Promotion Act to provide guidance to users of the sports facilities with regard to rules of games and overall sports activities. (Amended by Ordinance No. 4872, May 22, 2013)

CHAPTER II SPECIALIZED ATHLETIC FACILITIES

  • Article 6 (Permission for Exclusive Use)(1) Any person who intends to use a specialized sports facility exclusively (hereinafter referred to as "exclusive use") shall file an application for permission for exclusive use by not later than ten days before the scheduled date of use and shall obtain permission for exclusive use from the Mayor. The same procedure shall also apply where a person intends to have such permission amended: Provided, That if the Mayor deems necessary for efficient utilization of facilities, he or she may issue a permit for an application filed for permission for exclusive use by the day immediately before the scheduled date of use.   • (2) If a person who has obtained a permit for exclusive use under paragraph (1) (hereinafter referred to as the "exclusive user") intends to install structures, etc., he or she shall obtain approval from the Mayor, and at the end of the period of use, he or she shall remove the structures, etc. and restore the relevant facilities to their original state.
  • (3) An exclusive user shall not sublease the permitted specialized facilities without the Mayor's recognition.
  • Article 6-2 (Permission for Use of Moorings)(1) The Mayor may permit any of the following persons to use a mooring in a yachting center, among specialized sports facilities:
    • 1. The owner or co-owners of a vessel registered under the Ship Act or the Water-Related Leisure Activities Safety Act;
    • 2. The owner or co-owners of a foreign vessel and a person who intends to manage a foreign vessel.
  • (2) Article 6 (1) through (3) shall apply mutatis muntandis to permission for the use of moorings in a yachting center under paragraph (1).

