BUSAN METROPOLITAN CITY ORDINANCE ON THE ESTABLISHMENT AND SUPPORTING MANAGEMENT OF BUSAN ENGLISH BROADCASTING FOUNDATION

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to prescribe matters necessary for the establishment and support of management of the Busan English Broadcasting Foundation, an incorporated foundation under Article 32 of the Civil Act, for efficient radio broadcasting in English of which the main broadcasting area is Busan Metropolitan City.
  • Article 2 (Scope of Application)
  • Matters relevant to the establishment and management of the Busan English Broadcasting Foundation (hereinafter referred to as the "Foundation"), other than those prescribed in this Ordinance, shall be governed by the Civil Law.
  • Article 3 (Business)
  • The Foundation shall conduct the following business activities:
    • 1. Providing information and knowledge through English radio broadcasting;
    • 2. Planning, organization, production, and operation of broadcasting programs;
    • 3. Organization and adjustment of broadcasting advertisement;
    • 4. Other businesses activities prescribed by the articles of incorporation which are necessary to achieve the purpose of the Foundation .
  • Article 4 (Officers)
  • Necessary matters regarding the officers and operation of the Foundation shall be determined by the articles of incorporation.
  • Article 5 (Contributions)
  • The Busan Metropolitan City Mayor (hereinafter referred to as the “Mayor”) may grant contributions to the Foundation or support part of expenses within the budget pursuant to the Local Finance Act to cover expenses necessary for the establishment and management of the Foundation.
  • Article 6 (Entrustment of Affairs)
  • The Mayor may entrust affairs regarding various businesses activities and policies pursued for public relations of municipal policies or for creation of comfortable living environment for foreign residents.
  • Article 7 (Submission of Business Plan) (1) The Foundation shall submit a business plan and a budget for each business year to the Mayor before each business year commences. ‹Amended by Ordinance No. 4918, Jul. 31, 2013›
  • (2) The Foundation shall submit a report on the statement of accounts by attaching business performance and auditor’s report completed by a certified public accountant every business year to the Mayor within three months after the end of each business year. ‹Amended by Ordinance No. 4918, Jul. 31; Ordinance No. 5103, Feb. 25, 2015›
  • Article 8 (Reporting and Inspection) (1) The Mayor may request the Foundation to submit materials regarding the performance of business of the Foundation or require officials under his or her jurisdiction to inspect the business, accounts, and assets of the Foundation.
  • (2) The Mayor may order the Foundation to make corrections or take other necessary measures where illegal or unjust matters are found in the inspections under paragraph (1).
  • Article 9 (Dispatch of Officials)
  • In accordance with Article 30-4 of the Local Public Officials Act, the Mayor may dispatch an official under his or her jurisdiction to the Foundation to support its conducting of business.
  • Article 10 (Cooperation for English Radio Broadcasting Services)
  • The Mayor may render English radio broadcasting services at any of the following places or request cooperation in performing duties from a manager thereof.
    • 1. Office buildings of a public entity (referring to a public entity under subparagraph 3 of Article 2 of the Official Information Disclosure Act) which is located in Busan Metropolitan City;
    • 2. A place where unspecified foreigners visit in large numbers including parks or popular tourist attractions;
    • 3. A place where a large number of foreigners are dwelling and English radio broadcasting services are available;
    • 4. Other places where English radio broadcasting services are deemed necessary.
