Busan Metropolitan City Ordinance on Promotion and Support of Water Reuse

- Article 1 (Purpose)
- The purpose of this ordinance is to encourage the reuse of water in Busan Metropolitan City by stipulating the matters mandated by the Act on Promotion and Support of Water Reuse and the enforcement decree of the same law and the matters necessary for its implementation.
- Article 2 (Definition)

For the purpose of this Ordinance, the following terms shall have the meanings as below:
- 1. The term “sewage-treated water reuse facility” refers to facilities that treat treated water so that it can be reused, its affiliated facilities, and supply pipes;
- 2. The term “reprocessing water from sewage treatment” refers to water that has been treated so that wastewater can be reused using wastewater reuse facilities.

Article 3 (Establishment of management plan)
- ① The Mayor of Busan Metropolitan City (hereinafter referred to as the "Mayor") shall formulate and implement a plan for encouraging water reuse in Busan Metropolitan City pursuant to Article 6 of the Act on Promotion and Support of Water Recycling (hereinafter referred to as the "Act").

② Matters to be included in the water reuse management plans are as
follows:- 1. Water supply and demand status and water use forecast in the area;
- 2. Status of installation and operation of water reuse facilities;
- 3. Implementable target quantity and distribution plan for each purpose related to water reuse;
- 4. Effects and countermeasures for water reuse on river retention flow and river water use in downstream rivers;
- 5. Forecast of demand for water reuse;
- 6. Matters concerning step-by-step measures to encourage water reuse;
- 7. Matters concerning the calculation of costs and financing plans for water reuse projects;
- 8. Matters concerning the promotion of water reuse;
- 9. Other matters deemed necessary to encourage water reuse.
- ③ The mayor shall review the feasibility of the water reuse management plan every five years from the date on which the water reuse management plan is established in accordance with section 6 ⑤ of the Act and make changes if necessary.
- Article 4 (Standard for Installation of Rainwater Utilization Facilities)
- ① The Mayor may encourage a person who intends to build a new facility (including cases of expansion, renovation, or reconstruction) other than the facility subject to installation of rainwater utilization facilities under Article 8 of the Act to install rainwater utilization facilities.
- ② The facility standards and management standards for rainwater use facilities established pursuant to paragraph ① shall comply with Article 4 of the Enforcement Regulations of the Act on Promotion and Support of Water Reuse (hereinafter referred to as the "Rules").
- Article 5 (Standards for installation of gray water, etc.) ① The Mayor may encourage a person who intends to build a new building (including cases of expansion, renovation, or reconstruction) other than those subject to the installation of gray water under Article 9 of the Act to install gray water.
- ② The facility standards and management standards of gray water installed pursuant to paragraph ① shall be governed by Article 7 of the Rules.
- Article 6 (Application for supply and use of reprocessing water from sewage treatment)
- ① The Mayor may reuse reprocessing water from sewage treatment pursuant to Article 10 of the Act or supply it to a person in need. However, if sewage treatment water meets the water quality standards for each use under Article 14 of the Act, it may be reused or supplied immediately.
- ② A person who reuses or requires the reuse of sewage treated water or reprocessing water from sewage treatment pursuant to paragraph ① shall submit to the mayor an application for the use (modification) of sewage treated water and sewage treated water in attached Form 1.
- ③ A person who intends to receive sewage treatment water or reprocessing water from sewage treatment shall install and manage all expenses necessary for supply pipeline facilities, etc. at his/her own expense. However, the mayor installs and manages the meter for measuring supply.
- Article 7 (Fees for reprocessing water from sewage treatment)
- ① Fees for reprocessing water from sewage treatment shall be determined by the Mayor at the level of compensation for overall costs by conducting cost analysis for each sewage treatment plant supplying sewage reprocessed water pursuant to Article 21 of the Act.
- ② Notwithstanding paragraph ①, fees shall be exempted for public use.
- Article 8 (Reduction of Fees, etc.)
- ① The Mayor may reduce water fees (including water usage fees) or sewage fees for owners and managers of rainwater utilization facilities or facilities with gray water pipes in accordance with section 23 of the Act or this Ordinance, and for persons who receive sewage treatment water and reprocessing water from sewage treatment.
- ② The mayor may reduce the fee for the use of sewage if the gray water already installed and operating in addition to the gray water pursuant to paragraph ① meets the safety and water quality inspection standards of gray water in accordance with Article 9 ③ of the Act.
- ③ The mayor may reduce water fees (including water usage fees) if rainwater utilization facilities existing in installation and operation meet the management standards of rainwater utilization facilities under Article 8 ② of the Act.
- ④ The reduction of water fees or sewerage usage fees pursuant to paragraphs 1 to 3 shall be in accordance with the "Busan Metropolitan City Water Supply Ordinance" or the "Busan Metropolitan City Sewerage Use Ordinance".
- Article 9 (Financial Support)
- ① The Mayor may partially subsidize expenses incurred in installing rainwater utilization facilities and gray waterways within the scope of the budget to the person who installs rainwater use facilities and gray water pursuant to Articles 4 and 5.
- ② A person who intends to receive financial support pursuant to paragraph 1 shall apply in accordance with the application for support for the cost of installing rainwater use facilities in attached Form 2 and the application for support for the installation of gray water in attached Form 3.
- ③ The subsidy pursuant to paragraph (1) shall be provided only once, up to a maximum of up to KRW 10 million.
- ④ Methods and procedures for supporting expenses pursuant to paragraph 1 shall be in accordance with the "Busan Metropolitan City Local Subsidy Management Ordinance".

Article 10 (Recording and keeping journals)
The Mayor shall record and keep a log of the date of supply, amount of supply, amount of demand, place of demand, etc. of sewage treatment water or reprocessing water from sewage treatment.

Article 11 (Entrustment of Business)
The Mayor may entrust affairs related to sewage treatment water and reprocessing water from sewage treatment under this Ordinance to a corporation, industrial complex, or related specialized agency established by Busan Metropolitan City in accordance with the Local Public Enterprise Act.
Addendum

Article 1 (Effective Date)
This ordinance shall take effect on the date of its promulgation.
- Article 2 (revision of Other Ordinances)

① The Busan Metropolitan Government Ordinance on Water Supply shall be partially revised as follows:
Articles 8 and 9 of the Water Recycling Promotion and Support Act in Article 37 ① 2 shall be "Article 8 through Article 10 of the Water Recycling Promotion and Support Act", and Article 5 of the Busan Metropolitan Government Ordinance on the Installation and Management of Rainwater Utilization Facilities shall be "Article 4 and 5 of the Busan Metropolitan Government Ordinance on Water Recycling Promotion and Support". -
② The Busan Metropolitan Government Ordinance on the Use of Sewage shall be partially revised as follows:
The term "recycled water for public sewage treatment facilities" in Article 22 - ② 2 shall be "sewage treatment water and sewage treatment water under the Busan Metropolitan Government Ordinance on Promotion and Support of Recycling of Water".