  • Article 7 (Revocation of Permission for Exclusive Use) (1) In any of the following cases, the Mayor may revoke or suspend permission for the exclusive use of a specialized sports facility or for the use of a yachting center (hereinafter referred to as "permission for the exclusive use or use"). In such cases, Article 11 shall apply mutatis mutandis to the return of use fees: (Amended by Ordinance No. 5544, Mar. 22, 2017)
    • 1. Where a user uses such facility for any purpose other than the purpose specified in the permission for the exclusive use or use;
    • 2. Where a user breaches any condition attached to the permission for the exclusive use or use;
    • 3. Where a user fails to pay use fees;
    • 4. Where a user obstructs the management of the specialized sports facility.
  • (2) Deleted. (by Ordinance No. 5174, Jul. 15, 2015)
  • Article 8 (Order of Priority for Use)
  • If it is impossible for many persons to use any specialized sports facility simultaneously, the Mayor shall have them use the specialized sports facility according to the following order of priority: (Amended by Ordinance No. 4530, Jul. 7, 2010; Ordinance No. 5419, Sep. 21, 2016)
    • 1. Games, sports events, or other events held or organized by the State, a local government, or any of the organs under its jurisdiction;
    • 2. Games or sports events held or organized by the Korean Sports and Olympic Committee, the Korea Paralympics Committee, or any of their member organizations or affiliated organizations; (Amended by Ordinance No. 4530, Jul. 7, 2010; Ordinance No. 5419, Sep. 21, 2016)
    • 3. Sports activities that schools of all levels carry out for developing students' physical strength and promoting their sports activities;
    • . Sports activities or youth activities that youth organizations carry out for developing the youth's physical strength and upbringing the youth;
    • 5. Sports activities that persons belonging to institutions, organizations, and workplaces and persons with similar interests in physical exercise carry out for developing their physical strength and promoting sports development;
    • 6. Sports activities that users carry out practice or training for various games or sports events, or physical training;
    • 7. Other events such as cultural activities, public performances, exhibitions, and displays not falling under subparagraphs 1 through 6.
  • Article 9 (Fees) (1) The fees to be paid by a user of any specialized sports facility shall be as specified in attached Table 4.
  • (2) Where the use fees under paragraph (1) are to be paid, the user shall pay the full amount of the fees specified in subparagraphs 1 through 5 of attached Table 4 before the user begins to use a specialized sports facility and the estimated amount of the fees for the exclusive use of ancillary facilities and other facilities and equipment. specified in subparagraph 6 of attached Table 4 within five days of the date of permission for the exclusive use respectively and shall settle the amount of the fees within 15 days of the last date of use.   • (3) Any person who obtains permission for the use of a facility under the proviso of Article 6 (1) shall pay use fees and the estimated amount of fees for the exclusive use of ancillary facilities, and other facilities and equipment. and shall settle the amount of such fees within 15 days of the last date of use. (Newly Inserted by Ordinance No. 2749, Dec. 29, 2010; Ordinance No. 5419, Sep. 21, 2016)
  • Article 10 (Reduction of and Exemption from Use Fees)(1) The Mayor may fully or partially exempt a person from use fees in any of the following cases: Provided, That the Mayor may separately collect use fees for ancillary facilities specified in subparagraph 6 (1) of attached Table 4: (Amended by Ordinance No. 5174, Jul. 15, 2015)
    • 1. Games, sports events, or other events held or organized by the State, a local government;
    • 2. The Olympic Games, the Asian Games, and worldwide single games;
    • 3. Where players (including teams) registered with the Busan Sports Council and the Busan Sports Association for the Disabled undergo training according to the training programs of the Council and Association;
    • 4 and 5. Deleted. (by Ordinance No. 5174, Jul. 15, 2015)
  • (2) The Mayor may reduce use fees chargeable on any of the following persons by 50/100: Provided, That the same shall not apply if any of the following persons exclusively uses a specialized sports facility: (Amended by Ordinance No. 4530, Jul. 7, 2010; Ordinance No. 4872, May 22, 2013; Ordinance No. 5419, Sep. 21, 2016; Ordinance No. 5707, Feb. 7, 2018)
    • 1. A recipient of livelihood benefits and medical benefits under the National Basic Living Security Act;
    • 2. A person with disabilities, registered under the Act on Welfare of Persons with Disabilities (including one guardian in cases of persons with disabilities of Grade I through Grade III);
    • 3. A person entitled to the benefits under Article 15 of the Enforcement Decree of the Act on the Honorable Treatment of Persons of Distinguished Service to Independence:
    • 4. A person falling under any subparagraph of Article 86 (1) of the Enforcement Decree of the Act on the Honorable Treatment of and Support for Persons of Distinguished Service to the State;
    • 5. A person falling under any subparagraph of Article 52 (1) of the Enforcement Decree of the Act on the Honorable Treatment of Persons of Distinguished Service to the May 18 Democratization Movement;
    • 6. A person entitled to the benefits under Article 58 of the Enforcement Decree of the Act on Honorable Treatment of Persons of Distinguished Service during Special Missions and Establishment of Related Organizations;
    • 7. A person entitled to the benefits under the Act on Honorable Treatment of War Veterans and Establishment of Related Associations;
    • 8. A patient suffering from actual aftereffects of defoliants, a patient suffering from potential aftereffects of defoliants, or a second-generation patient suffering from actual aftereffects of defoliants, entitled to the benefits under the Act on Assistance to Patients Suffering from Actual or Potential Aftereffects of Defoliants and Establishment of Related Organizations;
