BUSAN METROPOLITAN CITY ORDINANCE ON EMERGENCY MEDICAL SERVICE

- Article 1 (Purpose)
- The purpose of this Ordinance is to contribute to protecting the health and lives of citizens in emergency situations by prescribing matters necessary for the provision of emergency medical services and those concerning the organization and operation of the Emergency Medical Service Committee pursuant to the provisions of the Emergency Medical Service Act.
- Article 2 (Formulation of Regional Implementation Plan for Emergency Medical Service)(1) The Mayor of the Busan Metropolitan City (hereinafter referred to as the "Mayor") shall formulate a regional implementation plan for emergency medical service pursuant to Article 13-2 of the Emergency Medical Service Act (hereinafter referred to as the "Act") and shall actively endeavor to protect health and lives of emergency patients.
- (2) The regional implementation plan for emergency medical service shall
include the following:
- 1. A plan for the supply, education and training of emergency medical service personnel;
- 2. A plan for the evaluation of and assistance to emergency medical institutions;
- 3. A plan for improvement of the system for transportation of patients;
- 4. A plan for the operation of telecommunications systems for information about emergency medical service;
- 5. A plan for response by the emergency medical service system when many people are injured during a disaster, etc.;
- 6. A plan for education and publicity on guidelines for rescue and emergency measures;
- 7. Other matters deemed necessary by the Mayor for emergency medical service.
- (3) The Fire Marshal of the Fire Department of the Busan Metropolitan City shall ensure that programs related to 119 Rescue Forces, such as the transportation of emergency patients, are reflected in the plan for improvement of the system for transportation of patients under paragraph (2) 3 and shall submit materials necessary for the formulation of regional implementation plans for emergency medical service so as to efficiently implement education and publicity for the use of automatic external defibrillators and cardiopulmonary resuscitation under paragraph (2) 6.
- (4) The Mayor shall conduct a biennial survey on citizens' actual use of emergency medical service and their level of satisfaction with the service, and shall reflect the outcomes thereof in the regional implementation plan for emergency medical service to be formulated pursuant to paragraph (1).
- Article 3 (Education on Rescue and Emergency Measures)(1) Pursuant to Article 4 of the Act, the Mayor shall devise measures necessary to keep all citizens informed about emergency medical service as their rights and to facilitate education regarding the guidelines, etc. for rescue and emergency measures under Article 14 (2) of the Act.
- (2) The Mayor may, if deemed necessary, request the Superintendent of the Busan Metropolitan City Office of Education, etc. to cooperate with him/her for conducting education under paragraph (1) in a school specified in Article 2 of the Elementary and Secondary Education Act and Article 2 of the Higher Education Act
- (3) The Mayor may entrust affairs related to education on the guidelines, etc. for rescue and emergency measures to a corporation or an organization recognized as appropriate for the efficient implementation of such education.
- Article 4 (Financial Assistance to Emergency Medical Institutions, etc.)
- Pursuant to Article 16 of the Act, the Mayor may provide financial assistance to emergency medical institutions, etc. specified in Article 2 of the Act within budgetary limits, as necessary.
- Article 5 (Establishment of Emergency Medical Service Committee)(1) The Emergency Medical Service Committee to be established within the Busan Metropolitan City pursuant to Article 13-6 of the Act (hereinafter referred to as the "Committee") shall be comprised of not more than ten members, including one chairperson and one vice chairperson.
- (2) The chairperson of the Committee shall be designated by the Mayor from
among committee members, and the vice chairperson shall be elected by
and from among committee members, while committee members shall be
appointed or commissioned by the Mayor from among the following
persons:
- 1. Grade-IV or higher-ranking public official in charge of affairs related to health and medical service in the Busan Metropolitan City;
- 2. Fire officer in charge of rescue service in the Busan Metropolitan City;
- 3. Representative from emergency medical institutions specified in subparagraph 5 of Article 2 of the Act;
- 4. Representative from emergency medical information centers under Article 27 of the Act;
- 5. Representative from non-profit non-governmental organizations under Article 2 of the Assistance for Non-Profit, Non-Governmental Organizations Act;
- 6. Person with abundant knowledge and experience in emergency medical service.
- (3) The term of office of each commissioned committee member shall be two years, but may be renewed consecutively only once: Provided, That the term of office for a committee member commissioned to fill a vacancy shall coincide with the remaining term of office of his/her predecessor.
- Article 6 (Chairperson's Duty)(1) The chairperson shall represent the Committee and shall be responsible for all affairs of the Committee.
- (2) The vice chairperson shall assist the chairperson and shall act on behalf of the chairperson if the chairperson is unable to perform any of his/her duties.
- Article 7 (Meetings of Committee)(1) The chairperson shall convene meetings of the Committee and shall preside over such meetings.
- (2) A meeting of the Committee shall be duly formed with the attendance of a majority of current committee members, and a resolution at the meeting shall be adopted by concurring votes of a majority of the committee members present at the meeting.
- Article 8 (Secretary of Committee)
- The Committee shall have one secretary who shall deal with administrative affairs of the Committee, and the Grade-V officer in charge of emergency medical service shall serve as the secretary.
- Article 9 (Allowances, etc.)
- Commissioned committee members may be given allowances and reimbursed travel expenses within budgetary limits.
- Article 10 (Detailed Operating Rules, etc.)
- Except as otherwise provided in this Ordinance, matters necessary for the operation of the Committee shall be determined by the chairperson, subject to prior resolution by the Committee.
- Article 11 (Application Mutatis Mutandis)
- The Busan Metropolitan City Framework Ordinance on Entrustment to Private Sector shall apply mutatis mutandis to the entrustment of affairs under Article 3 (3).
- ADDENDA
- Article 1 (Enforcement Date)
- This Ordinance shall enter into force one month after the date of its promulgation.
- Article 2 (Repeal of other Ordinance)
- The Busan Metropolitan City Ordinance on the Emergency Medical Service Committee is hereby repealed
- Article 3 (Transitional Measure concerning Emergency Medical Service Committee)
- The Emergency Medical Service Committee operating within the Busan Metropolitan City under the Busan Metropolitan City Ordinance on the Emergency Medical Service Committee at the time this Ordinance enters into force shall be construed as the Emergency Medical Service Committee established pursuant to this Ordinance.
- Article 4 (Transitional Measure concerning Entrustment of Affairs)
- Affairs entrusted at the time this Ordinance enters into force shall be deemed to be entrusted under this Ordinance.
