Ordinance on the Establishment and Operation of the Busan Metropolitan City Independence Memorial Center

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to prescribe necessary matters for the establishment and operation of the Busan Metropolitan City Independence Memorial Center (hereinafter referred to as the "Memorial Center") for honoring of our ancestors’ noble spirit of nationalism and the endeavor for independence and to form a sound attitude of younger generation to our nation.
  • Article 2 (Location)
  • The Memorial Center shall be located in 99-11 Bunji, 2 Ga, Dongdaeshin-dong, Seo-gu, Busan Metropolitan City.
  • Article 3 (Services)
  • The Memorial Center shall provide the following services :
    • l. Business for the enhancement of national spirit
    • 2. Service for the succession of the patriotism of the ancestors
    • 3. Excavation service for patriots and historical materials
    • 4. Operation of an exhibition hall
    • 5. Other services relevant to the purpose of establishment
  • Article 4 (Entrustment of management and operation)For the promotion of the professional management and utilization of the Memorial Center, the Mayor of Busan Metropolitan City (hereinafter referred to as the "Mayor") mayentrust the management and operation of the Memorial Center to a local public corporation or a non-profit corporation if deemed necessary.
  • (2) The period of entrustment pursuant to Paragraph l shall be 3 years, and may be extended if deemed necessary by the Mayor.
  • (3) Upon obtaining approval from the Mayor, the consignee shall establish a provision on the management and operation of the Independence Memorial Center, which is necessary for the operational procedures, and shall duly comply. The same is applied for its revision.
  • Article 5 (Operational Cost, etc)
  • The operational cost for the Memorial Center shall be covered by the consignee, however, the Mayor may partially subsidize the cost.
  • Article 6 (Cancellation of Operation Entrustment)
  • The Mayor may cancel the entrustment contract in any case of the following subparagraphs:
    • l. When the consignee’s operation interferes with the purpose of the Memorial Center.
    • 2. When the consignee neglects management duties or alters the facilities on his/her own discretion.
    • 3. When the consignee violates the operation and management entrustment contract.
    • 4. When the legitimate instructions of the Mayor is not carried out.
    • 5. lf there is any cause that hinders operation entrustment for the public good.
  • Article 7 (Hearing)
  • The Mayor shall conduct a hearing when the entrustment contract is to be cancelled pursuant to from subparagraph l to subparagraph 4 of Article 6.
  • Article 8 (Duties of the Consignee)(1) The consignee shall put in his/her utmost effort in the business that widely expands our national spirit and succeeds the will of the patriotic ancestors, and properly operate for the Independence Society Members and many citizens to utilize the facility.
  • (2) The consignee shall abide by the provisions of this Ordinance and the contract details, and perform the instructions of the Mayor necessary for business such as orders or disposition.
  • Article 9 (Accounting Management)
  • The consignee shall prepare a accounting related register for accounting purposes and shall submit this upon the Mayor’s request.
  • Article 10 (Management of Property)The consignee shall manage the entrusted property with caution as a well-intentioned manager.
  • (2) The consignee shall not use the entrusted property for any other purpose than the operation purpose of the Memorial Center.
  • (3) The consignee shall obtain pre-approval from the Mayor in order to alter or repair the facilities of the entrusted property. However, in case of emergencies, the consignee may take minimal action and shall report on the details immediately.
  • Article 11 (Indemnification for Damage and Application for Accident Insurance)(1) In case the consignee loses or damages the facilities on purpose or out of gross negligence, he/she shall indemnify for the damage.
  • (2) The consignee shall have accident insurance in order to preserve the damage inflicted on the entrusted property and shall submit the certificate of insurance to the Mayor.
  • Article 12 (Supervision and Management)(1) The Mayor shall be reported on the operation of the facilities from the consignee no less than once a year and may examine related registers, documents and its operation, or may make necessary dispositions for supervision purposes.
  • (2) The Mayor may take necessary measures in case amendment is needed according to the result of the reported matters or the examination, pursuant to Paragraph 1.
