Busan Metropolitan City Ordinance on the Nakdong Estuary Echo Center Article

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to prescribe the matters necessary to manage and operate the Nakdong Estuary Echo Center of the Busan Metropolitan City.
  • Article 2 (Opening and Closing of the Center) (1) The Nakdong Estuary Eco Center of Busan Metropolitan City (hereafter referred to as the “Eco Center”) shall be opened everyday except for those closing days according to the following subparagraphs:
    • 1. January 1;.
    • 2. Monday: Provided, that in case that Monday falls in with the national holiday, the next day shall be considered as a closing day; and
    • 3. The day on which the mayor of Busan Metropolitan City (hereafter referred to as the “Mayor”) confirms that it is necessary to close the Echo Center on account of reforming/repairing its facilities, etc.
  • (2) In case of confirming a closing day under paragraph (1) 3, the Mayor shall publish it in advance on the Internet homepage of Busan Metropolitan City, etc.
  • Article 3 (Observation and Ticket Selling Hours) (1) The opening hour of the Eco Center shall be from 9:00 a.m. to 6:00 p.m. , and the selling hour of admission tickets shall be from 9:00 a.m. to 5:00 p.m.
  • (2) In case that there is any special event such as an observation by national guests or diplomatic delegations, etc, or it is required to activate the operation of the Eco Center,, the Mayor may adjust the opening and ticket selling hours despite paragraph (1).
  • Article 4 (Admission Fees and Admission Ticket) (1) A person who wants to observe the Eco Center shall pay the admission fees under the attached Table 2.
  • (2) In case a person who paid the admission fees under paragraph (1) requests for refunds before the observatory tour, the Mayor shall return them.
  • (3) The admission tickets shall be classified into individual and group ticket sales, and the details related with the specification, certificate, etc, shall be separately determined by the Mayor.
  • Article 5 (Exemption of Admission Fees, etc) (1) A person who falls under any of the following subparagraphs may be exempted from the admission fees:
    • 1. National guests or diplomatic delegations and their attendants;
    • 2. Children less than 12 years old and the aged more than 65 years old;.
    • 3. Disabled citizens registered under Welfare of Disabled Persons Act and one guardian who accompanies;
    • 4. A person of distinguished services to the State, his/her bereaved family members or his/her family members under the Act on the Honorable Treatment and Support of Persons, etc. of Distinguished Services to the State;
    • 5. A person of distinguished service to the national independence, their bereaved family members or family members under the Act on the Honorable Treatment of Persons of Distinguished Services to Independence;
    • 6. A war veteran under the Act on the Honorable Treatment of War Veterans, etc;
    • 7. A person of distinguished services to the 5ㆍ18 democratization movement, their bereaved family members or family members under the Act on the Honorable Treatment of Persons of Distinguished Services to the 5ㆍ18 Democratization Movement;
    • 8. A person engaged in special military mission, their bereaved family members or family members under the Act on Assistance to the Persons engaged in Special Military Mission;
    • 9. A person entering the Eco Center for the purpose of academic studies and official duties;
    • 10. A person, as a Busan Metropolitan citizen, belonging to a family with at least three children who are born after 2000; or
    • 11. Otherwise, a person including soldiers entering the Eco Center on the Armed Forces Day who the Mayor permits as necessary.
  • (2) The Mayor sets free admission on special days including Citizen’s Day. In this case, the Mayor shall publish it in advance on the Internet homepage of Busan Metropolitan City.
  • Article 6 (Disallowance of Observation and Restriction of Activities) (1) A person who falls under any of the following subparagraphs shall not be allowed to observe the Eco Center:
    • 1. A person who possesses dangerous articles or articles emitting bad smells;
    • 2. A child less than 6 years old who accompanies no guardian; or
    • 3. Otherwise, those persons who the mayor determines not to permit into the Eco Center with a rationale of protecting exhibits, keeping up order, etc.
  • (2) Spectators shall not do the following activities inside the Eco Center:
    • 1. Activities of drinking, smoking or consuming food;
    • 2. Activities of touching the exhibits; and
    • 3. Activities of talking loudly or running, etc. and other activities that obstruct other spectators.
  • (3) The Mayor may order ban a person who commits activities falling under any of the subparagraphs in paragraph (2) from the Eco Center.
  • Article 7 (Uses of Facilities and the Equipment) (1) The Mayor may have facilities and equipment utilized for the purpose of the establishment of the Eco Center within the scope of keeping operations away from troubles.
  • (2) A person who wants to use the facilities of the Eco Center shall submit in advance to the Mayor the application forms containing the purpose, period and reason for utilization.
  • (3) Upon receiving the application for utilization according to Section 2, the Mayor shall determine whether to permit it or not and notify the result to the applicant.
  • (4) The Mayor may adjust, revise or condition a utilization period in case it is regarded as being necessary in determining the utilization of the facilities.
  • Article 8 (Payment and Exemption of Fees) (1) A person who uses the facilities and equipment shall pay fees under the attached Table 2.
  • (2) Fees shall be exempted in cases falling under any of the following subparagraphs:
    • 1. In case the state or the local government uses the facilities and equipment for holding events; or
    • 2. In case the Mayor recognizes that it may contribute to the operation and development of the Eco Center.
  • Article 9 (Operation of Program) (1) The Mayor may operate a program necessary for enhancing the citizens’ recognition regarding natural condition and for fostering related knowledge.
  • (2) The Mayor may collect costs for operating a program including tuition fees, material costs, etc from a person who participates in a program.
  • Article 10 (Souvenir Sales)
  • The Mayor shall devise the financial measures necessary for preserving the estuaries and foster the private organizations, and may subsidize the required expenses to such an extent as the relevant budget permits.
  • Article 11 (Education and Information Opening Relating to Preservation of Ecosystem) (1) The Mayor may sell souvenirs to commemorate to visitors and to widely promote the Eco Center.
  • (2) The Mayor shall publish the kinds of souvenirs and their prices on the Internet homepage of Busan Metropolitan City.
  • Article 11 (Indemnification Liabilities)
  • When spectators or persons utilizing the facilities damage the exhibits or facilities of the Eco Center, they shall compensate or restore the items. In this case, the indemnifying amount for the damaged exhibits or facilities shall correspond to the fair market value at the time of the discovery of the damages.
  • Article 12 (Volunteer Workers)
  • The Mayor may assign volunteer workers to the Eco Center for efficient operations, user’s convenience, and the maintenance of order. The Mayor may recruit and manage volunteers in order to guide visitors to the Eco Center or provide spectators with conveniences such as explaining about the exhibits, and pay them the actual expenses within the budget allowance.
  • Article 13 (Entrustment of Powers)
  • The Mayor shall entrust the head of Nakdong Estuary Eco Center of Busan Metropolitan City with the businesses related with the administration and operation of the Eco Center under this Ordinance.
