Busan Metropolitan City Ordinance on the Promotion and the Support of Social Contribution
- Article 1 (Purpose)
- The purpose of this Ordinance is to foster the sprit of social community by the social condition and environment for the social contribution, and thus to contribute the local development and the enhancement of citizen's welfare.
- Article 2 (Definitions)
- The definitions of the terms used in this Ordinance are as follows:
- 1."Social contribution" means donation of money or goods to other people, corporation or organization, or providing volunteering work without any payment;
- 2. "Social contributor" means individual (including a foreigner), corporation or organization that does social contribution.
- Article 3 (Obligation of the City)
- The Busan Metropolitan City (hereinafter referred to as the "City") shall make, recommend and support for the favorable environment for the autonomous social contribution by citizens.
- Article 4 (Plans for Social Contribution)
- The Mayor of Busan Metropolitan City (hereinafter
referred to as the "Mayor") shall prepare the following plans in order to promote the social
contribution:
- 1. Matters for the activation of social contribution;
- 2. Education on the social contribution and management of supporting program;
- 3. Providing information or supporting research regarding social contribution;
- 4. Development and utilizing of the social contribution index;
- 5. Publishing the data book on the social contribution;
- 6. Other matters necessary for the promotion of the social contribution.
- Article 5 (Social Contribution Award)The Mayor may award the following Social Contribution Award to anyone who distinctively contributed to the social contribution:

- 1. Sharing Prize: Those who greatly contributed to the social contribution mainly by using material resources;
- 2. Serving Prize: Those who greatly contributed to the social contribution mainly by using human resources;
- 3. Favoring Prize: Those who greatly contributed to the social contribution by connecting material and human resources.
- (2) The prizes pursuant to each subparagraphs pursuant to Paragraph 1 shall be classified into the First Prize and the Second Prize, and the shape, specification and the Social Contribution Mark pursuant to Article 11, Paragraph 1 shall be determined otherwise by the Mayor.
- Article 6 (Recommendation of Social Contribution Award Candidate)(1) Persons among the following subparagraphs may recommend candidates for the Social Contribution Award:

- 1. Persons who contributed to the social contribution;
- 2. Representatives of social welfare corporations or heads of social welfare facilities;
- 3. Representatives of institutions or organizations in the area of the social contribution;
- 4. Heads of Boroughs (Gu) and Counties (Gun);
- 5. Citizens no less than 10 persons.
- (2) The Mayor shall make a public notice regarding details for the recommendation of Social Contribution Award candidate pursuant to Paragraph 1 on the Busan City Gazette and Internet Website of Busan Metropolitan City by May 31st every year.
- (3) The Mayor shall get the deliberation of the Busan Metropolitan City Social Contribution Committee pursuant to Article 7 when he/she selects recipients of the Social Contribution Award among those who recommended pursuant to Paragraph 1 and 2.
- Article 7 (Social Contribution Committee)(1) The Mayor shall establish the Busan Metropolitan City Social Contribution Committee (hereinafter referred to as the "Committee") to deliberate matters of following subparagraphs:

- 1. Matters of the social contribution plan pursuant to Article 4;
- 2. Selection of recipients of the Social Contribution Award pursuant to Article 6;
- 3. Selection of those who can use the Social Contribution Mark pursuant to Article 11;
- 4. Other matters that the chairman submitted for consideration regarding social contribution.
- (2) The Committee may consult with institutions or organizations in the area of the social contribution about the plans for the social contribution, and may recommend the adjustment.
- (3) The Committee shall consist of no more than 20 members including one chairman and one vice chairman.
- (4) The chairman and vice chairman shall be elected among the members, and members of the
Committee shall be the Administrative Management Officer and Women & Family Policy Officer,
and those who are commissioned by the Mayor among those who fall under the following
subparagraphs:
- 1. Persons who are recommended by the Busan Metropolitan Council;
- 2. Representatives or members of volunteering organizations;
- 3. Representatives of social welfare organizations or heads of social welfare facilities;
- 4. Persons who have professional knowledge and abundant experience on the social contribution.
- (5) The chairman shall represent the Committee and exercise the overall control of the Committee.
- (6) The vice chairman shall assist the chairman and act on behalf of the chairman when the chairman inevitably can not perform his/her duties.
- (7) Commissioned members of the Committee holds office for 2 years, and the consecutive appointment may be permitted. However, the term of office for a committee member who filled the vacancy shall be the remainder of the predecessor.
- (8) The Committee meeting is to start with a majority of the incumbent Committee members present and shall pass a resolution with a majority vote of the Committee members who are present.
- (9) The Committee shall have one executive secretary, and the director in charge of social contribution shall be the executive secretary.
- (10) Payment of the allowances and travel expenses may, within limits of budget, be provided to the commissioned Committee members.
- (11) The chairmen shall decide on necessary matters other than that regulated in this Ordinance with the consent of the Committee.
- Article 8 (Practical Affairs Committee)(1) The Committee may have the practical affairs committees for the pre-deliberation of the agenda that will be deliberated by the Committee pursuant to Article 6, Paragraph 3.
- (2) The practical affairs committee shall consist of no more than 10 members including one chairman.
- (3) The chairman of practical affairs committee shall be elected among the members, and the members shall be commissioned by the chairman of the Committee among those who have professional knowledge and abundant experience on the social contribution
- (4) In regard to the operation of the practical affairs committee, from Paragraph 8 to 11 of Article 7 shall be applied mutatis mutandis.
- Article 9 (Social Contribution Information Center)(1) The Mayor may establish the Busan Metropolitan City Social Contribution Information Center (hereinafter referred to as the "Center") to manage the result of social contribution affairs and to collect and provide the information needed for the social contribution, and to consult about it.
- (2) The Mayor may entrust the operation of the Center to a non-profit corporation or organization for the efficient management.
- Article 10 (Social Contribution Week)
- In order to make social environment for the social contribution, the Mayor shall set the week starting from the Day of Social Welfare (September 7) and award the Social Contribution Award or host an exhibition for the social contribution.
- Article 11 (Social Contribution Mark, Etc.)(1) The Mayor may allow persons who received the Social Contribution Award pursuant to Article 5 to attach or post the Social Contribution Mark on the goods, documents or offices, etc.
- (2) The Mayor may render honorable treatment and support of the following subparagraphs to
persons who received the Social Contribution Award pursuant to Article 5:
- 1. Designating as a 'superb entrepreneur' pursuant to Article 4 of the Busan Metropolitan City Ordinance on the Honorable Treatment of Distinguished Businessmen and the Promotion of Business Activities (limited to cases of enterprises and entrepreneurs);
- 2. Inviting major City events and providing tickets for the cultural performance of the City;
- 3. Providing free use of public parking places operated by the City or consignees of the City;
- 4. Other necessary matters for the spiritual encouragement of the social contribution.
- (3) The term which the Social Contribution Mark can be attached or posted, and the honorable treatment and support can be given shall be 3 years from the date when the Social Contribution Award was conferred.
- Article 12 (Continuing Management of the Social Contribution Award)(1) The Mayor shall make the awardee pursuant to Article 5 return the Social Contribution Award if he/she received it with false or other illegal measures.
- (2) Article 6 of the Busan Metropolitan City Ordinance on the Honorable Treatment of Distinguished Businessmen and the Promotion of Business Activities shall be applied mutatis mutandis to matters about the suspension of honorable treatment and support for the social contributors.
