BUSAN METROPOLITAN ORDINANCE FOR PROMOTION OF CULTURAL CONTENT INDUSTRY

  • Article 1 (Purpose)
  • The purpose of this Act is to contribute to improving citizens' lifestyle and boosting the local economy by prescribing matters necessary for the promotion of the cultural content industry and support therefor, in order to develop the infrastructure of the cultural content industry and to strengthen the competitiveness thereof.
  • Article 2 (Definition)
  • The term "cultural content industry" in this Ordinance means the content industry under Article 2 (1) 1 of the Content Industry Promotion Act and the cultural industry under subparagraph 1 of Article2 of the Framework Act on the Promotion of Cultural Industries.
  • Article 3 (Formulating Mid- and Long-Term Master Plan for Cultural Content Industry)(1) The Mayor of Busan Metropolitan City (hereinafter referred to as the "Mayor") shall formulate and implement basic and comprehensive mid- to long-term master plans on the promotion of the cultural content industry (hereinafter referred to as "master plan").   • (2) The Mayor shall formulate and implement an implementation plan in accordance with the master plan every year. [Newly Inserted by Ordinance No. 5469, Nov. 2, 2016]
  • (3) If necessary for formulating and implementing a master plan, the Mayor may hear opinions of the heads of Gus/Guns and institutions, organizations, research institutes, corporations, universities, private enterprises, individuals, etc. related to the cultural content industry or request them to provide necessary cooperation.   • Article 4 (Support to Cultural Content Business Operators)
  • In order to promote the cultural content industry, the Mayor may provide cultural content business operators with the following support, within budgetary limits: [Amended by Ordinance No. 5469, Nov. 2, 2016]
    • 1. Securing space in which cultural content businesses are to be relocated;
    • 2. Employment subsidies and education and training subsidies;
    • 3. Rents;
    • 4. Providing high technology and equipment;
    • 5. Education and training to develop human resources;
    • 6. Participation and publicity of cultural content exhibitions within Korea and overseas;
    • 7. Location incentives.
  • Article 5 (Support for Production)
  • The Mayor may provide necessary funds to creators and producers within budget limits in order to strengthen the competitiveness of the cultural content industry and to promote the production of excellent cultural content products.
  • Article 6 (Support for Establishment of Enterprises)
  • The Mayor may provide necessary funds within budget limits for the promotion of the establishment of enterprises relating to the cultural content industry and for the growth and development of such enterprises.
  • Article 7 (Support for Relocation of Enterprises, etc.)
  • Where a cultural content industry-related enterprise or research institution relocates to the Busan Metropolitan area, the Mayor shall provide support necessary therefor, as prescribed by the Busan Metropolitan Ordinance on Promotion Attracting of Enterprises and Investment.   • Article 8 (Promotion to Attract Foreign Investment)
  • The Mayor shall provide support for the promotion of foreign investment in the cultural content industry, as prescribed by the Busan Metropolitan Ordinance on Promotion Attracting of Enterprises and Investment. [Amended by Ordinance No. 4976, Jan. 1, 2014]
  • Article 9 (Promotion of Technical Development)
  • The Mayor shall establish and implement policies for the promotion of technical development related to the cultural content industry and subsidize research projects for technical development of cultural contents selected through a public invitation, within budget limits.
  • Article 10 (Training for Experts)
  • The Mayor may subsidize education and training of universities, research institutions, other cultural content-related institutions or organizations executing projects to train cultural content-related experts within budget limits, in order to activate the creation of cultural contents.
  • Article 10-2 (Expansion of Cultural Content Base)
  • The Mayor may prepare facilities necessary for enhancing citizen's recognition of cultural content and providing information, and operate programs for experiencing and educating on cultural content. [This Article Newly Inserted by Ordinance, Nov. 2, 2016]
  • Article 10-3 (Support for Overseas Expansion, etc.)(1) The Mayor may support the following projects to promote expansion into overseas markets for cultural content:
    • 1. Projects for overseas marketing for cultural content;
    • 2. Holding international events related to cultural content;
    • 3. Other project necessary for overseas expansion of cultural content
  • (2) The Mayor may subsidize expenses necessary for institutions or organizations which promote projects under paragraph (1), within budgetary limits. [This Article Newly Inserted by Ordinance, Nov. 2, 2016]
  • Article 11 (Creation, etc. of Cultural Industry Complexes and Cultural Industry Promotion Districts)(1) Where necessary in relation to the creation of a cultural industry complex and a cultural industry promotion district designated in accordance with the Framework Act on the Promotion of Cultural Industries, the Mayor may subsidize a person who implements a plan for creation within budget limits.
