CHAPTER I GENERAL PROVISIONS

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to prescribe matters necessary for the operation of the Busan Museum of Art and the Museum of Contemporary Art Busan established pursuant to Article 12 of the Museum and Art Gallery Support Act. (Amended by Ordinance No. 5602, Jul. 12, 2017.)

CHAPTER II OPERATION OF EXHIBITION HALLS

  • Article 2 (Operation of Exhibition Halls)
  • ① The exhibition halls of the Busan Museum of Art and the Museum of Contemporary Art Busan (hereinafter referred to as the "Art Museums") may be classified into permanent exhibition halls and planned exhibition halls, and operated accordingly. (Amended by Ordinance No. 4354, Feb. 4, 2009; Ordinance No. 5602, Jul. 12, 2017)
  • ② Permanent exhibition halls may be changed to and operated as planned exhibition halls when deemed necessary to do so.
  • ③ The Mayor may operate exhibition halls of an art gallery as a biennale hall when deemed necessary for the development of culture and arts. (Newly Inserted on May 27, 2020)
  • Article 3 (Opening and Closure)
  • ① The Art Museums shall be open every day except the days of closure referred to in paragraph ②.
  • ② The days of closure of the Art Museums shall be as follows: (Amended by Ordinance No. 4098, May 10, 2006)
    • 1. January 1;
    • 2. Monday: Provided, That where Monday is a holiday, the following day shall be the day of closure;
    • 3. Other days of closure determined by the Mayor of Busan Metropolitan City (hereinafter referred to as the "Mayor").
  • ③ Where the Mayor determines a day of closure under paragraph ② 3, he or she shall post the day of closure on the website, etc. of Busan Metropolitan City (hereinafter referred to as the "City") in advance. (Newly Inserted by Ordinance No. 4098, May 10, 2006; Ordinance No. 4354, Feb. 4, 2009)
  • Article 4 (Opening Hours (Amended by Ordinance No. 4549, Sep. 29. 2010.))
  • ① The opening hours of the Art Museums shall be from ten o'clock in the morning to six o'clock in the afternoon.(Amended by Ordinance No. 4549, Sep. 29. 2010; Ordinance No. 5353, Jun. 8, 2016.)

