BUSAN METROPOLITAN CITY ORDINANCE ON THE ESTABLISHMENT OF ART GROUP
- Article 1 (Purpose)
- The purpose of this Ordinance is to provided for necessary matters concerning the establishment and operation of the Busan Art Group (hereinafter referred to as the "Art Group") to develop sentiments of citizens of Busan as well as to promote the local culture and art.
- Article 2 (Composition)(1) The head of the Art Group (hereinafter referred to as the "group head") shall be the Vice-Mayor of Busan Metropolitan City and the vice-head of the Art Group shall be the head of the Busan Culture Hall.
- (2) The Art Group shall have art organizations falling under the following
subparagraphs:
- 1. Busan symphony orchestra (hereinafter referred to as the "symphony orchestra");
- 2. Busan traditional music orchestra (hereinafter referred to as the "traditional music orchestra");
- 3. Busan corps de ballet (hereinafter referred to as the "corps de ballet");
- 4. Busan chorus (hereinafter referred to as the "chorus");
- 5. Busan juvenile symphony orchestra (hereinafter referred to as the "juvenile symphony orchestra");
- 6. Busan boys and girls chorus (hereinafter referred to as the "boys and girls chorus"); and
- 7. Busan theater company (hereinafter referred to as the "theater company").
- (3) A publicity department shall be established to support general affairs of each art organization, such as publicity, etc.
- (4) Matters concerning the classification and prescribed number of the members of each art organization (hereinafter referred to as the "members") and the employees of the publicity department (hereinafter referred to as the "employees"), shall be determined by rule of Busan Metropolitan City.
- Article 3 (Duties of Group Head, etc.)(1) The group head shall exercise the overall control of each art organization and direct and supervise the members and employees under the order of the Mayor of Busan Metropolitan City (hereinafter referred to as the "Mayor"), and the group vice-head shall assist the group head.
- (2) An art supervisor shall direct and supervise general affairs of public performances of each art organization, such as the planning thereof, guest conducting, selection of co-performers, etc.: Provided, That the group head may, when deemed necessary, have the chief conductor, the chief choreographer and the chief producer of each such art organization (hereinafter referred to as the "chief director") concurrently perform the duties of the art supervisor.
- (3) The chief director shall direct musical performances, exercises and public performances of members of an art organization to which he belongs.
- (4) The supervisory committee for dramatic company's art of Busan Metropolitan City may be established in order to deliberate and resolve on matters relating to the public performance and operation of the dramatic company.
- (5) Necessary matters for the composition and operation of the supervisory committee for Busan dramatic company's art shall be determined by rule of Busan Metropolitan City.
- Article 4 (Operation Committee)(1) The operation committee for ○ ○ ○Group of Busan Metropolitan City (hereinafter referred to as the Committee") shall be established for the purpose of hearing the opinions of specialized persons of each circle, on the basic plan and operation of each art organization
- (2) Necessary matters for the composition and operation, etc. of the Committee shall be determined by rule of Busan Metropolitan City.
- Article 5 (Screening Committeemen, etc.)
- (1) The screening committeemen shall be placed by art organizations for the purpose of screening and rating of the level of artistic accomplishment, at the time of commissioning the members.
- (2) Necessary matters for the composition and operation, etc. of the screening committee shall be determined by rule of Busan Metropolitan City.
- Article 6 (Full-time Members and Part-time Members)
- The members of art organizations shall be classified into the full-time members and part-time members.
- Article 7 (Honorary Members)
- The group head may, if necessary, commission those persons who have rendered distinguished services to art organizations to which they have belonged from among the retired members as honorary members.
- Article 8 (Qualification and Commissioning)(1) The members shall be commissioned by the group head from among those persons who have professional knowledge and experience in the relevant fields of each art organization, by going through screenings open to the public: Provided, That in case of part-time members and honorary members, the group head may commission them upon the recommendation of chief director, and that of art supervisor.
- (2) The persons who are recognized home and abroad as those of excellent abilities may be commissioned by means of a special screening or a contract, notwithstanding the provisions of paragraph (1).
- (3) The new commissioning of the employees shall be made by the group head from among those who have engaged in the related art field, or equipped with the attainments necessary for performing the duties under their charge.
- Article 9 (Method of Screening)(1) The open screening shall be made by means of a practical skill test and an interview, and the interview shall be made for those who have passed practical skill test: Provided, That the special screening under Article 8 (2) may be made by means of an examination of documents and an interview.
- (2) Matters concerning the open screening and grading standards, etc. shall be determined by the group head..
