Busan Metropolitan City Ordinance on Regional Public Health and Medical Service Deliberation Committee
- Article 1 (Purpose)
- The purpose of this Ordinance is to provide for the matters concerning organization and operation of the Busan Metropolitan City Regional Public Health and Medical Service Deliberation Committee (hereinafter referred to as the "Committee") pursuant to the Article 2 of the Enforcement Decree of the Regional Public Health Act.
- Article 2 (Functions)
- The Committee shall respond to the request of consultation by the Mayor
of the Busan Metropolitan City(hereinafter referred to as the "Mayor") on
the following matters:
- 1. Matters concerning research on the actual condition of public health and medical service in the jurisdiction;
- 2. Matters concerning establishment of regional public health and medical service plan;
- 3. Matters concerning implementation of regional public health and medical service plan, and evaluation of performance thereof; and
- 4. Other matters which the Mayor deems necessary for the promotion of regional public health and medical service measure.
- Article 3 (Composition)(1) The members of the Committee shall be 20 or less persons including one chairperson and one vice-chairperson.
- (2) The committee members shall be designated or commissioned by the
Mayor from among the persons falling under any of the following
subparagraphs:
- 1. Regional residents;
- 2. Officers or employees of pubic health and medical service-related institutions and organizations;
- 3. Public health and medical service-related specialists; or
- 4. Related public officials.
- (3) The chairperson shall be the Deputy Mayor for Administrative Affairs, and the vice-chairperson shall be elected from among and by its members.
- Article 4 (Term of Office for Members)(1) The term of office of a member shall be two years, and consecutive appointment may be permitted: Provided, That the term of office of a member who is a public official shall be his or her tenure.
- (2) The term of office of a supplementary member shall be the remainder of his/her predecessor's term of office.
- Article 5 (Duty of the Chairperson, etc.)(1) The chairperson shall represent the Committee and exercise the overall control of the affairs thereof.
- (2) The vice-chairperson shall assist the chairperson, and in case where the chairperson is unable to perform his/her duties, the vice chairperson shall act on behalf of the chairperson.
- Article 6 (Meeting and Proceedings)(1) The chairperson shall convene the meeting, and shall be the chairperson thereof.
- (2) The meeting shall be divided into regular meeting and extraordinary meeting, and the regular meeting shall be convened once a year, and the extraordinary meeting shall be convened in case where the chairperson deems necessary.
- (3) The meeting shall start by the attendance of a majority of all incumbent members, and its resolution shall require the consent of a majority of those present.
- Article 7 (Report)
- The chairperson shall report the agenda which has been deliberated and decided at the meeting of the Committee to the Mayor without delay
- Article 8 (Secretary, etc.)(1) The Committee shall have one secretary, and one clerk, respectively.
- (2) The secretary shall be the chief of division in charge of public health and hygiene, and the clerk shall be the deputy director in charge of public health administration.
- (3) The secretary shall, by order from the chairperson, administer the affairs concerning the meetings of the Committee, and the clerk shall assist the secretary.
- Article 9 (Compensation for Actual Expenses)
- The Committee members who are not public officials may, in case where they are present at the meeting, or travel under their jurisdiction, be paid the allowances and travel expenses within the limit of the budget under the Busan Metropolitan City Ordinance on Committee Compensation for Actual Expenses.
- Article 10 (Request for Cooperation of Related Institution, etc.)
- The chairperson may, in case where he/she deems necessary, require the institution or organization related to public health and medical service to render their cooperation, such as submission of data, etc., and such institution or organization shall respond to the request unless there exists any justifiable cause.
- Article 11 (Holding Public Hearing, etc.)
- The chairperson may, in case where he/she deems necessary for deciding the agenda, hold a public hearing, etc.
