BUSAN METROPOLITAN CITY ORDINANCE ON THE ESTABLISHMENT AND OPERATION OF THE BUSAN GLOBAL VILLAGE

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to prescribe necessary matters on the establishment and operation of the Busan Global Village, which was jointly established by Busan Metropolitan City and the Busan Metropolitan City Office of Education to provide the youth and other citizens with opportunities to experience English-speaking environment and enhance their command of English.
  • Article 2 (Location)
  • The Busan Global Village shall be located at 734 Gayadae-ro (Bujun-dong), Busanjin-gu, Busan Metropolitan City. (Amended by Ordinance No. 4777, Jul. 11, 2012)
  • Article 3 (Users) (1) Persons eligible to use the Busan Global Village are as follows:
    • 1. Students of schools provided for in the Elementary and Secondary Education Act located in Busan Metropolitan City (hereinafter referred to as the "City");
    • 2. Youths provided for in subparagraph 1 of Article 3 of the Framework Act on Youth who reside in the City.
  • (2) The Busan Metropolitan City Mayor (hereinafter referred to as the "Mayor") may allow people other than those falling under each subparagraph of paragraph (1) to use the Busan Global Village to the extent that they do interfere with the operation of the Busan Global Village.
  • Article 4 (Service Fee) (1) The Mayor may impose a service fee on users of the Busan Global Village.
  • (2) The Mayor shall decide the amount of service fee under paragraph (1) in consideration of curricular and hours of the courses after consultation with the Busan Metropolitan City Superintendent of Education and deliberation of the Busan Global Village Operation Committee, and he or she shall publicly notify thereon in the Busan Metropolitan City’s official gazette.   • Article 5 (Exemption of Service Fee)
  • The Mayor may exempt any of the following persons from service fee: Provided, That this shall not apply to cases falling under Article 3 (2):
    • 1. Eligible recipients defined in paragraph 2 of Article 2 of the National Basic Living Security Act, persons in the second-lowest income bracket defined in paragraph 11 of the same Article, and their children;
    • 2. Persons eligible for protection referred to in Article 5 of the Single-Parent Family Support Act;
    • 3. Persons with disabilities registered pursuant to Article 32 of the Welfare of Persons with Disabilities Act;
    • 4. Persons who are exempt from tuition fee pursuant to the Act on the Honorable Treatment and Support for Persons of Distinguished Service to the State, or other statutes and regulations;
    • 5. Persons who obtain recommendation from the Busan Metropolitan City Superintendent of Education among those who fall under Article 3 of the Rules on Tuition and Entrance Fees of Schools;
    • 6. Members of Families with at least three children.
  • Article 6 (Return of Service Fee)
  • The Mayor shall return the service fee calculated on a daily basis where the user who already paid the fee can not use the Busan Global Village due to inevitable causes, such as illness and relocation of residence
  • Article 7 (Entrustment of Management and Operation) (1) For the effective management and operation of the Busan Global Village, the Mayor may outsource the management and operation to a institution, corporation, or organization in the field of English education.
  • (2) Where the Mayor intends to outsource the management and operation of the Busan Global Village, he or she shall make an outsourcing agreement with the outsourced person entrusted with such affairs (hereinafter referred to as the "outsourced person").
  • (3) The outsourced person shall prepare operation rules for the management and operation of the Busan Global Village and shall obtain approval from the Mayor. The same shall apply where he or she intends to change the operation rules.
  • Article 8 (Supervision and Management) (1) Where the Mayor entrusts the management and operation of the Busan Global Village pursuant to Article 7 (1), he or she may have the outsourced person report on the outsourced business or have relevant public officers examine and inspect the operation of facilities, related documents, etc.
  • (2) Where any matter requiring correction is discovered from the report or exmination and inspection under paragraph (1), the Mayor shall order the outsourced person to correct such matter or take other necessary measures.
  • Article 9 (Cancellation of Entrustment Contract)
  • The Mayor may cancel the outsoursing agreement in any of the following cases:
    • 1. Where the outsourced person violates related statutes, regulations, or this Ordinance;
    • 2. Where the outsourced person breaches the terms of outsourcing agreement;
    • 3. Where it is difficult to operate the facilities normally due to reasons for which the outsourced person is responsible.
  • Article 10 (Hearing)
  • The Mayor shall hold a hearing when the outsourcing agreement is to be cancelled pursuant to Article 9.
  • Article 11 (Busan Global Village Operation Committee) (1) The Busan Global Village Operation Committee (hereinafter referred to as the "Committee") shall be established to deliberate and decide on matters necessary for the management and operation of the Busan Global Village.
  • (2) The Committee shall be composed of not more than 11 members including two co-chairmen; the co-chairmen shall be the Deputy Mayor for Administrative Affairs and the Busan Metropolitan City Vice-superintendent of Education, and members shall be commissioned or appointed by the Mayor from among the following persons:
    • 1. Director-general-level public officials who perform affairs related to the Busan Global Village in the City or the Busan Metropolitan City Office of Education;
    • 2. Persons recommended by the Busan Metropolitan Council;
    • 3. Persons recommended by the Busan Metropolitan City Office of Education;
    • 4. Persons who have abundant knowledge and experience in the field of English education and are considered to be necessary for the effective management of the Busan Global Village.
  • (3) The term of office of the commissioned members of the Committee shall be two years and may be consecutively renewed only once.
  • (4) The Committee shall have two executive secretaries to handle the affairs of the Committee, and they shall be designated by the co-chairmen.
  • (5) A majority of the members of the Committee shall constitute a quorum, and any decision thereof shall require the concurring vote of at least a majority of those present.
  • (6) Allowances and traveling expenses may be provided within the budget to the commissioned members.
  • (7) The co-chairmen shall decide on necessary matters other than those prescribed in this Ordinance after resolution of the Committee.
  • Article 12 (Subsidy of Operational Cost)
  • The Mayor may partially subsidize expenses incurred in managing and operating the Busan Global Village within the budget after deliberation of the Committee.
  • ADDENDA
  • Article 1 (Enforcement Date)
  • This Ordinance shall enter into force one month after the date of its promulgation.
  • Article 2 (Preparations)
  • For the enforcement of Article 7, the Mayor may publicly announce the matters necessary to entrust the management and operation before this Ordinance enters into force.
