Busan Metropolitan City Ordinance on Revitalization of Medical Tourism

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to promote the medical tourism and to contribute to the development of local economy by providing for the necessary matters for the revitalization of medical tourism.
  • Article 2 (Definitions)
  • The definitions of terms used in this Ordinance are as follows:
    • 1. The term "medical tourism" means that the patient who is given medical treatment services, such as treatment, therapy, operation, etc., at the medical institutions in the jurisdiction of the Busan Metropolitan City and his/her companion take a tour combined with medical treatment services;
    • 2. The term "medical tourism specialist" means the person who connects foreign patient who wants to get medical treatment services, such as treatment, therapy, operation, etc., at the medical institutions in the jurisdiction of the Busan Metropolitan City with a competent medical team, and provides supports of stay and tour for the patient and his/her companion.
  • Article 3 (Establishment of Framework Plan for Revitalization of Medical Tourism)(1) The Mayor of the Busan Metropolitan City (hereinafter referred to as the "Mayor") shall establish and implement the framework plan for revitalization of medical tourism.
  • (2) The framework plan under paragraph (1) shall include following matters:
    • 1. Framework policy and direction for the revitalization of medical tourism;
    • 2. Matters concerning establishment of collaboration system among industry, university, and institute for the revitalization of medical tourism;
    • 3. Matters concerning support of inducement of medical tourists and cultivation of medical tourism specialist;
    • Measures for revitalization of medical tourism under Article 12-2 of the Tourism Promotion Act;
    • 5. Other matters necessary for revitalization of medical tourism.
  • Article 4 (Support of Cultivation of Medical Tourism Specialist)
  • The Mayor may, in order to provide support of foreigner's medical tourism, select excellent special education institution from among those institutions which cultivate medical tourism specialist, and may select excellent curriculum, and may provide support of part of education expenses for those institution and curriculum within the limit of the budget.
  • Article 5 (Support to Vanguard Medical Institution)(1) The Mayor may provide support of part of business expenses concerning medical tourism for the medical institution which, as the registered medical institution for the inducement of foreign patients under Article 27-2 of the Medical Service Act (hereinafter referred to as the "Vanguard Medical Institution"), has the possibility of taking central role and the will for the improvement of medical facilities, condition, and the standard of medical service, etc., within the limit of the budget.
  • (2) Matters necessary for the selection of Vanguard Medical Institution under paragraph (1) shall be determined separately by the Mayor.
  • Article 6 (Support of Revitalization of Medical Tourism)
  • The Mayor may provide support of following matters administratively or financially for the institution, juristic person, or organization concerning medical tourism in order to revitalize the medical tourism:
    • 1. Academic event for sharing and diffusion of knowledge and information concerning medical tourism;
    • 2. Overseas marketing and public relations activities concerning medical tourism;
    • 3.Control of statistics including present condition concerning inducement of foreign patients, etc.;
    • 4. Installation and operation of information center for inducement of medical tourism;
    • 5. Development of products in medical tourism, and establishment of network of medical tourism at home and abroad;
    • 6. Other matters necessary for the revitalization of medical tourism.
  • Article 6-2 (Functions and Organization of Medical Tourism Promotion Council) (1) The Mayor shall establish the Busan Medical Tourism Promotion Council (hereinafter referred to as the "Council") to deliberate on and consult the following matters for revitalizing medical tourism:
    • 1. Matters concerning establishing and suggesting medical tourism policies, and cultivating and supporting the same;
    • 2. Matters concerning deliberating on, assessing and consulting major projects for medical tourism;
    • 3. Other matters the chairperson submits to a conference concerning the revitalization of medical tourism.
  • (2) The Council consists of not more than 30 members, including each one chairperson and vice-chairperson.
  • (3) The administrative deputy mayor shall be the chairperson; the vice-chairperson shall be elected from members; and members shall be appointed or entrusted by the Mayor in consideration of gender equality among the following persons:
