Ordinance on the Operation of the Busan Marine Natural History Museum

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to prescribe the matters necessary to operate the Busan Marine Natural History Museum under Article 12 of the Museum and Art Gallery Support Act.
  • Article 1-2 (Location)
  • The facilities of Busan Marine Natural History Museum (hereinafter referred to as the “museum”) shall be classified into the main building and the fishing village folk building, and its location shall be as follows:

  • Article 2 (Opening and Closure) (1) The museum shall be opened every day except for closed days under paragraph (2) and the museum’s collections shall be open for the public to use.
  • (2) The closed days of the museum shall be as follows:
    • 1. January 1;
    • 2. Monday: Provided, That in case Monday falls in with the national holiday, the next day shall be considered as a closing day; and
    • 3. The day on which the Mayor of Busan Metropolitan City (hereafter referred to as the “Mayor”) confirms that it is necessary to close the museum on account of reforming/repairing its facilities, etc.
  • (3) In case of confirming a closing day under paragraph (2) 3, the Mayor shall publish it in advance on the Internet homepage of Busan Metropolitan City and museum.
  • Article 4 (Observation and Ticket Selling Hours) (1) The opening hour of the museum shall be from 9:00 a.m. to 6:00 p.m.
  • (2) The selling hour of admission tickets shall be from 9:00 a.m. to 5:00 p.m.
  • (3) In case there is any special event such as an observation by national guests or diplomatic delegations, etc., or it is required to activate the operation of the museum such as opening at night, etc., the Mayor may adjust the opening and ticket selling hours.
  • Article 5 (Admission Fees, etc) (1) The admission fees under Article 25 (2) of the Museum and Art Gallery Support Act shall be as specified in the attached Table 1.
  • (2) In case a person who paid the admission fees under paragraph (1) requests for refunds before the observatory tour, the Mayor shall return them.
  • (3) A person, who exhibits in special exhibition halls obtaining permission for the rental of the museum’s facilities under Article 19, may receive the fees from a spectator. In this case, the admission fees shall be determined consulting with the Mayor in advance.
  • Article 6 (Admission Tickets) (1) The admission tickets shall be classified into individual and group ticket sales.
  • (2) The forms of admission tickets, matters to be entered therein, and other matters concerning the approval certification of admission tickets, etc. shall be prescribed by the Rule of Busan Metropolitan City.
  • Article 7 (Exemption of Fees)
  • The Mayor may exempt the fees in any case falling under following subparagraphs:
    • 1. National guests and their attendants;
    • 2. Diplomatic delegations and their attendants;
    • 3. Children less than 12 years old and the aged more than 65 years old;
    • 4. Disabled citizens registered under the Welfare of Disabled Persons Act and one guardian who accompanies;
    • 5. A person of distinguished service to the national independence, their bereaved family members or family members under the Act on the Honorable Treatment of Persons of Distinguished Services to Independence;
    • 6. A person of distinguished services to the State, his/her bereaved family members or his/her family members under the Act on the Honorable Treatment and Support of Persons, etc. of Distinguished Services to the State;
    • 7. A war veteran under the Act on the Honorable Treatment of War Veterans, etc;
    • 8. A person of distinguished services to the 5ㆍ18 democratization movement, their bereaved family members or family members under the Act on the Honorable Treatment of Persons of Distinguished Services to the 5ㆍ18 Democratization Movement;
    • 9. A person engaged in special military mission, their bereaved family members or family members under the Act on Assistance to the Persons engaged in Special Military Mission; and
    • 10. A person entering the museum for the purpose of academic studies and official duties;
    • 11. A person belonging to a family with many children under the Busan Metropolitan City Ordinance of the Low Birth Rate Measure and Birth Encouragement Support; and
    • 12. Otherwise, a person including soldiers entering the museum on the Armed Forces Day who the Mayor permits as necessary.
  • Article 7-2 (Free Admission Day)
  • The Mayor sets free admission on special days including Citizen’s Day, Sea Day, etc.
    • (2) In case of setting free admission day, the Mayor shall publish it in advance on the Internet homepage of Busan Metropolitan City and museum.
  • Article 8 (Posting Fee Table)
  • The Mayor shall post a fee table for the public to see well.
  • Article 11 (Use of Multi-language Auto Guide Device, etc.) (1) A spectator may use a multilanguage auto guide device or take photograph pictures experiencing fisherman.
  • (2) A person, who intends to use a multi-language auto guide device or to photographs pictures experiencing fisherman, shall pay the fees specified in the attached Table 2.
  • Article 12 (Rental of Museum’s Collections)
  • The rental of the museum’s collections under Article 23 (1) of the Museum and Art Gallery Support Act shall be limited to academic research or any other equivalent case unless there exists any impediment to the operation of the museum and the preservation of the museum’s collections.
  • Article 13 (Institutions Subject to Rental)
  • The institutions, which may rent out the museum’s collections under Article 12, shall be the museums falling under any of the subparagraphs of Article 3 (1) of the Museum and Art Gallery Support Act or the cultural facilities determined by the Minister of Culture, Sports, and Tourism under Article 2 of the Enforcement Decree of the Museum and Art Gallery Support Act.