    • 9. A member of a multiple-children family entitled to the benefits under the Busan Metropolitan City Ordinance on Measures to Boost Low Birth Rate and Support to Encourage Child Birth;
    • 10. A person falling under any subparagraph of Article 17-2 (1) of the Enforcement Decree of the Act on Honorable Treatment of and Support for Persons Who Died or Were Injured for Public Good;
  • (3) In any of the following cases, the Mayor may reduce use fees by 30/100: (Amended by Ordinance No. 5174, Jul. 15, 2015; Ordinance No. 5419, Sep. 21, 2016)
    • 1. An event organized by the Busan Sports Council or the Busan Sports Association for the Disabled (including any member organization or affiliated organization of the relevant organization);
    • 2. An event for people aged 65 years or over;
    • 3. An sports game or event for enhancing national prestige or for implementing measures for promoting sports;
    • 4. An event for spreading and developing a folk festival or a native folk custom;
    • 5. Other sports game or event that the Mayor deems expecially meaningful.
  • (4) When a family of three or more persons, including a child or youth, uses a swimming pool or an indoor ice ink, among sports facilities, the Mayor may reduce use fees chargeable on such family by 20/100. (Newly Inserted by Ordinance No. 2749, Dec. 29, 2010)
  • (5) Use fees may be reduced by 10/100 for a semi-monthly member, a monthly member or a quarterly member, among women aged not younger than 13 years but not older than 55 years, who use a swimming pool, among specialized sports facilities. (Amended by Ordinance No. 2749, Dec. 29, 2010)
  • (6) If a person is eligible for reduction under two or more paragraphs of paragraphs (1) through (5), the highest reduction rate among the rates prescribed in the relevant paragraphs shall apply to use fees. (Amended by Ordinance No. 2749, Dec. 29, 2010)
  • Article 11 (Return of Use Fees)
  • In any of the following cases, the Mayor shall return use fees fully or partially according to the guideline for the return of fees in attached Table 5: (Amended by Ordinance No. 5544, Mar. 22, 2017)
    • 1. Where a user demands a return before the time of use after purchasing the ticket for one time (including the case of purchasing the admission fees under Article 14 (1);
    • 2. Where an exclusive user, a user of a mooring in a yachting center, or a person who has purchased half-monthly membership, monthly membership, or quarterly membership falls under any of the following subparagraphs:
      • a. Where it becomes difficult to use the relevant specialized sports facility due to an event of Busan Metropolitan City or managerial or operational circumstance of the relevant specialized sports facility;
      • b. Where a user demands a return before the beginning date of use due to his or her circumstance;
      • c. Where a user demands a return after the beginning date of use due to his or her circumstance;
      • d. Where it is impossible to use specialized sports facilities due to force majeure or any other equivalent cause.
  • Article 12 (Fees following Issuing Admission Tickets)(1) An exclusive user may issue admission tickets with an amount stated thereon (including advance tickets; hereafter the same shall apply in this Article). In such cases, the number of issued free admission tickets, including invitation cards and invitation tickets, shall not exceed 30/100 of the total number of admission tickets for the full capacity of the relevant facility, and use fees for the free admission tickets exceeding such ratio shall be settled and collected by applying the same amount for paid admission tickets to such free admission tickets.   • (2) In case an exclusive user issues the admission tickets under paragraph (1), the Mayor shall collect 10/100 of the amount as a fee other than that for the exclusive use in subparagraphs 5 and 6 of attached Table 4. In such cases, if such fee is less than an entrance fee to be collected under Article 14 (2), he or she shall collect a corresponding amount to the entrance fee under Article 14 (2).
  • (3) Notwithstanding Article 9 (2), the fees under paragraph (2) shall be collected at the same time when issuing admission tickets and shall be settled within 15 days of the last date of use. (Amended by Ordinance No. 5419, Sep. 21, 2016)
  • (4) The Mayor may, if it is deemed necessary for vitalizing the use of specialized sports facilities, reduce the fees that shall be collected under the former part of paragraph (2) within the limit of the amount corresponding to the fees under Article 14 (2).
  • Article 13 (Selling and Purchasing of Admission Tickets)(1) An exclusive user who issues the admission tickets under Article 12 (1) shall manage selling and purchasing of admission tickets.
  • (2) Admission tickets shall be issued at the ticket office of the stadium concerned: Provided, That advanced tickets may be issued by an office other than the ticket office.
  • Article 14 (Entrance Fees)
  • (1) A person intends to enter a specialized sports facility for touring or for spectating a game or sport event for which no admission ticket is issued, shall pay an entrance fee: Provided, That a person falling under any of the following subparagraphs shall be excluded:
    • 1. A person who participates in a sports event or any other event held or organized by the State or a local government;
    • 2. A person related to a game, sports event or any other event, participating player, participant, journalist for covering a story,
    • 3. A person who falls under Article 2 (5) (a) or (e);
    • 4. A person who carries an entrance certificate issued by the Mayor.
  • (2) The entrance fees under paragraph (1) shall be as follows:
    • 1. A person who falls under Article 2 (5) (b) or (c): 100 won (in cases of the use by a group over 30 persons, 50 won per person)
    • 2. A person who falls under Article 2 (5) (d): 200 won (in cases of the use by a group over 30 persons, 100 per person)