  • ③ Notwithstanding paragraph ①, the Mayor may adjust the opening hours where deemed necessary for revitalizing the operation of the Art Museums. (Amended by Ordinance No. 4354, Feb. 4, 2009; Ordinance No. 4549, Sep. 29, 2010) [This Article Wholly Amended by Ordinance No. 4098, May 10, 2006]
  • Article 5 (Admission Fees)
  • ① Admission to the Art Museums shall be free of charge: Provided, That admission fees may be collected in any of the following cases. (Amended on May 27. 2020)
    • 1. Where a special exhibition or planned exhibition is held;
    • 2. Where an exhibition under Article 2 ③ is held;
  • ② Admission fees under paragraph ① 1 shall be determined by the Operating Advisory Committees referred to in Article 18 ① within the limits of 15,000 won in consideration of the scale and level of the relevant exhibition, and the admission fees under paragraph ① 2 shall be determined after consultation with the Mayor.   • Article 5-2 (Exemption from Admission Fees)
  • ① Notwithstanding Article 5 ①, the Mayor shall exempt any of the following persons from paying admission fees: (Amended by Ordinance No. 5602, Jul. 12, 2017; May. 27, 2020; Jul. 14, 2021; Dec. 29, 2021)
    • 1. A state guest or foreign envoy and the members of his or her suite;
    • 2. A child under seven years of age accompanied by his or her guardian, or a person of at least 65 years of age;
    • 3. A person who enters the Art Museums for the purpose of conducting academic research or performing public duties;
    • 4. A person with a disability registered in accordance with the Act on Welfare of Persons with Disabilities, and one guardian accompanying such person;
    • 5. A person who possesses a certificate of distinguished service to the State or certificate of a bereaved family of a person who rendered distinguished service to the State under the Act on the Honorable Treatment of and Support for Persons of Distinguished Service to the State;
    • 6. A person who possesses a certificate of distinguished service to national independence or certificate of a bereaved family of a person who rendered distinguished service to national independence under the Act on the Honorable Treatment of Persons of Distinguished Service to Independence;
    • 7. A person who falls under any of the subparagraphs of Article 52 ① of the Enforcement Decree of the Act on the Honorable Treatment of Persons of Distinguished Service to the May 18 Democratization Movement and the Establishment of Organizations;
    • 8. A person who possesses a certificate of a war veteran under the Act on Honorable Treatment of War Veterans and Establishment of Related Associations;
    • 9. A person who possesses a certificate of a patient suffering from actual or potential aftereffects of defoliants under the Act on Assistance to Patients Suffering from Actual or Potential Aftereffects of Defoliants and Establishment of Related Organizations;
    • 10. A person who possesses a certificate of distinguished service during special missions or certificate of a bereaved family of a person who rendered distinguished service during special missions under the Act on Honorable Treatment of Persons of Distinguished Service during Special Missions and Establishment of Related Organizations;
    • 11. A person possessing a family love card who belongs to a multi-child family under the Busan Metropolitan City Ordinance on Preferential Treatment and Support for Multi-child families;
    • 12. A person who possesses a certificate of an exemplary entrepreneur under the Busan Metropolitan City Ordinance on the Honorable Treatment of Entrepreneurs and the Promotion of Enterprise Activities;
    • 13. A person who possesses an honorary citizenship certificate under the Act on the Busan Metropolitan City Ordinance on the Conferment and Control of Honorary Citizenship Certificate, and his or her spouse;
    • 14. A person possessing a certificate of voting issued by the relevant election commission who participated in the voting of an election under the Public Official Election Act or the Local Education Autonomy Act (In such case, the exemption of admission fees shall be effective, only for once, until three months after the relevant election date);
    • 15. A person who possesses a certificate of a wounded noble person or certificate of a bereaved family of a deceased noble person under the Act on Honorable Treatment of and Support for Persons Who Died or Were Injured for Public Good, and the spouse and children of a wounded noble person; (Newly Inserted on Jul. 12, 2017)
    • 16. Registered prisoners of war under subparagraph 5 of Article 2 of the Act on the repatriation and treatment of POWs, and families of prisoners from the detention center under subparagraph 3 of the same Article (Newly Inserted on Dec. 29, 2021)
  • ② Admission fees may be partially reduced or exempted for any of the following persons: (Newly Inserted on May 27, 2020)
    • 1. Group admission;
    • 2. Artist Pass Holder;
    • 3. Any other person for whom an admission fee exemption is deemed necessary by the Mayor.
  • ③ Detailed matters concerning the amount of reduction or exemption of admission fees under paragraph ②, the matters to be entered therein, and other matters shall be separately determined by the Mayor. (Newly Inserted on May 27, 2020)
  • ④ The Mayor may designate and offer a free admission day where necessary for revitalizing the operation of the Art Museums. (Newly Inserted on May 27, 2020)

  • Article 5-3 (Admission Ticket)
  • ① The Mayor shall issue admission tickets when receiving admission fees.
  • ② The Mayor shall assign serial numbers to admission tickets and attach his or her inspection seal thereto: Provided, That such seal may be omitted where admission tickets are sold electronically.
  • ③ Detailed matters concerning the design and size of admission tickets under paragraph ①, the matters to be entered therein, and other matters shall be separately determined by the Mayor.

