Busan Metropolitan City Ordinance on Protection of the Aged

- Article 1 (Purpose)
- The purpose of this Ordinance is to enhance the rights and interests of the aged, and to enable them to live sound and stable old life, by providing for the necessary matters to prevent maltreatment of the aged, and to protect senior citizens.
- Article 2 (Definitions)
- The definitions of terms used in this Ordinance are as follows:
- 1. The term "maltreatment of the aged" means the maltreatment of the aged as prescribed in the Welfare of the Aged Act;
- 2. The term "specialized agency for protection of the aged" means the specialized agency for protection of the aged as prescribed in the Article 39-5(1) of the Welfare of the Aged Act; and
- 3. The term "shelter for the maltreated aged" means the facility which the Mayor of the Busan Metropolitan City (hereinafter referred to as the "Mayor") designates and operates among the welfare facilities for the aged under Article 31 of the Welfare of the Aged Act for the purpose of the protection of the maltreated aged separately from the family temporarily.
- Article 3 (Obligation)
- (1) The Busan Metropolitan City shall devise the policy measures necessary for the prevention of maltreatment of the aged and the protection of the aged(hereinafter referred to as the "protection of the aged").
- (2) Any citizen shall not maltreat the aged, and shall endeavor to protect the aged.
- Article 4 (Establishment and Enforcement of Implementation Plan of Protection of the Aged)
- (1) The Mayor shall establish and enforce the implementation plan related to protection of the aged (hereinafter referred to as the "implementation plan") every year.
- (2) The implementation plan shall include the following matters:
- 1. Matters concerning master plan and direction for the protection of the aged;
- 2. Matters concerning education and public relations activities for the protection of the aged;
- 3. Matters concerning financial resources of the projects for the protection of the aged; and
- 4. Matters concerning the construction of relationship with the related institutions for the protection of the aged.
- (3) The Mayor may, in case where he/she establishes the implementation plan, request cooperation to the related institutions, corporations or organization in advance on the matters as prescribed in the subparagraphs of the paragraph (2).
- Article 5 (Deliberation on the Master Plan for the Protection of the aged)
- The Busan Metropolitan City Elderly Welfare Policy Committee shall deliberate on the matters about elderly protection in the following subparagraphs:
- 1. Matters concerning master plan for the protection of the aged;
- 2. Matters concerning construction of relationship with the related institutions for the protection of the aged; and
- 3. Other matters which the Mayor submits to the meeting for the protection of the aged.
- Article 6 (Establishment of Elderly Protection Special Institution)
- ① The Mayor shall have in place an elderly protection special institution, which is charge of the works of the following subparagraphs, to process the discovery, protection, and treatment for the abused elderly and protect the elderly:
- 1. Operation of an elderly abuse reporting center, and case filing
- 2. Field investigation for the suspected case of elderly abuse
- 3. Consultation for abused elderly and elderly abuser
- 3-2 Request for legal aid for abused elderly
- 4. Consultation for the relevant family members and relevant institution for abused elderly
- 5. Preventive education and publicity for elderly abuse, and education for the human rights for the elderly
- 6. Operation of the Elderly Abuse Case Decision Committee to decide on elderly abuse cases
- 7. Operation of a shelter for the abused elderly
- 8. Any matter deemed otherwise necessary by the Mayor to protect the elderly
- ② The Mayor may designate a non-profit corporation and consign the operation of the elderly protection special institution to implement the elderly abuse prevention activities in an efficient manner.
- Artile 7 (Operation of Abused Elderly Shelter)
- (1) The Mayor shall designate and operate abused elderly shelters, out of the elderly welfare facilities in a district and/or gun and recommended by the district mayor or the gun mayor, to protect the abused elderly temporarily.
- (2) The head of an elderly welfare facility, designated as an abused elderly shelter, shall act immediately to accept an abused elderly, when a specialized elderly protection institution requests for the acceptance of the abused elderly, and notify the result to the specialized elderly protection institution.

- Article 8 (Support of Operating Expenses)
- The Mayor may support the "specialized agency for protection of the aged" or the "shelter for the maltreated aged" which performs the business concerning the protection of the aged with the partial amount of operating expenses within the limit of the budget.

- Article 9 (Public Relations Activities, etc.) <Mar. 24, 2021>
- (1) The Mayor shall do public relations activities through utilizing various types of media including newspaper, broadcast, etc., in order to enhance and improve public awareness of the protection of the aged.
- (2) The Mayor may organize and operate "voluntary service group for protection of the aged", in which the private organizations would participate, for the purpose of spreading and settling the activities concerning the protection of the aged throughout the whole city.
- (3) The Mayor shall provide the citizens with information related to protection of the aged, and shall manage the information system related to protection of the aged.

- Supplementary Provision
- Article 1 (Enforcement Date)
- This ordinance shall be in effect one month after proclamation.
- Article 2 (Amendment of Other Ordinance)
- The Busan Metropolitan City Ordinance for Social Welfare Committee shall be amended, in part, as follows:
- Article 2 Subparagraph 6 shall change to Subparagraph 7 in the article with a new incorporation of Subparagraph 6 as follows:
- 6. Examination on the basic policies for elderly protection, pursuant to the respective subparagraphs of the Busan Metropolitan City Ordinance on Elderly Protection Article 5.
- Supplementary Provision (Framework Ordinance for Elderly Welfare for Realization of Senior-friendly City) <April 1, 2015>
- Article 1 (Effective Date)
- The ordinance shall be in effect upon proclamation.
- Article 2 (Revision of Other Ordinance)

- ② The Busan Metropolitan City Ordinance on Elderly Protection shall be revised in part as follows:
- Article 5
- The non-subparagraph part of the Busan Metropolitan City Social Welfare Committee shall deliberate, pursuant to the Busan Metropolitan City Social Welfare Committee Ordinance, on the matters of the following subparagraphs for elderly protection” shall be substituted with “The Busan Metropolitan City Elderly Welfare Policy Committee shall deliberate on the matters of the following subparagraphs for elderly protection.”

- The ordinance shall be in effect upon proclamation, except that the revised regulation in Article 6 Paragraph 1 Subparagraph 3-2 shall be in effect on and after June 30, 2021.