CHAPTER III LIFE ATHLETIC FACILITIES

  • Article 15 (Use Fees)
  • The fees that a person shall pay for the use of a life sports facility shall be as prescribed in attached Table 6.
  • Article 16 (Reduction and Return of Use Fees)
  • Article 10 (2), (4), (5) and (6) and Article 11 shall apply mutatis mutandis to the reduction and exemption, and return of use fees for life sports facilities: Provided, That such fees may be collected in cases falling under subparagraphs 3 and 4 of attached Table 6. CHAPTER IV ATHLETIC FACILITIES FOR PERSONS WITH DISABILITIES

  • Article 17 (Fees)
  • The fees that a person who uses sports facilities for persons with disabilities shall be as specified in attached Table 7.
  • Article 18 (Reduction and Exemption, and Return of Fees)
  • (1) Article 10 (2), (4), (5) and (6) and Article 11 shall apply mutatis mutandis to the reduction, exemption, and return of use fees for the sports facilities specified in subparagraph 1 of attached Table 7 and for the programs specified in subparagraph 2 of the same Table, among sports facilities for persons with disabilities. (Amended by Ordinance No. 2749, Dec. 29, 2010; Ordinance No. 5419, Sep. 21, 2016) 1 through 3. Deleted. (by Ordinance No. 5419, Sep. 21, 2016)
  • (2) The fees for the use of a gymnasium specified in subparagraph 3 of attached Table 7, among sports facilities for persons with disabilities, may be exempted in any of the following cases:
    • 1. Where the Korea Disabled Veterans Organization or any corporation established to promote welfare of persons with disabilities under the Social Welfare Services Act holds or organizes an event that meets the purpose of its establishment;
    • 2. Where the State or a local government uses the facility to hold an event;
    • 3. Where a player (including teams) recognized by the Busan Sports Association for the Disabled undergoes training to participate in a national or international sport competition.

CHAPTER V ENTRUSTMENT OF MANAGEMENT AND OPERATION

  • Article 19 (Entrusted Operation)
  • (1) Pursuant to Article 9 of the Act, the Mayor may entrust the management and operation of specialized sports facilities to a public corporation or public agency established by Busan Metropolitan City under the Local Public Enterprises Act or a sports-related nonprofit corporation or organization or a professional sport organization or corporation.
  • (2) Pursuant to Article 9 of the Act, the Mayor may entrust the management and operation of life sports facilities to a public corporation or public agency established by Busan Metropolitan City under the Local Public Enterprises Act or a sports-related nonprofit corporation or organization (including member organizations of the Busan Sports Council; the same shall apply hereinafter). (Amended by Ordinance No. 4530, Jul. 7, 2010; Ordinance No. 5419, Sep. 21, 2016)
  • (3) Pursuant to Article 9 of the Act, the Mayor may entrust the management and operation of sports facilities for persons with disabilities to a social welfare corporation established under the Social Welfare Services Act, a public corporation or public agency established by Busan Metropolitan City under the Local Public Enterprises Act or a sports-related nonprofit corporation or organization.
  • (4) When the Mayor intends to entrust a person with the management and operation of a sports facility under paragraphs (1) through (3), he or she shall conclude an entrustment agreement with such entrusted person (hereinafter referred to as "trustee"), and the period of entrusted operation shall not exceed five years.
  • (5) Where the management and operation of a sports facility is entrusted to a person, expenses incurred in relation to the facility shall be covered by use fees, entrance fees and other revenue under Articles 9, 12, 14, 15 and 17.
  • Article 20 (Trustee's Obligations) (1) A trustee shall exercise due care as a good fiduciary in managing and operating a sports facility.
  • (3) Except as otherwise prescribed in this Ordinance, a trustee shall establish its own operating regulations on matters necessary for the management and operation of a sports facility, with the Mayor's approval.
  • Article 21 (Guidance and Supervision)
  • (1) Where the Mayor entrusts a person with the management and operation of a sports facility under Article 19, he or she may require the trustee to report to him or her on the entrusted administrative services or may authorize related public officials to investigate or inspect the status of the management and operation of the facility, documents, etc.
  • (2) If the Mayor finds any matter to be corrected according to a report received or as a result of an investigation or inspection conducted under paragraph (1), he or she shall order the trustee to take corrective measures or shall take other necessary measures.
  • Article 22 (Termination of Entrustment Agreement)
  • The Mayor may terminate an entrustment agreement in any of the following cases:
    • 1. Where the trustee violates any relevant statute, regulation or this Ordinance;
    • 2. Where the trustee breaches the entrustment agreement;
    • 3. Where it is impracticable to operate a sports facility in a normal condition due to a cause for which the trustee is liable.
  • Article 23 (Hearings)
  • When the Mayor intends to terminate an entrustment agreement, he or she shall hold a hearing pursuant to Article 22.