  • Articles 6 and 7

  • Article 8 (Prohibition of Admission)
  • Any of the following persons shall be prohibited from admission to the Art Museums: (Amended by Ordinance No. 4354, Feb. 4, 2009; Ordinance No. 4641, Jul. 13, 2011; May 27, 2020)
    • 1. Deleted; (Ordinance No. 4354, Feb. 4, 2009)
    • 2. A child under six years of age who is not accompanied by his or her guardian;
    • 3. A person who carries a large quantity of articles or is accompanied by an animal (Provided, That a person with a disability who is accompanied by a guide dog with the mark of a guide dog pursuant to Article 40 ③ of the Act by Welfare of Persons with Disabilities shall be excluded henceforth); (Amended by Ordinance No. 4354, Feb. 4, 2009; Ordinance No. 4641, Jul. 13, 2011)
    • 4. A person who carries fire-causing, malodorous, or aversive articles;
    • 5. Any other person who is likely to damage exhibits or other equipment of the Art Museums due to drinking, etc. (Amended by Ordinance No. 4354, Feb. 4, 2009)
  • Article 9 (Restriction on Acts)
  • ① No visitors to the Art Museums shall conduct the following acts in the exhibition halls of the Art Museums: (Amended by Ordinance No. 4354, Feb. 4, 2009)
    • 1. Smoking or drinking;
    • 2. Lighting or photographing without the permission of the Mayor;
    • 3. Touching exhibits;
    • 4. Causing inconvenience to other visitors in the Art Museums, such as talking in a loud voice; (Amended by Ordinance No. 4354, Feb. 4, 2009)
    • 5. Deleted. (Amended by Ordinance No. 4354, Feb. 4, 2009)
  • ② The Mayor may order a person who has committed an act referred to in any subparagraph of paragraph ① to leave the Art Museums. (Amended by Ordinance No. 4354, Feb. 4, 2009)
  • Article 9-2 (Tuition Fees)
  • Art education lectures or programs provided by the Art Museums shall be free of charge: Provided, That tuition fees may be collected within the extent specified in attached Table 5 where deemed necessary by the Mayor.

  • Article 9-3 (Refund of Tuition Fees)
  • ① The Mayor shall fully or partially refund tuition fees in any of the following cases:
    • 1. Where education is impractical, canceled, or suspended due to a natural disaster or any other unavoidable cause;
    • 2. Where a person who applied for participation in education, etc. has abandoned receiving the relevant education, etc.
  • ② The refund of tuition fees under paragraph ① shall be made in accordance with the refund criteria specified in attached Table 6.

CHAPTER III COLLECTION AND MANAGEMENT OF WORKS (Amended by Ordinance No. 4098, May. 10, 2006)

  • Article 10 (Collection of Works)
  • The Mayor shall collect works of art by means of purchase, donation, deposit, entrustment of custody, transfer of management, etc. of such works (hereinafter referred to as "collection of works"), and the objects and scope of collection shall be domestic or foreign excellent works of art that have the academic or artistic value of preservation or the value of research.

  • Article 10-2 (Purchase of Works)
  • ① Where the Mayor intends to purchase works, he or she shall formulate a plan for such purchase, including the objects of and procedures for purchase, in advance. In such cases, he or she shall publish matters necessary for the purchase of works in a daily newspaper, the City's official gazette, and by the City's webpage. (Amended by Ordinance No. 4625, Jun. 8, 2011)
  • ② The Mayor shall determine the works to be purchased and their prices according to the final results of deliberation by the relevant Works Collection Committee under Article 18 ④ after undergoing deliberation by the relevant Works Price Deliberation Committee under Article 18 ③ and Works Collection Recommendation Committee in accordance with the plan for the purchase of works under paragraph ①.   • Article 10-3 (Donation of Works)
  • ① The Mayor may use works of art necessary for exhibitions, research, etc. of the Art Museums after having such works donated to the Art Museums. In such case, he/she shall comply with the matters prescribed in Article 8 of the Museum and Art Gallery Support Act. (Amended by Ordinance No. 4354, Feb. 4, 2009; May. 27, 2020)
  • ② The Mayor may use works of art necessary for exhibitions, research, etc. of the Art Museums after having such works donated, deposited, entrusted in custody and transferred of management to the Art Museums. In such case, he/she shall determine according to the final results of deliberation by the relevant Works Collection Committee under Article 18 ④ after undergoing deliberation by the relevant Works Price Deliberation Committee under Article 18 ③ and Works Collection Recommendation Committee under Article 18 ②.   • Article 11 (Use of Works)
  • ① Where there is a request for the use of materials collected by the Art Museums, the Mayor may grant permission for such use unless the operation and management of the Art Museums is impeded. (Amended by Ordinance No. 4354, Feb. 4, 2009)
  • ② A person who intends to use the materials under paragraph ① shall pay the use fees specified in attached Table 2; Provided, That he or she may be exempted from such payment when he/she uses the relevant materials for the purpose of academic research or study, education, and promotion of culture and arts. (Amended by Ordinance No. 4354, Feb. 4, 2009)
  • Article 12 (Loan of Works)
  • ① In any of the following cases, the Mayor may loan works unless the affairs of the Art Museums are impeded: (Amended by Ordinance No. 4354, Feb. 4, 2009)
    • 1. An exhibition which the State, a local government, a public art gallery, or other organization holds for open exhibition;
    • 2. An exhibition for international cultural exchange;
    • 3. Where a person who has transferred the management of his or her works to the Art Museums or donated his or her works thereto makes a special request for the loan of the relevant works;

