Busan Metropolitan City Ordinance on Traffic Safety of School Road for Children

  • Article 1 (Purpose)
  • The ordinance aims at stipulating the requirements to protect child from the danger of traffic accident in the child safety zone and school walkway, designated pursuant to the Road Traffic Act Article 12, and ensuring the traffic safety in the child school walkways.
  • Article 2 (Definition)
  • The definitions of terms used in this Ordinance shall be as follows:
    • 1. “Child safety zone” means the zone designated to protect child (referring to persons age 13 or younger, and henceforth applied likewise) from the dangers of traffic accident, pursuant to the Road Traffic Act (hereafter called “Act”) Article 12.
    • 2. The term “primary schools etc.” means that kindergartens under Article 2(2) of the Early Childhood Education Act, and primary schools and special schools under Article 38 of the Elementary and Secondary Education Act; and
    • 3. “Daycare center” means the daycare center pursuant to the “Infant Care Act Article 10 (limited to the daycare center pursuant to the Road Traffic Act Enforcement Decree Article 14).
    • 4. “Education facility” means the elementary school and daycare center, as stipulated in Subparagraphs 2 and 3,
    • 5. “School walkway” means the child protection zone, pursuant to the Act Article 12, and the walkway deemed otherwise necessary by the mayor of Busan Metropolitan City (hereafter called “Mayor”) for the safety of walking child, out of major walkways which is used by child, under the education at the education facility, to move routinely from their home to the school facility.
  • Article 3 (Duties of the City)(1) The Busan Metropolitan City shall devise the policy for installment and improvement of various facilities for children’s traffic safety and prevention of children’s traffic accident.
  • (2) All the citizens must actively participate and cooperate in businesses and policies for children’s traffic safety.
  • Article 4 (Establishment of Basic Plan etc.)(1) The Mayor of Busan Metropolitan City (hereinafter referred to as the “Mayor”) shall establish a basic plan for improving protective areas for children(hereinafter referred to as the “basic plan”) every five years and shall establish a yearly enforcement plan every year.
  • (2) The basic plan under paragraph (1) shall include the following matters:
    • 1. Improvement goal and direction for the child safety zone and school walkway
    • 2. Status of the child safety zone and school walkway
    • 3. Signal and safety sign in the child safety zone and school walkway
    • 4. Installation, repair, and maintenance of the road accessories in the child safety zone and school walkway
    • 5. Shutdown or relocation plan for the road parking stalls installed in the child safety zone and school walkway
    • 6. Improvement and financial support for the child safety zone and school walkway
    • 7. Any other waling environment and traffic accident of the child safety zone and school walkway
  • (3) (3) The Mayor shall, if necessary for the establishment of the plan and the implement of the project under paragraph (1) and (2), take necessary matters such as consultation, approval, etc. of the agency concerned
  • Article 5 (Survey)
  • The Mayor shall conduct a survey to understand the status of, and improvements for, the traffic safety and road accessories for the child safety zone and school walkway each and every year to reflect in the Master Plan and the Implementation Plan in Article 4 Paragraph 1.
  • Article 6 (Safety Education for Children)(1) The Mayor may conduct the traffic safety education, if needed, for the child in elementary schools and in daycare centers.
  • (2) Traffic safety education for children under paragraph (1) shall be as each of the following subparagraphs;
    • 1. Education through the Children Traffic Safety Education Center established under Busan Metropolitan City Ordinance on the Establishment and Operation of the Busan Children Traffic Safety Education Center;
    • 2. Self-Education by elementary schools etc. and nursery schools through the production and distribution of traffic safety education for children program
    • 3. Other commissioned education of traffic safety special educational institutions etc.
  • Article 6-2 (Designation of Child School Walkway)(1) The Mayor may review traffic conditions and effectiveness of the area carefully and designate, as the child school walkway, a certain section of the surrounding roads of the child safety zone and the education facility, if deemed necessary to protect child from the danger of traffic accident.
  • (2) The Mayor may enforce the activities of the following subparagraphs for the safety of the child school walkway:
    • 1. Installation and management of the traffic safety facility pursuant to the Act Articles 3 and 4
    • 2. Installation and management of the road accessories pursuant to the Road Act Article 2
    • 3. Manpower placement for traffic guidance before and after child’s school attendance.
    • 3. Any school walkway improvement activity deemed otherwise necessary by the Mayor
  • Article 7 (Traffic Guidance Before and After Child’s School Attendance)
  • The Mayor may recommend the heads of elementary schools and daycare centers to have in place the traffic guidance team, run by teachers, parents, or a traffic volunteer organization, before and after school attendance, if necessitated for the traffic safety of child before and after school attendance.
  • Article 8 (Traffic Control in Child Safety Zone)
  • The Mayor may consult aggressively with the Busan Metropolitan Police and an in-charge police station and provide administrative and financial supports to entrench the traffic control by zone and hour in the child safety zone, pursuant to the stipulation on Designation and Management of Child, Elderly, and People of Disability Article 9.
  • Article 9 (Construction Site Management in Child Safety Zone)
  • (1) The Mayor may make or demand a safety management plan for child traffic safety to the construction sites in the child safety zone, if needed, and have the plan recorded and reflected in the construction specification.
  • (2) The safety management plan pursuant to Paragraph 1 shall incorporate the matters of the following subparagraphs:
    • 1. Traffic safety while under construction
    • 2. Placement of traffic guidance guide and installation of safety signs
    • 3. Installation, repair, and maintenance of road accessories in the child safety zone
    • 4. Advance discussion with the school principal and the daycare center director
    • 5. Hazard removal during construction works
    • 6. Waling environment and traffic accident prevention before and after construction
    • 7. Any matter deemed otherwise necessary by the Mayor
  • (3) The Mayor may recommend the district mayors and/or gun mayors, in charge of the management agency, to enforce the matters pursuant to Paragraphs 1 and 2.
  • Article 10 (Support)
  • The Mayor may give necessary support within the limit of the budget in case that traffic service organizations etc. provide traffic guidance before and after school for children’s safety.
  • Article 11 (Establishment of Cooperation System)
  • The Mayor shall cooperate closely with the Busan Metropolitan Policy, the Busan Metropolitan City Office of Education, and relevant organizations to advance the traffic safety policy for the child school walkway, and may form, and have in place, a consultative group, if need.
  • Supplementary Provision
  • The ordinance shall be in effect upon proclamation.
