Busan Metropolitan City Ordinance on Support to Agriculture and Farming Villages

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to wisely handle the expansion of the international trade of agriculture and the foreign trade policy and to contribute to the promotion of agriculture and the development of farming villages areas by enhancing the competiveness of fishery and by providing for the matters necessary for the stabilization of the income and management of farmers.
  • Article 2 (Definition)
  • The definitions of terms used in this Ordinance are as follows:
    • 1. The term “agriculture” means the agriculture under item (a) of subparagraph 1 of Article 3 of the Framework Act on Agriculture and Fisheries, Rural Community, and Food Industry (hereinafter referred to as the “Act”)
    • 2. The term “farmers” means the farmers under item (a) of subparagraph 2 of Article 3 of the Act;
    • 3. The term “agricultural juristic person” means the agricultural association corporation under Article 16 of the Act on Fostering and Supporting Agricultural and Fisheries Enterprises among agricultural juristic person under subparagraph 2 of Article 2 of the same Act;
    • 4. The term “farmers, etc.” means the farmers and agricultural juristic person; and
    • 5. The term “farming villages” means the farming villages under subparagraph 5 of Article 3 of the Act and the quasi-farming villages under Article 33 of the Special Act on Improvement of Public Health and Welfare for Agricultural and Fishing Village Residents.
  • Article 3 (Duty) (1) The Busan Metropolitan City shall establish and implement the comprehensive measures necessary for support to agriculture and farming villages for the purpose of the stable growth and development of agriculture.
  • (2) Farmers, etc. shall endeavor to steadily produce and supply safe agricultural products whose quality is good as the main agent of development of agriculture and farming villages to contribute to the local community’s development through the improvement of productivity, the innovation of management, etc.
  • Article 4 (Fostering and Support to Agriculture and Farmers, etc.)
  • The Mayor of the Ulsan Metropolitan City (hereinafter referred to as the “Mayor”) may establish and implement the support measures of any project falling under the following subparagraphs to foster competitive agriculture and farmers, etc.:
    • 1. Projects promoting the production and consumption of environmentally friendly and high quality agriculture products;
    • 2. Projects for supplying good seeds of vegetables, fruits and flowers which have competitiveness in exports and raising seeding;
    • 3. Projects for improving distributions and logistics to promote the distribution and export of agricultural products;
    • 4. Projects for fostering foods industries and developing a promising brand;
    • 5. Projects for promoting mechanized agriculture such as agricultural machine rental businesses;
    • 6. Projects for research, development, and distribution to improve a new kind of agricultural products and their quality, etc;
    • 7. Projects for improving agricultural production infrastructures and utilizing agricultural production infrastructures and adjacent areas;
    • 8. Projects for fostering and supporting agriculture for urban consumers;
    • 9. Projects for educating and training to foster professional farmers and agricultural successor;
    • 10. Fostering processing technology of agricultural products for developing the income sources other than agriculture;
    • 11. Test projects necessary for the development, distribution, etc. of new technology to foster agriculture and farming villages and to develop agriculture; and
    • 12. Other necessary projects for fostering agriculture and farmers, etc. as matters including the development plan of agriculture, fisheries, fishing and farming villages, and foods.
  • Article 5 (Support for the Stabilization of Management to Farmers, etc.)
  • The Mayor may give support of part of expenses falling under the following subparagraphs within the limit of the budget for the stabilization of income and of farmers, etc:
    • 1. Expenses required for the purchase of materials to reduce the production cost of agriculture;
    • 2. Expenses required for increasing production, developing technology, etc. for the farmhouse which practices environmentally friendly agriculture; and
    • 3. Expenses required for environmentally friendly livestock businesses for creating sustainable livestock infrastructure.
  • Article 6 (Support to Farmers, etc. Damaged from Agricultural Disasters) (1) The Mayor may give support of part of expenses falling under the following subparagraphs to farmers, etc. owning or managing agricultural products, livestock, and facilities for the use of agriculture which are damaged from agricultural disasters within the limit of the budget:
    • 1. Expenses required for emergency measures, recovery, etc. according to agricultural disasters; and
    • 2. Insurance premiums which the policy holder of farmers safety cooperatives, agricultural disaster insurances, or livestock disaster insurances bear.
  • (2) Notwithstanding paragraph (1), this object of support shall be excluded in case of receiving compensation or support for damages from agricultural disasters under Acts and subordinate statutes or other Ordinances.
  • Article 7 (Support to Farmers’ Vocational Training) (1) The Mayor may give support to farmers who are not able to farm any more due to an urban planning project, etc. in order to enable him/her to get a professional vocational training for changing jobs.
  • (2) The Mayor may help farmers to find employment in the enterprise, etc. established in the area considering farmers’ technology, etc. under paragraph (1).
  • Article 8 (Fostering and Support, etc. of Venture Fishery) (1) The Mayor may foster and give support to venture agriculture to recommend and spread the development of new technology and new products for enhancing the added value of agriculture.
  • (2) The Mayor shall establish and implement the support measures concerning the support of funds, the education of technology management, etc. to continually foster future agricultural human resources, to promote the establishment of business, and to enable outstanding farmers to settle down at farming villages.
  • Article 9 (Application, etc. for Support) (1) If farmers, etc. intend to get support under Article 5 through 8, they shall fill out an support application and draw up a business plan and shall apply to the Mayor.
  • (2) The Mayor shall separately prescribe the matters concerning the object of support, application procedure, method, etc. under paragraph (1).