    • 1. Public officials of at least Grade III belonging to the Busan Metropolitan City;
    • 2. Persons recommended by the Busan Metropolitan City Council;
    • 3. Other persons with abundant knowledge and experience concerning medical tourism.
  • (4) The term of a member shall be two year, and he/she may be reappointed only once: Provided, That the term of a member filling a vacancy shall be the remainder of his/her predecessor's term.
  • (5) The chairperson shall represent the Council and supervise the affairs of the Council; and where the chairperson is unable to conduct his/her duties due to any extenuating circumstance, the vice-chairperson shall conduct such duties on behalf of the chairperson.[This Article Newly Inserted by Ordinance No. 5124, Apr. 1, 2015]
  • Article 6-3 (Meeting, etc. of Council) (1) While meetings of the Council shall be classified as regular meetings and extraordinary meetings, a regular meeting shall be held every year, in principle, and an extraordinary meeting shall be convened by the chairperson when the chairperson deems it necessary.
  • (2) A meeting of the council shall commence with a majority of the registered members present, and shall pass resolutions with consent of the majority of present members.
  • (3) Where it is necessary for deliberation on agenda items, the chairperson may have the relevant public officials and experts attend a meeting to hear their opinions, or request the relevant institutions and organizations to provide necessary cooperation such as submitting materials or opinions.
  • (4) The Council shall have one secretary and one clerk to process the affairs of the Council; the department head of medical tourism affairs shall be the secretary, and the assistant junior official of medical tourism affairs shall be the clerk.
  • (5) Allowances and travel expenses may be paid to the commissioned members and relevant experts, etc. who attend the Council.
  • (6) Matters necessary for operating the Council other than those expressly provided for in this Ordinance shall be determined by the chairperson by a resolution of the Council. [This Article Newly Inserted by Ordinance No. 5124, Apr. 1, 2015]
  • Article 6-4 (Exclusion, Challenge and Evasion of Members) (1) Where a member of the Council falls under any of the following, he/she shall be excluded from deliberation of the relevant agenda:
    • 1. Where a member or his/her current or former spouse becomes a party to the relevant agenda or is in the relationship of a joint manager or a joint responsible person with a party to the relevant agenda;
    • 2. Where a member is or was of a relative with the party of the relevant agenda;
    • 3. Where a member provided consultation, research or services concerning the relevant agenda;
    • 4. Where the corporation or organization, etc. to which a member belongs is or was an agent of the party of the relevant agenda.
  • (2) Where there are circumstances that the fair deliberation of a member is difficult, the party of the relevant agenda may file an application for challenge of such member to the Council, and the Council shall determine the challenge by voting. In such cases, the member subject to application of challenge may not participate in the relevant agenda.
  • (3) Where any ground of exclusion provided for in the subparagraphs of paragraph (1) arises to a member, the member shall evade from the deliberation for such agenda of his/her own accord. [This Article Newly Inserted by Ordinance No. 5124, Apr. 1, 2015]
  • Article 7 (Establishment and Operation of Exclusive Internet Homepage for Medical Tourism)(1) The Mayor may establish and operate the exclusive internet homepage for medical tourism in order to promote the inducement of medical tourists.
  • (2) Matters necessary for establishment and operation of exclusive internet homepage for medical tourism under paragraph (1) shall be determined separately by the Mayor.

  • Article 9 (Entrustment of Functions)
  • The Mayor may entrust his/her functions falling under following subparagraphs to the institutions, juristic persons or organizations related to medical tourism for the efficient revitalization of medical tourism. In this case, the Mayor may provide support of whole or part of the expenses within the limit of the budget:
    • 1. Functions concerning education for cultivation of the medical tourism specialist;
    • 2. Functions concerning promotion of international event related to medical tourism;
    • 3. Other functions necessary for the revitalization of medical tourism.

ADDENDUM (Ordinance No. 5124, Apr. 1, 2015)

  • This Ordinance shall enter into force on the date of its promulgation.