  • Article 14 (Application for Rental)
  • In case the institutions under Article 13 intend to rent the museum’s collections, they shall make an application to the Mayor with any of the following subparagraphs:
    • 1. Types of the museum’s collections, name, and quantity;
    • 2. Purpose of rental and period
    • 3. Place to store the museum’s collections rented and the situation of storing facilities;
    • 4. Protection management methods of the museum’s collections rented; and
    • 5. Transporting methods of the museum’s collections rented.
  • Article 15 (Condition of Rental)
  • In case of renting out the museum’s collections, the Mayor may add a condition necessary for the safe management of the museum’s collections.
  • Article 16 (Burden of Expenses)
  • A person who rent the museum’s collections shall pay the expenses concerning photographing, recording of real measuring, wrapping, and transporting, etc. necessary for entering or leaving the museum’s collection, and shall follow the technical direction of the Mayor.
  • Article 17 (Museum Collections Deliberation Committee) (1) The Mayor shall establish the Busan Marine Natural History Museum Collections Deliberation Committee (hereinafter referred to as the “Committee”) in order to deliberate and advice on the matters concerning the manufacture, purchase, or rental of the museum’s collections.
  • (2) The chairman of the Committee shall be elected from among the members, and the members shall be appointed or commissioned by the Mayor of the Busan Metropolitan City the Mayor from among those persons having profound knowledge and experience in the museum’s collections and the related government officers.
  • (3) A meeting of the Committee shall start by the attendance of more than three and less than five members chosen by the Mayor in every meeting, and its deliberation and resolution shall require the count-signature by all members’ consent of those present.
  • (4) The Committee shall have one secretary, and he/she shall be in charge exhibition planning affairs.
  • (6) The allowances and travel expenses may be paid to the commissioned members within the limit of the budget.
  • (7) Matters necessary for the operation of the Committee, other than those provided in this Ordinance, shall be determined by the chairman through a resolution of the Committee.
  • Article 18 (Facilities for Rental and Purpose of Use)
  • The Mayor may rent out the museum’s facilities in the events falling under any of the following subparagraphs unless there exists any impediments to the operation of the museum, and the facilities subject to permission for rental and rental fees shall be as specified in the attached Table 3.
    • 1. Education and academic activities capable of contributing to the preservation, distribution, and transmission of tradition and marine culture;
    • 2. Culture and art activities such as exhibitions, etc. contributing to the development of tradition and marine culture and arts; and
    • 3. Events which government agencies or public organizations hold for the purpose of contributing to the promotion of ethnic arts and marine science, industry, and education, etc.
  • Article 19 (Application for Rental of Facilities and Permission) (1) A person, who intends to rent the museum’s facilities, shall apply for a permission for rental of facilities to the Mayor. The same shall also apply to any case where a person who obtains permission for rental of facilities (hereinafter referred to as the “renter”) intends to change the permitted matters.
  • (2) In case of receiving an application for permission for rental of facilities under paragraph (1), the Mayor shall determine whether or not to grant permission for rental after examining it, and shall notify the result to an applicant.
  • (3) The Mayor may, if deemed necessary in deciding to rent out the museum’s facilities, adjust and modify or add a condition.
  • (4) In case applications for rental of facilities are overlapped, priority order of permission for rental of facilities may be adjusted considering the museum’s business, characteristics of events, etc.
  • Article 20 (Restriction on Permission for Rental of Facilities)
  • The Mayor may not rent out facilities in any person falling under any of the following subparagraphs:
    • 1. A person who has failed to comply with compensation for damage or restoration to their original state resulted from damage to facilities according to the rental of facilities;
    • 2. A person whose permission for rental of facilities has been revoked violating its condition; and
    • 3. A person who falsely draws up an application for permission for rental of facilities.
  • Article 21 (Change of Permission for Rental of Facilities) (1) In case there is the operation of the museum or any inevitable reason, the Mayor may change the period of time and area of the rented facilities with the consent of an applicant by one week before the permitted rental date.
  • (2) In case a renter falls under any of the following subparagraphs, the Mayor may revoke permission for rental of facilities:
    • 1. In case a renter holds exhibitions contrary to the contents of such permission;
    • 2. In case a renter violates the rental conditions of Article 19 (3) or the matters to be observed of Article 24;
    • 3. In case a renter fails to pay the rental fees under Article 22; or
    • 4. In case it is deemed that it is impossible for a renter to use the museum’s facilities due to force majeure or other equivalent causes.
  • Article 22 (Payment of Rental Fees, etc.) (1) Any renter shall pay the rental fees of the attached Table 3 ten days before the permitted rental date: Provided, That he/she shall do so not later than the day before that date when there is any unavoidable reason.
  • Article 23 (Reduction and Exemption of Rental Fees) (1) The Mayor may exempt the rental fees in any case falling under following subparagraphs:
    • 1. Events held or organized by the Busan Metropolitan City or its offices; or
    • 2. Events held or organized by the museum or events co-organized by the museum.
  • (2) In case of events contributing to the operation of the museum and the development of regional culture, the Mayor may reduce the rental fees by 50 percent.
  • Article 23-2 (Return of Fees) (1) The Mayor shall return all or part of the rental fees in any case falling under any of the following subparagraphs:
    • 1. In case it is difficult to rent the facilities due to the event of the Busan Metropolitan City or circumstances of the museum;
    • 2. In case it is impossible to rent the facilities due to force majeure or other equivalent causes; or
    • 3. In case a renter demand a return due to circumstances of him/her.
  • (2) The standards of the return of the rental fees under paragraph (1) shall be as specified in the attached Table 3.
