Busan Metropolitan City Ordinance on the Activation of the Use of Bicycles

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to contribute to the active use of bicycles by prescribing matters delegated by the Activation of the Use of Bicycles Act and its Decree and matters necessary for its enforcement.
  • Article 2 (Definition)
  • The definitions of terms used in this Ordinance shall be as follows:
    • 1. The term “bicycle repair shop” means the facility where a bicycle is checked for defects and a broken part is repaired; and
    • 2. The term “bicycle rental shop” means the facility where a bicycle is rented at free of charge or at charge to a person who wants to use it.
  • Article 3 (Duties of the City, etc.) (1) The Busan Metropolitan City shall devise the policy for promoting bicycle users’ safety and convenience and the project for the citizens’ participation.
  • (2) All the citizens must actively participate and cooperate in the active policy of the use of bicycles.
  • Article 4 (Establishment of the Maintenance Plan) (1) The Mayor of the Busan Metropolitan City (hereinafter referred to as the “Mayor”) shall establish the maintenance plan of the facilities for the use of bicycles under the Activation of the Use of Bicycles Act(hereinafter referred to as the “Act”) every five years, and shall establish and enforce the action plan for it.
  • (2) In case of establishing the action plan under paragraph (1), the following matters shall be included:
    • 1. Contents as prescribed in subparagraphs under Article 5 (2) of the Act;
    • 2. Matters regarding the management and operation of the facility of the use of bicycles; and
    • 3. Matters regarding the activation policy of the use of bicycles.
  • Article 5 (Promotion of the Establishment of the Facilities for the Use of Bicycles)
  • The Mayor may promote the establishment of the facilities for the use of bicycles to a person who establishes or operates collective housing, schools of all levels, large-scale facilities of distribution and sale, and large-scale equipment, etc.
  • Article 6 (Maintenance and Management of the Facilities for the Use of Bicycles)(1) A person establishing and managing the facilities for the use of bicycles shall always monitor and repair the facilities for the use of bicycles for the bicycle users’ safety and convenience.
  • (2) A person establishing and managing the facilities for the use of bicycles shall maintain and manage the facilities for the use of bicycles and the parked bicycles in order not to hinder the beauty of the city.
  • (3) The Mayor shall separately prescribe matters necessary for the management and operation of the facilities for the use of bicycles established by the Mayor.
  • Article 7 (Bicycle Parking Fees)
  • The parking fees of bicycle parking lots established by the Mayor (including the equipment for the bicycle parking and its lock under Article (2) 3 of the Enforcement Decree of the Activation of the Use of Bicycles Act) shall be free of charge.
  • Article 8 (Parking Priority of the Registered Bicycles)
  • A person establishing and managing bicycle parking lots shall be considerate by putting a parking priority to the registered bicycles under Article 22 of the Act.
  • Article 9 (Establishment of Bicycle Repair Shop or Bicycle Rental Shop)(1) The Mayor may establish and operate a bicycle repair shop or a bicycle rental shop in a place of great demand for the use of bicycles under Article 22 of the Act.
  • (2) The Mayor shall separately prescribe matters necessary for the method, etc. of the operation of a bicycle repair shop or a bicycle rental shop established and operated by the Mayor.
  • Article 10 (Designation and Operation of Demonstration Area or Demonstration Institution)(1) The Mayor may designate and operate demonstration areas or may designate and operate public institutions private enterprises, and schools, etc. as demonstration institutions for the activation of the use of bicycles.
  • (2) The Mayor shall try to promote to the residents, employees, and students of a demonstration area to use bicycles in commuting.
  • Article 11 (Establishment and Operation of the Bicycle Traffic Safety Education Center)
  • The Mayor may establish and operate the Bicycle Traffic Safety Education Center to provide education necessary for the right use of bicycles.
  • Article 12 (Support of Private Organization, etc)
  • The Mayor may establish and operate the Bicycle Traffic Safety Education Center to provide education necessary for the right use of bicycles.