  • ② The Mayor may request a person has received a loan of works pursuant to paragraph ① to take out an insurance policy on the relevant works if necessary. (Amended by Ordinance No. 4354, Feb. 4, 2009)
  • ③ The period of loan of works shall not be not more than six months, and where the extension of the loan period is necessary, it shall be approved by the Mayor. (Amended by Ordinance No. 4354, Feb. 4, 2009; May. 27, 2020)
  • Article 13 (Matters to Be Observed)
  • Any person who has received a loan of works pursuant to Article 12 shall observe the following: (Amended by Ordinance No. 4354, Feb. 4, 2009)
    • 1. He or she shall have a duty of good faith for the safe preservation and management of the loaned works;
    • 2. He or she shall bear the expenses for photographing, recording of the actual measurement, packaging, carrying, etc. which are necessary for transporting the loaned works from or to the Art Museums;
    • 3. Where the loaned works are damaged or destroyed during the rental period, he or she shall restore them or pay compensation equivalent to the works damaged or destroyed;
    • 4. He or she shall be prohibited from photographing, copying, imitating, or duplicating the loaned works;

  • Article 14 (Revocation and Suspension of Loan)
  • ① Where a person who has received a loan of works uses them contrary to the original purposes of such loan or fails to comply with the terms and conditions thereof, the Mayor may revoke such loan.
  • ② If necessary for the safe management, etc. of loaned works, the Mayor may request for the return of the relevant works even during the period of such loan. (Amended by Ordinance No. 4354, Feb. 4, 2009)
  • Article 15 (Decision on Disuse of Works)
  • ① When works cannot be used for their original purposes, the Mayor may make a decision on the disuse of such works.
  • ② Where the Mayor intends to make a decision on the disuse under paragraph ①, he or she shall undergo consultation by the relevant Operating Advisory Committee pursuant to Article 18 ① 4.   • Article 16 (Sale and Disposal)
  • The Mayor may sell or dispose of works with respect to which he or she has made a decision on the disuse under Article 15. (Amended by Ordinance No. 4354, Feb. 4, 2009)

CHAPTER IV OPERATION OF COMMITTEES (Amended on Apr. 1, 1999; May 10, 2006)

  • Article 17 (Establishment)
  • ① The following committees may be established to render advice to the Mayor concerning the efficient management and operation of the Busan Museum of Art: (Amended on May 27, 2020)
    • 1. Advisory Committee on the Operation of the Busan Museum of Art;
    • 2. Recommendation Committee on the Collection of Works of the Busan Museum of Art;
    • 3. Deliberative Committee on the Price of Works of the Busan Museum of Art;
    • 4. Deliberative Committee on the Collection of Works of the Busan Museum of Art.
  • ② The following committees may be established to render advice to the Mayor concerning the efficient management and operation of the Museum of Contemporary Art Busan: (Amended on May. 27, 2020)
    • 1. Advisory Committee on the Operation of the Museum of Contemporary Art Busan;
    • 2. Recommendation Committee on the Collection of Works of the Museum of Contemporary Art Busan;
    • 3. Deliberative Committee on the Price of Works of the Museum of Contemporary Art Busan;
    • 4. Deliberative Committee on the Collection of Works of the Museum of Contemporary Art Busan.

