Busan Metropolitan City Ordinance on the Collection of Fees for the Folklore Museum Use
- Article 1 (Purpose)
- The purpose of this Ordinance is to prescribe the matters concerning the collection of fees for the Busan City Folklore Museum (hereinafter referred to as the “folklore museum”) use.
- Article 2 (Permission of Use)
- A person who intends to use the folklore museum shall submit an application for permission of use to the Mayor by five days before the expected date of use.
- Article 3 (Non-Permission of Use)
- The permission of use shall not be given in a case falling
under any of the following subparagraphs:
- 1. In case where it is feared to be detrimental to public order and good morals;
- 2. In case where it is feared to destroy buildings and appurtenant facilities;
- 3. In case where there exists obstacle to the management of facilities and equipments;
- 4. In case where the fee is not paid in accordance with provisions; or
- 5. In other cases where the Mayor deems it improper.
- Article 4 (Change of Permission of Use)
- The permission of use may be revoked or the use
may be restricted or suspended in a case falling under any of the following subparagraphs:
- 1. In case of violating this Ordinance or regulations or directions pursuant to this Ordinance;
- 2. In case where it is impossible to use the folklore museum due to disasters and other inevitable reasons;
- 3. In case of default in fee payment; or
- 4. In case where the Mayor deems it especially necessary to change.
- Article 5 (Fees)(1) In case where a user collects admission fees (hereinafter referred to as the “entrance fees”) from spectators, 30/100 of the revenue from which entrance tax is deducted shall be the revenue of the City.
- (2) In case where a user does not collect the entrance fees from spectators, he/she shall pay the fees under attached Table 2 to the City in advance.
- (3) In case where a user intends to collect the entrance fees from spectators, he/she shall pay the fees of the previous paragraph to the City if the calculated amount of fees under paragraph (1) falls short of the fees prescribed in the previous paragraph.
- Article 6 (Reduction or Exemption of Fees)
- The fees may be reduced or exempted when the Mayor admits that there exits special reason based on public use or folklore promotion.
- Article 7 (Return of Fees)
- The fees which are paid under Article 5 shall not be returned.
- Article 8 (Ticketing)
- The City shall be fully in charge of entrance tickets and ticketing.
- Article 9 (Management)(1) When a user intends to install special equipments, he/she shall obtain the permission from the Mayor in advance.
- (2) The Mayor may, if it is deemed necessary for management, make a user install necessary equipments at the cost of himself/herself.
- (3) A user shall remove the equipments under the previous paragraph at the same time when the use period is expired. When he/she did not remove them, the Mayor shall carry out the vicarious execution and collect the expenses from a user.
- Article 10 (User’s Care)
- A user shall use the facilities or the equipments with the care of good user during the use period.
- Article 11 (Compensation for Damage)
- A user shall compensate for such damage when he/she damaged the facilities or equipments by neglecting the duty under previous Article.
- Article 12 (Prohibition of Transfer and Sublease)
- A person who receives the permission of use under this Ordinance shall neither transfer nor sublease the right without the approval of the Mayor.