  • (2) In order to promote the cultural content industry, the Mayor may develop cultural industry promotion facilities intensively in a cultural industry complex, etc., or encourage companies to relocate thereto, and provide necessary support so that non-governmental persons, etc. may establish cultural industry promotion facilities readily in accordance with the Framework Act on the Promotion of Cultural Industries.
  • Article 12 (Establishment and Functions of Committee on Promotion of Cultural Content Industry)
  • The Mayor shall establish the Committee on Promotion of the Busan Metropolitan Cultural Content Industry (hereinafter referred to as the "Committee")to deliberate on the following matters concerning the promotion of the cultural content industry: [Amended by Ordinance No. 5469, Nov. 2, 2016]
    • 1. Matters concerning the development and implementation of a mid- to long-term master plan for the cultural content industry;
    • 2. Development of policies for the promotion of the cultural content industry and consultation thereon;
    • 3. Matters concerning support pursuant to Articles 4 through 10, 10-2, 10-3 and 11;
    • 4. Other matters concerning the promotion of the cultural content industry, submitted to a meeting by the chairperson of the Committee.
  • Article 13 (Organization, etc.)(1) The Committee shall consist of not more than 15 members, including one chairperson and one vice chairperson.
  • (2) A Deputy Mayor for Administrative Affairs shall serve as a chairperson of the Committee and a vice chairperson shall be elected from among members, and the Mayor shall appoint or commission members of the Committee from among the following persons:
    • 1. Public officials at Grade 4 or higher, belonging to the Busan Metropolitan City;
    • 2. Persons recommended by the Busan Metropolitan Council;
    • 3. Persons who have abundant knowledge of and extensive experience in the cultural content industry
  • (3) The committee shall be organized if an agenda occurs, and shall be automatically dissolved following deliberation and resolution. [Amended by Ordinance No. 5469, Nov. 2, 2016]
  • Article 14 (Duties of the Chairperson)(1) The chairperson shall represent the Committee and preside over its affairs.
  • (2) The vice chairperson shall assist the chairperson, and perform duties of the chairperson on his/her behalf when the chairperson is unable to perform his/her duties due to an extenuating circumstance.
  • Article 15 (Meetings, etc.)(1) The chairperson shall convene meetings of the Committee and preside over such meetings.
  • (2) Meetings of the Committee shall be held with the attendance of a majority ofallmembers,andresolutionsonmattersshall be passed with the concurrent votes of a majority of the members present.
  • Article 16 (Administrative Secretary)
  • The Committee shall have one administrative secretary to conduct its affairs, and an officer in charge of affairs of the cultural content industry shall serve as an administrative secretary.
  • Article 17 (Requesting Relevant Agencies, etc. to Provide Cooperation)
  • Where necessary for deliberation, the Committee may have the relevant public official or the relevant expert attend a meeting to hear his/heropinion, or request the relevant agency, organization, etc. to provide cooperation, such as the submission of data and opinions.
  • Article 18 (Allowances, etc.)
  • When commissioned members and the relevant experts attend a meeting of the Committee, the Mayor may grant the man allowance and reimburse them for travel expenses within budget limits
  • Article 19 (Entrustment of Affairs)(1) Where necessary for the promotion of the cultural content industry, the Mayor may entrust affairs related to the cultural content industry to a non-profit corporation or organization
  • (2) Where the Mayor entrusts affairs pursuant to paragraph (1), he/she may subsidize a person entrusted with such affairs as necessary for the operation of facilities and the conduct of such affairs within budget limits.
  • Article 20 (Provisions of other Ordinances to be Applied Mutatis Mutandis)
  • The Busan Metropolitan Ordinance for the Management of Local Subsidies shall apply mutatis mutandis to subsidies, except as otherwise provided for in this Ordinance. [Amended by Ordinance No. 5081, Jan. 1, 2015]

  • This Ordinance shall enter into force one month after the date of its promulgation.