  • Article 18 (Functions)
  • ① The Advisory Committee on the Operation of the Busan Museum of Art and the Advisory Committee on the Operation of the Museum of Contemporary Art Busan (hereinafter referred to as the "Operating Advisory Committees") shall deliberate on the following: (Amended by Ordinance No. 4354, Feb. 4, 2009; Ordinance No. 5353, Jun. 8, 2016; Ordinance No. 5602, Jul. 12, 2017)
    • 1. Matters concerning the establishment and promotion of the basic directions of the operation of the Art Museums;
    • 2. Matters concerning the formulation of plans for major projects of the Art Museums;
    • 3. Matters concerning fees for admission to special exhibitions and planned exhibitions; (Newly Inserted on Jun. 8, 2016)
    • 4. Other significant matters concerning the operation of the Art Museums, with respect to which advice is rendered to the Mayor. (Newly Inserted by Ordinance No. 4354, Feb. 4, 2009)
  • ② The Recommendation Committee on the Collection of Works of the Busan Museum of Art and the Recommendation Committee on the Collection of Works of the Museum of Contemporary Art Busan (hereinafter referred to as the "Works Recommendation Committees") shall deliberate on the following matters: (Newly Inserted on May 10, 2006) (Amended by Ordinance No. 4354, Feb. 4, 2009; Ordinance No. 5602, Jul. 12, 2017; May 27, 2020)
    • 1. Recommendation of a group of works from which purchases are to be made;
    • 2. Recommendation of Works to be deposited, etc;
    • 3. Other matters the Mayor refers to meetings of the Committees concerning the collection of works. (Amended by Ordinance No. 4354, Feb. 4, 2009)
  • ③ The Deliberative Committee on the Price of Works of the Busan Museum of Art and the Deliberative Committee on the Price of Works of the Museum of Contemporary Art Busan (hereinafter referred to as the "Works Price Committees") shall deliberate on the following matters: (Newly Inserted on May 27, 2020)
    • 1. Appropriate prices of a group of works from which purchases are to be made;
    • 2. Calculation of price of works to be deposited, etc;
    • 3. Other matters the Mayor refers to meetings of the Committees concerning the price of works.
  • ④ The Deliberative Committee on the Collection of Works of the Busan Museum of Art and the Deliberative Committee on the Collection of Works of the Museum of Contemporary Art Busan (hereinafter referred to as the "Works Collection Committees") shall deliberate on the following matters. (Amended on May 10, 2006; Feb. 4, 2009; Jul. 12, 2017; May 27, 2020)
    • 1. Selection of a group of works from which purchases are to be made, and decision on whether to purchase them;
    • 2. Determination of the appropriate prices of works to be purchased;
    • 3. Decision on whether to have works deposited, etc;
    • 4. Other matters the Mayor refers to meetings of the Committees concerning the purchase and deposit of works.
  • Article 19 (Composition)
  • ① Each Operating Advisory Committee shall be composed of at least 10 and not more than 15 members, including one Chairperson and one Vice Chairperson, and its members shall be commissioned by the Mayor from among art experts who have much knowledge of and experience in art-related fields and other persons qualified to represent each of the social standings in each of the levels of society.   • ② Each Works Recommendation Committee shall be composed of not more than 35 members, and its members shall be the following persons: (Amended by Ordinance No. 4354, Feb. 4, 2009; Ordinance No. 5602, Jul. 12, 2017)
    • 1. The Director of the relevant Art Museum (hereinafter referred to as "Director of the relevant Art Museum"); (Amended by Ordinance No. 5602, Jul. 12, 2017)
    • 2. Persons commissioned by the Mayor from among experts who have much knowledge of and experience in art-related fields.
  • ③ Each Works Price Committee shall be composed of at least 6 and not more than 10 members, including one Chairperson and one Vice Chairperson, and its members shall be commissioned by the Mayor from among persons who have much knowledge of and experience in art-related fields.   • ④ Each Works Collection Committee shall be composed of at least 12 and not more than 20 members, including one Chairperson and one Vice Chairperson, and its members shall be commissioned by the Mayor from among persons who have much knowledge of and experience in art-related fields.   • ⑤ The Chairperson and Vice Chairperson of each Committee referred to in paragraphs ①, ③ and ④ shall be elected from among the members thereof. (Amended by Ordinance No. 4354, Feb. 4, 2009; May 27, 2020)
  • ⑥ In commissioning the members of each Committee referred to in paragraphs ① through ④, the commissioned members shall not overlap each other. (Amended by Ordinance No. 4354, Feb. 4, 2009; May 27, 2020)

