Busan Metropolitan City Ordinance on the Organization and Operation of the 119 Citizen Water Rescue Squad

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to ensure water safety in the summer season by prescribing matters necessary for the organization and operation of the Busan Metropolitan City 119 Citizen Water Rescue Squad which consists of civil volunteers under Article 3 of the Rule on Rescue and Relief Squad.
  • Article 2 (Operation Plan)
  • The chief of Busan fire department (hereinafter referred to as the “chief”) shall establish the comprehensive operating plan of the Busan 119 Citizen Rescue Squad (hereinafter referred to as the “water rescue squad”) including recruitment, selection, and working method, etc. of the Busan 119 Citizen Rescue worker (hereinafter referred to as the “water rescue worker”) no later than at the end of May each year and notify the fire chief and the agency concerned of it. Thereafter, the fire chief shall establish the detailed operating plan under the organization and operation of water rescue squad not later than the end of June.
  • Article 3 (Organization of the Water Rescue Squad) (1) The chief of the Busan fire department shall properly assign persons who are recruited and selected according to the comprehensive operating plan under Article 2, determined by the fire station having jurisdiction over the place for water activity designated by the head of a Gu/Gun (hereinafter referred to as the “place for water activity”) among the coastal area (including the beach) under Article 2 of the Coast Management Act and sea level or inland waters under Article 6 or 7 of the Water- Related Leisure Activities Safety Act. In this case, the assigned place shall be consulted with the head of a Gu/Gun having jurisdiction over the place for water activity.
  • (2) The fire chief, who receives the assigned water rescue worker under paragraph 1, shall organize a water rescue squad including a general rescue squad under Article 9 (1) 1 of the Enforcement Decree of the Framework Act on Fire Services according to the detailed operating plan under Article 2, and shall make them work by allotting them to the place for water activity.
  • Article 4 (Standards of Qualification of the Water Rescue Worker) (1) The assigned water rescue workers under Article 3 shall be divided into groups by assignments. The first group shall have the main duty to rescue a person who is drowning and the other group shall be in charge of the safety around the water. The standards for qualification to be a water rescuer shall be as follows:
    • 1. The water rescue worker shall be:
      • a. A person who acquires the qualification of a rescue worker under Article 37 (1) of the WaterRelated Leisure Activities Safety Act;
      • b. A person who has been in charge of a business related to water rescue for at least one year;
      • c. A person who completes courses related to a water rescue and first aid at a University; and
      • d. Other person who are capable of water rescue.
    • 2. The water safety worker shall be:
      • a. A civic group member;
      • b. A university student;
      • c. A volunteer firefighter; and
      • d. A resident who is healthy and possesses a willingness to volunteer.
  • Article 5 (Equipments of the Water Rescue Squad)
  • The chief of the Busan fire department shall be required to have the following water rescue equipment:
    • 1. Water rescue equipments including a rescue ship, a lifeboat, and life tube
    • 2. First aid and first aid kits
    • 3. Patrol equipment; and
    • 4. Other protection equipment for water rescue activities.
  • Article 6 (Operation Period of the Water Rescue Squad) (1) The operation period of the water rescue squad shall be as follows: Provided, that the operation period may be adjustable considering the condition of the place for water activity.
    • 1. Beaches: open season (year round)
    • 2. Other places of water activity: from July 1 to August 31.
  • Article 7 (Business Hours of the Water Rescue Squad)
  • The business hours of the water rescue squad shall be the business hours of the place of the water activity: Provided, that the business hours may be adjustable considering the condition of the place for water play.
  • Article 8 (Duties of the Water Rescue Squad)
  • The water rescue squad shall conduct the following duties:
    • 1. Serving as a lifeguard on or in water;
    • 2. Providing first aid to emergency patients and provide protection for a lost child;
    • 3. Enforcing and practicing safety measures and patrol for the prevent water accidents; a
    • 4. Other matters concerning water safety.
  • Article 9 (Attire, etc. of the Water Rescue Squad)
  • The chief of the Busan fire department may provide attire and equipment necessary for lifeguard and first aid.
  • Article 10 (Guidance and Supervision)
  • The chief of the Busan fire department or the fire chief shall guide and supervise the performances and working standards of the water rescue worker.
  • Article 11 (Suspension of Duty for a Water Rescue Squad)
  • The chief of the Busan fire department or the fire chief may suspend a Water rescue squad for any of the following reasons:
    • 1. Where the reputation of the water rescue squad is damaged by their activities;
    • 2. Where the duty to follow directions is breached;
    • 3. Where it is deemed to be improper for the duty of the water rescue worker
  • Article 12 (Education and Training of the Water Rescue Worker)
  • The chief of the Busan fire department may provide the water rescue worker with education and training necessary for the execution of duty including lifeguard and first aid before assigning him/her under Article 3 (2).
  • Article 13 (Protection of the Water Rescue Worker) (1) The chief of the Busan fire department or the fire chief shall take necessary measures for ensuring a safe environment for the water rescue worker’s activities.
  • (2) Insurance shall be purchased to protect the water rescue worker under paragraph (1), and the kind and content of the insurance shall be determined by the chief of the Busan fire department.
  • (3) In a case where the water rescue worker who has been wounded, impaired, or killed while doing safety activities in water activities, the Rescue and Aid at Sea and in the River Act shall apply mutatis mutandis.
  • Article 14 (Cooperation etc. with Related Agencies)
  • The chief of the Busan fire department or the fire chief may request cooperation with the head of a Gu/Gun having jurisdiction over the place for water activities and related agencies concerning the necessary matters for the operation of the water rescue squad.
  • Article 15 (Payment of Transportation Expenses, etc.)
  • The Mayor may pay the water rescue worker actual expenses including transportation expenses and food expenses which are necessary for activities within the limit of the budget.
  • Article 16 (Reward)
  • The Mayor may grant any reward to the water rescue worker who is exceptionally credited with safety activities in water activities under the Busan Metropolitan City Ordinance.
