Busan Metropolitan City Ordinance on the Establishment and Operation of the Special Fund Account on the Medical Care Assistance
- Article 1 (Purpose)
- The purpose of this Ordinance is to efficiently manage the Medical Allowance Fund (hereinafter referred to as the "Fund") pursuant to Article 25 of the Medical Care Assistance Act by establishing a Special Fund Account (hereinafter referred to as the "Account") and prescribe necessary matters for the operation of the Fund.
- Article 2 (Financial Resources of Fund)
- The financial resources of the Fund shall be from the subsidy from the National Treasury, contributions from Busan Metropolitan City, surplus after settlement of the Fund account, profits incurred from the operation of the Fund, and other profit earnings.
- Article 3 (Tax Revenue and Expenditures)
- This Account deems the financial resources of the Fund as the revenue, and the grant money to the beneficiaries in accordance with the Medical Care Assistance Act (hereinafter referred to as the "beneficiary") and the related expenses as the expenditure.
- Article 4 (Grant Application of the Fund)
- For the head of Borough(Gu) and County(Gun) to commence the medical assistance for the beneficiaries by applying for the Fund grant, they shall submit requests following the from in the annexed Form to the Mayor of Busan Metropolitan City (hereinafter referred to as the "Mayor").
- Article 5 (Standard for the Grant)(1) When the Mayor grant the Fund to the head of Borough(Gu) and County(Gun), a condition in which the fund may be wholly or partially withdrawn or a condition, which necessary measures may be taken shall be entailed if any of the following occurs.

- l. When the Fund is used for other than the original purpose.
- 2. When the supervision order, pursuant to the related laws and Municipal Ordinances is not fulfilled.
- 3. When adjustment is deemed necessary for the operation of the Fund
- (2) lf the head of Bor0ugh(Gu) and County(Gun) lends the Fund to the beneficiary, no interest shall be levied and the Fund shall be redeemed on the quarterly basis.
- (3) When the Fund that has been lent, pursuant t0 the provision of Paragraph 2, is redeemed by the beneficiary the head of the Borough(Gu) and County(Gun)shall return the Fund.
- Article 6 (Accounting related officials)
- Pursuant to Article 16 of the Enforcement Decree of the Medical Care Assistance Act, the Director General of Welfare and Health Bureau shall be appointed as the Fund Expenses Commanding Official and the deputy director who deals with Livelihood Security Affairs shall be appointed as the Fund Accounting Public Official.
- Article 7 (Responsibilities of the accounting officials)
- Provisions in the Local Finance Act on the responsibility of accounting officials and collection officers shall apply mutatis mutandis to the Fund Expenses Commanding Official and the provisions on public official in charge of expenditures and treasurers shall apply mutatis mutandis to the Fund Accounting Public Official.
- Article 8 (Reporting, etc.)
- The head of Borough(Gu) and County(Gun) who have received Fund grant shall prepare a document on the settlement of the following subparagraphs and submit it to the Mayor by the end of February of the following year.
- l. A summarized table of the revenue and expenditure
- 2. A breakdown on the settlement
- 3. An account document on the settlement surplus
- 4. Written evidence of the expenditure of the lent fund and redemption.
- Article 9 (Application mutatis mutandis)
- With the exception of the related laws and this Ordinance, all shall be in accordance with the example of general accounting custom.