CHAPTER VI SUPPLEMENTARY PROVISIONS

  • Article 24 (Delegation of Authority) (1) The Mayor shall delegate his or her authority for the following administrative services to the head of the Busan Metropolitan City Sports Facilities Management Office: (Amended by Ordinance No. 5544, Mar. 22, 2017)
    • 1. Opening of facilities to local residents under Article 3;
    • 2. Restriction on the use of facilities under Article 4;
    • 3. Assignment of sports-for-all instructors under Article 5;
    • 4. Permission for exclusive use under Article 6;
    • 5. Permission for the use of moorings under Article 6-2;
    • 6. Revocation, etc. of permission for exclusive use, etc. under Article 7;
    • 7. Order of priority in use under Article 8;
    • 8. Collection of use fees under Article 9;
    • 9. Reduction of or exemption from use fees under Article 10;
    • 10. Return of use fees under Article 11;
    • 11. Collection of use fees according to the issuance of admission tickets under Article 12;
    • 12. Collection of entrance fees under Article 14;
    • 13. Other matters necessary for the maintenance and management of structures in specialized sports facilities.
  • (2) The Mayor may delegate his or her authority for the administrative services specified in paragraph (1) concerning a Busan indoor ice link to the head of the Gu having jurisdiction over the relevant Busan indoor ice link.
  • ADDENDA
  • (1) (Enforcement Date) This Ordinance shall enter into force on the date of its promulgation.
  • (2) (Repealed Ordinance) The Busan Metropolitan City Ordinance on the Gudeok Stadium (Ordinance No. 133) shall be repealed simultaneously when this Ordinance enters into force.
  • (3) (Transitional Measure) The use permits issued before this Ordinance enters into force shall be deemed the permission granted under this Ordinance if the fees for such use permits have been already paid.
  • ADDENDUM (Ordinance No. 2143, Apr. 7, 1986)
  • This Ordinance shall enter into force on the date of its promulgation.
  • ADDENDUM (Ordinance No. 2275, Oct. 6, 1987)
  • This Ordinance shall enter into force on the date of its promulgation.
  • ADDENDUM (Ordinance No. 2546, Mar. 15, 1989)
  • This Ordinance shall enter into force on the date of its promulgation.
  • ADDENDA (Ordinance No. 2749, Dec. 17, 1990)
  • (1) (Enforcement Date) This Ordinance shall enter into force on the date of its promulgation.
  • (2) (Repealed Ordinances) The Busan Metropolitan City Ordinance on the Operation and Management of the Yachting Center (Ordinance No. 2228) and the Busan Metropolitan City Ordinance on the Establishment and Operation of the Shooting Range Complex (Ordinance No. 1090) shall be repealed simultaneously when this Ordinance enters into force.
  • (3) (Transitional Measure) The use permits issued before this Ordinance enters into force shall be deemed the permission granted under this Ordinance if the fees for such use permits have been already paid.
  • ADDENDA (Ordinance No. 3403, Sep. 24, 1997)
  • (1) (Enforcement Date) This Ordinance shall enter into force on the date of its promulgation.
  • (2) (Transitional Measure) The previous Ordinance shall apply to the persons who obtained permission to use a facility before this Ordinance enters into force.
  • ADDENDUM (Ordinance No. 3563, Sep. 16, 1999)
  • This Ordinance shall enter into force on the date of its promulgation.
  • ADDENDUM (Ordinance No. 3623, May 4, 2000)
  • This Ordinance shall enter into force on the date of its promulgation.
  • ADDENDA (Ordinance No. 3729, Nov. 1, 2001)
  • (1) (Enforcement Date) This Ordinance shall enter into force on the date of its promulgation.
  • (2) (Transitional Measure) The permission granted for the use of a facility under the previous provisions before this Ordinance enters into force shall be deemed to have been granted under this Ordinance, but the previous provisions shall apply to use fees for such permission.
  • ADDENDUM (Ordinance No. 3791, Jul. 11, 2002)
  • This Ordinance shall enter into force one month after the date of its promulgation.
  • ADDENDA (Ordinance No. 3856, Jul. 18, 2003)
  • (1) (Enforcement Date) This Ordinance shall enter into force one month after the date of its promulgation.
