Busan Metropolitan City Ordinance on the Establishment and Management of the Transportation Improvement Committee

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to deliberate on matters regarding the improvement of the traffic policy and transportation system of Busan Metropolitan City in order to improve transportation services such as the intra-city bus, local shuttle bus(Maul Bus), taxi, urban railroad, and etc. for the citizens, and to establish the Busan Metropolitan City Transportation Improvement Committee, and to prescribe such matters as the organization and management of the above committee to provide advice and suggestion as requested by the Mayor of Busan Metropolitan City
  • Article 2(Definitions of Terms)
  • The definitions of terms used in this Ordinance are as follows.
    • 1. "Transit Fare Discount System" refers to the system that provides a discount on the later fare for any transits among intra-city buses, local shuttle buses(Maul Buses), and urban railroad during the trip to destination.
    • 2. "Evaluation of Management and Service" refers to the system that evaluates the quality of the management condition of the intra-city bus transportation business operator and the service provided to the passengers following the enforcement of the quasi-public management system.
    • 3. "Quasi-Public Management System" refers to the system that authorizes Busan Metropolitan City to adjust and manage the route of intra-city buses and the operation channel, and assigns the intra-city bus transportation business operators to assume the operation of the intra-city bus and the management of labor relations and vehicles. In addition, Busan Metropolitan City guarantees proper income to the intra-city bus transportation operators according to the actual results of each route under this system
    • 4. "Urban Railroad" refers to the vehicles among the urban railroads prescribed in Article 3, Subparagraph 1 of the Urban Railroad Act
    • 5. "Public Transportation" refers to the intra-city bus, local shuttle bus (Maul Bus) and urban railroads among the public transportation means stipulated in Article 2, Subparagraph 1 of the Act on the Fosterage and Promotion of Public Transportation
  • Article 3(Functions)(1) The Busan Metropolitan City Transportation Improvement Committee(hereinafter referred to as the "Committee") deliberates on the following matters.
    • 1. Matters concerning the establishment of operation policies for intra-city buses, shuttle buses(Maul Buses), taxis and urban railroads
    • 2. Matters concerning the adjustment of intra-city bus routes
    • 3. Matters concerning fare adjustments of intra-city buses, taxis, and urban railroads
    • 4. Matters concerning the Transit Fare Discount System such as the standard and process of financial support for transit fare losses and operation deficits
    • 5. Matters concerning Quasi-Public Management System and evaluation of the intra-city bus management and service
    • 6. Matters concerning fostering and promoting the use of public transportation
    • 7. Matters concerning the transport support for the transportation underprivileged people.
    • 8. Other matters submitted for consideration which the mayor of Busan Metropolitan City feels the necessity of deliberation or consultationof the Committee..
  • (2) The Committee under Paragraph 1 shall carry out deliberation on matters which the Busan Metropolitan City Public Transportation Business and Service Evaluation Committee is to deliberate pursuant to Article 25 of the Enforcement Decree of the Act on the Fosterage and Promotion of Public Transportation.
  • Article 4(Composition)(1) The Committee shall consist of no more than 25 committee members including one chairman and one vice chairman.
  • (2) The Deputy Mayor for Administrative Affairs shall be the chairman and the chairman shall designate a vice chairman among the appointed committee members. The Committee members shall consist of the following persons.
    • 1. Assistant Mayor of Planning and Management, Chief of the Financial Management Office, Director General of the Transportation Bureau, Director of the Transportation Division of Busan Metropolitan City Police Agency.
    • 2. Person who is appointed among those listed in the following items by the Mayor of Busan Metropolitan City.
      • A. Persons who are recommended by the Busan Metropolitan Council
      • B. Professors of the fields relevant to transportation at universities under the Higher Education Act
      • C. Persons who arequalified as either a lawyer or a certified public accountant
      • D. Persons who are recommended by citizens' groups that are non-profit and non-governmental organizations stipulated in Article 2 of the Assistance for Non-profit Non-governmental Organizations Act.
      • E. Officers of public corporations such as the Busan Transportation Corporation or researchers of the transportation related research institutes
      • F. Representatives of the associations established pursuant to the Passenger Transport Service Act or representatives of the passenger transport service business operators and the people engaged in the transportation business.
      • G. Persons who haveabundant knowledge and experience in fields relevant to transportation
  • Article 5(Terms)
  • Appointed members of the Committee holds office for 2 years, and the consecutive appointment may be permitted. Yet, the term of office for a committee member who filled the vacancy shall be the remainder of the predecessor.
  • Article 6(Duties of the Chairman, etc.)(1) The chairman shall represent the Committee and exercise the overall control of the Committee.
  • (2) The vice chairman shall assist the chairman and act on behalf of the chairman when the chairman inevitably can not perform his/her duties. The committee member designated in advance by the chairman shall carry out the above duties when both the chairman and vice chairman inevitably can not perform his/her duties.
  • Article 7(Meeting)(1) The chairman convokes a meeting and becomes the chairman of the meeting.
  • (2) The chairman must inform all committee members on matters regarding the date and the place of a meeting, and the agendato be deliberated in the meeting 7 days before the actual meeting takes place. However, this does not apply in case of emergency
  • (3) The Committee meeting is to start with a majority of the registered Committee members present and shall pass a resolution with a majority vote of the Committee members who are present.
  • Article 8(Practical Affairs Committee)(1) The Committee may organize and operate Practical Affairs Committees for each specialized areas such as the route adjustment, the fare adjustment, the joint control of revenue, the evaluation of business and service, the transit support for the transportation underprivileged people, the expansion of using natural gas-driven cars, and etc. to deliberate professionally and effectively on matters that are to be considered at the Committee.
  • (2) The Practical Affairs Committee shall examine and adjust the agenda that is to be introduced to the committee in advance, and deal matters which the Committee entrusted to do.
  • (3) The chairman shall decide on matters necessary for the organization and operation of the Practical Affairs Committee with obtaining the Committee's favorable vote.
  • Article 9(Executive Secretary and Clerk)(1) The Committee shall have one executive secretary and one clerk to handle the affairs of the Committee.
  • (2) The director of the Transportation Improvement Division shall be the executive secretary and the deputy director of the above division who is in charge of the transportation improvement matters shall be the clerk.
  • Article 10(Request for Cooperation to Agencies Concerned)
  • The Committee and the Practical Affairs Committeemay request necessary cooperation such as asking relevant specialists or civil servants, etc. to be present to say their opinion and submitting data or opinions of the concerned agencies or organizations.
  • Article 11(Prohibition of Divulgence of Classified Information)
  • Committee members and relevant civil servants, etc. who were present at the meeting shallnot reveal any classified information obtained during the process of performing their duties.
  • Article 12(Allowance etc.)
  • Allowance and traveling expenses may be provided within the limit of the budget to the appointed Committee members.
  • Article 13(Managerial Rules)
  • The chairman shall decide on necessary matters other than that regulated in this Ordinance with the consent of the Committee.