  • Article 20 (Term of Office and Dismissal)
  • ① The members of each Committee shall hold office for a term of two years and may be commissioned consecutively for further terms: Provided, That any member filling a vacancy shall hold office for the remainder of his or her predecessor's term of office.
  • ② When any of the following grounds has occurred, the Mayor may dismiss the relevant member even before the expiration of his or her term of office: (Amended by Ordinance No. 4354, Feb. 4, 2009)
    • 1. When he or she fails to perform his or her duties in good faith;
    • 2. When he or she voluntarily wishes to resign;
    • 3. Otherwise when he or she is deemed unfit to serve as a member due to injury to dignity, etc.

  • Article 21 (Chairperson)
  • ① The Chairperson of each Committee shall represent the relevant Committee and exercise general supervision over its affairs.
  • ② Where the Chairperson of each Committee is unable to perform his or her duties due to any unavoidable cause, the Vice Chairperson shall act on behalf of the Chairperson. (Amended by Ordinance No. 4549, Sep. 29, 2010)
  • Article 22 (Meeting)
  • ① The Chairperson of each Committee referred to in Article 19 ①, ③ and ④ shall convene and preside over meetings of the relevant Committee. (Amended by Ordinance No. 3526, Apr. 1, 1999; Ordinance No. 4098, May 10, 2006; Ordinance No. 4354, Feb. 4, 2009; May 27, 2020)
  • ② A majority of the members of each Operating Advisory Committee shall constitute a quorum, and any decision thereof shall require the concurring vote of a majority of those present. (Amended by Ordinance No. 3526, Apr. 1, 1999)
  • ③ Meetings of each Works Recommendation Committee shall be convened by the Mayor. At each meeting, the Committee shall be composed of the Director of the relevant Art Museum and six experts in each relevant genre selected by the Mayor from among the members referred to in Article 19 ② 2, and its Chairperson shall be elected from among the members present. In such cases, at least five members of the Committee shall constitute a quorum, and any decision thereof shall require the concurring vote of at least 2/3 of those present. CHAPTER V RENTAL OF FACILITIES

  • Article 25 (Permission for Rental of Facilities)
  • The Mayor may grant permission for the rental of fundamental facilities only for events which accord with the operational policies of the Art Museums unless the operation and management of the Art Museums is impeded. (Amended by Ordinance No. 3915, Mar. 11, 2004; Ordinance No. 4354, Feb. 4, 2009; May 27, 2020)
  • Article 26 (Scope of Facilities Subject to Permission for Rental, and Purposes of Use of Those Facilities)
  • The scope of fundamental facilities and attached equipment with respect to which permission for rental may be granted shall be as follows: Provided, That the rental of fundamental facilities shall be limited to Art and culture events, such as art-related lectures, and other general events that do not impede the operation and management of the Art Museums:
    • 1. Fundamental facilities: Auditorium, meeting room, lecture room, seminar room;
    • 2. Attached equipment: Air conditioners, etc.

  • Article 28 (Modification of Permission for Rental of Facilities)
  • ① In deciding on the rental of facilities, the Mayor may adjust or modify the period of rental or attach a condition thereto where necessary for the smooth maintenance and management of facilities.
  • ② When a renter intends to modify the permitted matters, he/she shall obtain a permission from the Mayor.
  • Article 29 (Restriction on Permission for Rental of Facilities)
  • The Mayor need not rent out fundamental facilities in any of the following cases: (Amended by Ordinance No. 4354, Feb. 4, 2009; May 27, 2020)
    • 1. Where public security and order or good morals are likely to be disturbed;
    • 2. Deleted; (May 27, 2020)
    • 3. Where a person who has failed to pay compensation for damage or restore any damaged facilities pursuant to Article 35 applies for the use of facilities;
    • 4. Other cases deemed by the Mayor inappropriate for the management and operation of the Art Museums.
  • Article 30 (Rental Fees)
  • ① A renter shall pay the rental fees specified in attached Table 3 at least ten days before the date of permitted use: Provided, That he or she shall pay the rental fees by not later than the day before the date of rental of the relevant facilities where there exists any unavoidable cause.   • ② Rental fees shall include the fees for using fundamental facilities, etc. and those for using attached equipment such as air conditioners. (Amended by May 27, 2020)