    • 1. Organizations exploring or participating in the activation policy of the use of bicycles shall be registered with the Busan Metropolitan City for the purpose of expanding the base of the use of bicycles under Article 4 of the Assistance for Non-profit, Non-governmental Organizations Act; or
    • 2. Demonstration areas or demonstration institutions are designated and operated under Article 10.
  • Article 13 (Establishment of the Committee on the Activation of the Use of Bicycles) (1) The Mayor shall establish the Committee on the Activation of the Use of Bicycles to deliberate all matters regarding the bicycle policy including the activation of the use of bicycles and the improvement of the usage condition.
  • (2) The Committee shall deliberate the following matters:
    • 1. Establishment and change of the revision plan and action plan;
    • 2. Matters regarding the evaluation of the environmental improvement project;
    • 3. Matters reflecting residents’ opinions on the improvement of the conditions of the use of bicycles;
    • 4. Matters regarding citizens’ relations and training for the activation of the use of bicycles
    • 5. Matters regarding the support for the residents’ participatory activity project, and
    • 6. Other important matters for the activation of the use of bicycles
  • Article 14 (Composition of Committee)(1) The Committee shall consist of less than 15 members including one chairman and one vice chairman.
  • (2) The chairman shall be the Deputy Mayor for Administrative Affairs and the vice chairman of the committee shall be elected from among the members.
  • (3) The members shall be appointed or commissioned by the Mayor from among Director General for Transportations, Director General for Construction and Disaster, and the persons who fall under any of the following subparagraphs:
    • 1. One person recommended by the Busan Metropolitan Counsel;
    • 2. Public officers of the relevant organizations such as Busan Metropolitan Office of Education, Busan Metropolitan Police Agency, etc.;
    • 3. Representatives of civic groups practicing the activation policy of the use of bicycles; or
    • 4. Other persons having profound learning and experiences in the use of bicycles.
  • (4) The term of office of the commissioned members of the Committee shall be two years: Provided, that the term of office of a member elected to fill a vacancy shall be the remainder of the term of the predecessor.
  • Article 15 (Discharge of Member)
  • The Mayor may discharge the members from office for any of the following reasons:
    • 1. Where the member is deemed incapable or considerably hard to perform their duties due to long-term treatment for disease; or
    • 2. Where the member is deemed unsuitable for perform their duties due to socially having caused trouble or disgracing the dignity, etc.
  • Article 16 (Duties of Chairman, etc) (1) The chairman shall represent the Committee and exercise the overall control of the affairs thereof.
  • (2) The vice chairman shall assist the chairman, and if the chairman is unable to perform his/her duties due to an inevitable cause, the vice chairman shall act on behalf of the chairman.
  • Article 17 (Meeting, etc)(1) The chairman shall convene and preside over the meeting of the Committee.
  • (2) The meeting of the Committee shall be divided into the regular session and the extraordinary meeting: the regular meeting shall be held two times a year and the extraordinary meeting shall be convened by the chairman when the chairman deems it necessary or when more than a third of all members on the register demands it.
  • (3) The deliberation of a meeting of the Committee shall start by the attendance of a majority of all incumbent members, and its resolution shall require the consent of a majority of those present.
  • Article 18 (Secretaries)(1) For dealing with businesses of the Committee, the Committee shall have a secretary and a clerk respectively.
  • (2) A secretary shall be a director in charge of businesses related to bicycles.
  • Article 19 (Hearing, etc)
  • When the Committee deems it necessary for their deliberations, the Committee may hear the opinions of the relevant public officers or the experts and by getting them to attend or they may request the relevant institutions or organizations to help by submitting the materials and opinions.
  • Article 20 (Allowances, etc)
  • In the case where appointed members of the Committee and the relevant experts are required to attend a meeting, the allowances and travel expenses may be paid to them within the limits of budget.
  • Article 21 (Delegation and Entrustment of Authority) (1)The Mayor shall delegate the authority of the maintenance and management of the facilities of the use of bicycles to the head of a Gu/Gun.
  • (2) The Mayor may, if deemed necessary, entrust the part of the authority under this Ordinance to the relevant institutions or the private organizations.
