Busan Metropolitan City Ordinance on the Approval of the Installation of Booths and Vending Machines in Public Facilities

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to prescribe necessary matters to give privilege to the disabled to start a business when the installment of booths or vending machines is approved or is entrusted for selling commodities such as foods, office supplies, and newspaper (hereinafter referred to as the "articles of food, etc".) in public facilities, which Busan Metropolitan City Establishes and Manages according to Article 38 of the Welfare of Disabled Persons Act.
  • Article 2 (Scope of Application)
  • (1) The scope of providing approval or entrustment of the installment of booths or vending machines for the disabled to sell commodities and articles of food etc. are as follows:
    • l. Busan Metropolitan City Hall and other Public Office buildings
    • 2. Public facilities which are directly managed by Busan Metropolitan City or other offices
    • 3. The public facilities of the local public corporations, which Busan Metropolitan City has entirely financed
  • (2) When booths or vending machines for selling articles of food etc. in public facilities are to be installed, it shall be in accordance with this Ordinance, with the exception of matters prescribed by other laws.
  • Article 3 (Advance Notice)
  • When the Mayor of the Busan Metropolitan City, Heads of Public Offices, or the local public corporation head (hereinafter referred to as the "installer") installs a booth or a vending machine under Article 2, Paragraph l, they must give advance notice in accordance with Article 82 of the Enforcement Decree of the Budget and Accounts Act and Article 2O of the Rule on Contract Business.
  • Article 4 (Application Qualifications and Required Documents)
  • The qualification for the application of the installment of booths or vending machines to sell articles of food, etc and commodities is the disabled registered under Article 29 of the Welfare of Disabled Persons Act, and they shall prepare the required documents and apply t0 the installer.
    • l. Contract application form
    • 2. (Deleted)
    • 3. Registration card for the disabled
    • 4. Certificate of the Basic Livelihood Security beneficiary (if applicable)
  • Article 5 (Preferential Contract)(1) If there is an application for a contract pursuant to Article 4, the installer shall enter a preferential contract with the applicant than non-disabled persons Within the scope of 50%.
  • (2) lf there are more than 2 applicants pursuant to Article 4, the order shall be determined as follows, and the installer shall decide on a person who will not hinder the operation of the business.
    • l. Disabled person who is a beneficiary of the Basic Livelihood Security
    • 2. Person with a higher disability level
  • Article 6 (Duties of the Contractor)
  • The contractor pursuant to Article 5 shall operate the business by himself / herself, and if there is an inevitable ground for which the contractor cannot directly operate the business, it may be entrusted upon obtaining approval from the installer.
  • Article 7 (Utilization Fee)
  • The standard for imposing the utilization fee from the installation of the booth and vending machine shall be conformed to the property management regulation of the mattered organization and the terms of contract.
  • Article 8 (Municipal Rule)
  • Necessary matters concerning the enforcement of this Ordinance shall be prescribed by municipal rules.