  • Article 31 (Exemption from or Reduction of Rental Fees)
  • ① The Mayor may grant the exemption from or reduction of rental fees in any of the following cases: (Amended by Ordinance No. 5353, Jun. 8, 2016; May 27, 2020)
    • 1. An event held or hosted by the City or its affiliated institutions: Exemption from rental fees;
    • 2. An event sponsored by the City or its affiliated institutions: Reduction of 50/100 in rental fees.
  • ② The Mayor may grant a reduction of 50/100 in rental fees, in cases of an event that can contribute to the revitalization of the operation of the Art Museums or to the development of the regional culture.

  • Article 31-2 (Refund of Rental Fees)
  • In any of the following cases, the Mayor shall fully or partially refund rental fees in accordance with attached Table 4:
    • 1. Where the rental of facilities becomes difficult due to the City's event or the Art Museums' circumstances;
    • 2. Where the rental of facilities is impossible due to a natural disaster or any other force majeure;
    • 3. Where the refund of rental fees is requested due to the relevant renter's circumstances.

  • Article 32 (Suspension and Modification of Permission for Rental of Facilities)
  • When there is an unavoidable reason connected with the operation of the Art Museums, the Mayor may suspend the use of fundamental facilities, etc. that have already been rented or modify the period for or place of such use with the consent of the relevant renter. (Amended on May 27. 2020)

  • Article 33 (Revocation of Permission for Rental of Facilities)
  • Where a renter falls under any of the following, the Mayor may revoke permission for the rental of the relevant facilities: (Amended by Ordinance No. 4354, Feb. 4, 2009; May. 27, 2020)
    • 1. Where the renter holds an event, etc. in violation of the details of the permission therefor;
    • 2. Where the renter falls under any subparagraph of Article 29;
    • 3. Where the renter fails to pay the rental fees referred to in Article 30;
    • 4. Where it is deemed impossible to use exhibition halls, etc. due to a natural disaster or any other unavoidable cause.

  • Article 35 (Compensatory Measures and Compensation for Damage)
  • ① When a person admitted to the Art Museums has damaged or soiled exhibits, the Mayor shall have the relevant person pay compensation therefor without delay.
  • ② When a renter has damaged any rented facilities or other facilities attached thereto by intention or negligence, the Mayor shall have the relevant renter pay compensation for such damage or restore the damaged facilities.
  • Article 36 (Permission for Use of Facilities)
  • The Mayor may rent out facilities in the Art Museums, and facilities subject to permission and matters necessary for the operation thereof shall be governed by the Busan Metropolitan City Ordinance on the Public Property and Goods Management.   • Article 36-2 (Operation of Shuttle Bus)
  • ① The Mayor may operate a shuttle bus for citizens who visit the Art Museums.
  • ② The route of the shuttle bus service shall be determined in connection with urban railroad routes and may be adjusted if necessary; and the shuttle bus fare shall be free.
  • ③ The operating hours of the shuttle bus shall be from nine o'clock in the morning to seven o'clock in the afternoon and may be adjusted if necessary.
  • ④ The shuttle bus shall operate except the days of closure under Article 3, and such operating dates may be adjusted if necessary.

  • Article 37 (Delegation of Authority)
  • The Mayor shall delegate to the Directors of the Art Museums his or her authority over affairs related to the operation of the Art Museums under Articles 3, 4, 5, 5-2, 5-3, 9, 9-2, 9-3, 10 through 19, 22, 23, 25 through 29, 31, 31-2, and 32 through 36-2.