- Article 10 (Age for Commissioning)
- The age for commissioning of the members and
employees shall be less than 58 years old: Provided, That any case falling under any
of the following subparagraphs shall be exempted:
- 1. Where there exists no impediment in his health for performing duties, and the group head deems it specially necessary; and
- 2. Where the art supervisor and chief director of each art organization are commissioned.
- Article 11 (Commission Period, and Guarantee of Status)(1) The commission period of the members and employees shall be less than three years.
- (2) The status of the members and employees shall be guaranteed for their commission period, unless any measures of dismissal or disciplinary action is taken under Article 13.
- Article 12 (Recommission)(1) Any members whose commission period has expired may be recommissioned by going through a screening of the screening committeemen by art organizations: Provided, That the members and employees who have been designated by the group head may be recommissioned by him by evaluating their actual achievements during their commission period.
- (2) The standards, etc. for screening under paragraph (1) shall be as separately determined by the group head.
- Article 13 (Dismissal of Members)(1) The group head shall deservedly dismiss the members falling under any of the following subparagraphs (including the "employees" in this Article) from their posts:

- 1. Persons falling under one of each subparagraph of Article 31 of the Local Public Officials Act;
- 2. Persons who are in need of medical treatments for not less than one year due to physical or mental handicaps;
- 3. Persons who are enlisted or called up in order to complete the compulsory military services under the Military Service Act;
- 4. Persons whose being alive or dead or whose whereabout came to be obscure due to natural disasters, wartime calamities or other causes; and
- 5. Persons who are judged by the results of a screening for recommission that their skills are remarkably insufficient for the members.
- (2) The group head may, ex officio, dismiss persons falling under any of the following
subparagraphs from their posts with the consent of the disciplinary committee:
- 1. Persons who have violated the obligation under Acts and subordinate statutes, or business instructions without any justifiable ground;
- 2. Persons whose overseas tour period exceeds one month due to other reasons than their duties;
- 3. Persons who have refused or wilfully avoided their performances or as- signed casts; and
- 4. Persons who have committed an absence without notice continuously not less than five times without any justifiable ground.
- (3) The composition of the disciplinary committee, etc. shall be determined by rule of Busan Metropolitan City.
- Article 14 (Budget)
- Those expenses which are required for the operation of art organizations shall be stated in the budget of Busan Metropolitan City every year.
- Article 15 (Compensation for Remunerations and Actual Expenses) (1) Necessary matters for the assessment of salary grades, remunerations and various allowances (including the "subsidy to the research on artistic achievements"), travel expenses for the members and employees, shall be determined by rule of Busan Metropolitan City.
- (2) Actual expenses of allowances and travel expenses may be paid to the part-time members and honorary members, to such an extent as the relevant budget permits.
- (3) Allowances and travel expenses may be paid to the screening committeemen, operation members and art supervisory members, to such an extent as the relevant budget permits.
- Article 16 (Establishment of Operational Fund)
- Any separate fund may be established and operated by every art organization, if it is necessary for the activation of public performances and the enhancement of the members' welfare.
- Article 17 (Collection of Admission Fees)(1) Admission fees shall be collected when the art organizations make any public performances: Provided, That they may be held free of charge when the Mayor deems it necessary for the public interests.
- (2) Free admission tickets may be issued within 10 percent of the issued number of the charged admission tickets: Provided, That the group head may adjust the scope of their issuance in case where deemed necessary.
- (3) Where the sale of charged admission tickets are entrusted to the individuals or organizations, the fees equivalent to 15 percent of total sale amounts of admission tickets may be paid to the trustees, to such an extent as the relevant budget permits
- (4) The group head shall separately determine admission fees by art organizations and by public performances.
- (5) The membership system may be implemented by every art organization for the purpose of expanding the basis of culture and art populations, and when joining in the membership, the admission fees may be discounted within 50 percent.
- Article 18 (Entrusted Operation)(1) The Mayor may, when deemed necessary, entrust the operation of art organizations to the nonprofit corporations or social organizations.
- (2) When the Mayor has entrusted the operation of the Busan Art Group, he may render the subsidies to required expenses to such an extent as the relevant budget permits.
- Article 19 (Supervision of Public Performance Businesses)
- The group head may implement the culture and art projects, such as the supervision of public performance, publication of performance art, lectures of performance art, etc. for developing sentiments of citizens of Busan.
- Article 20 (Municipal Rule)
- Necessary matters concerning the enforcement of this Ordinance shall be prescribed by rule of Busan Metropolitan City.
- ADDENDUM
- This Ordinance shall enter into force one month after the date of its promulgation.
